These regulations amend the principal Petroleum and Natural Gas Regulatory Board (Authorizing Entities to Lay, Build, Operate or Expand Natural Gas Pipelines) Regulations, 2008, originally notified vide G.S.R.340(E), dated 6.05.2008. Key amendments include: in regulation 2, clause (1), sub-clause (j), a definition for 'Performance Bond' is inserted to include Demand Draft, Pay Order, Bank Guarantee from any scheduled bank of India, or Insurance Surety Bond from Insurance Companies licensed/authorized by Insurance Regulatory and Development Authority of India (IRDAI) for the specified amount. In regulation 8, clause (1), it is specified that Insurance Surety Bonds will be accepted up to a maximum of 50% of the specified amount, with the balance 50% accepted via other instruments mentioned in regulation 2(1)(j), although entities can provide 100% security using Bank Guarantee/DD/Pay Order. Regulation 17, clause 3, sub-clause (b) sees the deletion of the words 'or bank guarantee'. Additionally, a proviso is inserted after sub-clause (b) in regulation 17, clause (3), stipulating that in case of encashment of a performance bond, a Bank Guarantee will be encashed first, followed by an Insurance Surety Bond and other instruments. No. PNGRB/Comm/7Misc (5)/2025 (E-5734)/02.-In exercise of the powers conferred by Section 61 of the Petroleum and Natural Gas Regulatory Act, 2006 (19 of 2006), the Petroleum and Natural Gas Regulatory Board hereby makes the following regulations, namely: - 1. Short title and commencement. (1) These regulations may be called the Petroleum and Natural Gas Regulatory Board (Authorizing Entities to Lay, Build, Operate or Expand Natural Gas Pipelines) amendment Regulations, 2025. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Petroleum and Natural Gas Regulatory Board (Authorizing Entities to Lay, Build, Operate or Expand Natural Gas Pipelines) Regulations, 2008- (a) In regulation 2, clause (1), sub clause (j), defining Performance Bond shall be inserted: "The Performance Bond, as the case may be, shall include Demand Draft or Pay Order or Bank Guarantee from any scheduled bank of India or Insurance Surety Bond from Insurance Companies Licensed / authorized by Insurance Regulatory and Development Authority of India (IRDAI) for the amount as specified in the regulation". 3. In Regulation 8, clause (1), after the word “Explanation”, the following words shall be inserted :- "The performance Bond by way of Insurance Surety Bonds will be accepted to the extent of maximum upto 50% of the amount as specified in the regulation and balance 50% will be accepted by way of any of other instruments as mentioned in the definition of Performance Bond at regulation 2 (1) (j)”. However, Entity is free to provide the performance security by way of Bank Guarantee/DD/Pay Order to the extent of 100% of the value as stipulated in the respective regulation. 4. In regulation 17, clause 3, sub clause (b), the word “or bank guarantee" shall be deleted. 5. In regulation 17, clause (3), after sub clause (b), the following proviso shall be inserted: "Provided that in case of encashment of performance Bond, firstly Bank Guarantee will be encashed followed by Insurance Surety Bond and other instruments, as the case may be."
