Ministry of Consumer Affairs, Food and Public Distribution (Department of Consumer Affairs) notification G.S.R. 456(E) dated 23 June 2023, issued under sub-section (1) read with clauses (j) and (q) of sub-section (2) of section 52 of the Legal Metrology Act, 2009 (1 of 2010), promulgates the Legal Metrology (Packaged Commodities) (Amendment) Rules, 2023, effective from the date of publication in the Official Gazette. The amendment modifies rule 6 of the Legal Metrology (Packaged Commodities) Rules, 2011: for electronic products, packages may declare via QR code, instead of directly on the package, the name of the manufacturer/packer/importer and address (proviso to clause (a) of sub-rule (1)), the common or generic name and quantity of the commodity (proviso to clause (b)), the size and dimension of the commodity (proviso to clause (f)), and the telephone number and email address (proviso to sub-rule (2)). The principal rules were published vide G.S.R. number 202(E) dated 7 March 2011 and were last amended vide notification number G.S.R. 412(E) dated 5 June 2023. EXTRAORDINARY PART II —Section 3 —Sub-section ( i) PUBLISHED BY AUTHORITY No. 367] NEW DELHI, FRIDAY, JUNE 23, 2023/ASHADHA 2, 194 5 CG-DL-E-23062023-246773 MINISTRY OF CONSUMER AFFAIRS, FOOD AND PUBLIC DISTRIBUTION (Department of Consumer Affairs) NOTIFICATION New Delhi, the 23 rd June, 2023 G.S.R. 456(E).—In exercise of the powers co nferred by sub -section (1), read with clauses (j) and (q) of sub-section (2), of section 52 of the Legal Metrology Act, 2009 (1 of 2010), the Central Government hereby makes the following rules further to amend the Legal Metrology (Packaged Commodities) R ules, 2011, namely: - 1. (1) These rules may be called the Legal Metrology (Packaged Commodities) (Amendment) Rules, 2023. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Legal Metrology (Packaged Co mmodities) Rules, 2011, in rule 6, - (a) in sub -rule (1), - (i) in clause (a), for the proviso, the following proviso shall be substituted, namely: - “Provided that in the case of an electronic product, the package of such product shall declare the name of the manufacturer or packer or importer, as the case may be, on the package itself, and such declaration shall also inform the consumers to scan the QR code for the address and other related information, if such information is declared through the QR Code a nd not declared on the package itself;’ (ii) in clause (b), for the proviso, the following proviso shall be substituted, namely: - “Provided that in the case of an electronic product, the package of such product shall inform the consumers to scan the QR co de for the common or generic name of the commodity and where such package contains more than one product, then for the name and number or quantity of each product, if such information is declared through the QR Code and not declared on the package itself”; (iii) in clause (f), for the proviso ,the following proviso shall be substituted, namely: - “Provided that in the case of an electronic product, the package of such product shall inform the consumers to scan the QR code for the size and dimension of the c ommodity if such information is declared through the QR Code and not declared on the package itself”; (b) in sub -rule (2), for the proviso, the following proviso shall be substituted, namely: - “Provided that in the case of an electronic product, the pack age of such product shall declare the telephone number and e -mail address on the package itself, and such declaration shall also inform the consumers to scan the QR code for other related information if such information is declared through the QR Code and not declared on the package itself.”.
