L.-33004/99 The Gazette of India CG-DL-E-17012025-260291 EXTRAORDINARY PART II-Section 3-Sub-section (i) PUBLISHED BY AUTHORITY No. 36] NEW DELHI, FRIDAY, JANUARY 17, 2025/PAUSHA 27, 1946 MINISTRY OF INFORMATION AND BROADCASTING NOTIFICATION New Delhi, the 17th January, 2025 G.S.R. 65 (E)- In exercise of the powers conferred under sub-sections (1) and (2) of section 22 of the Cable Television Networks (Regulation) Act, 1995 (7 of 1995), the Central Government hereby makes the following rules further to amend the Cable Television Networks Rules, 1994, namely:- 1. Short title and commencement. - (1) These rules may be called the Cable Television Networks (Amendment) Rules, 2025. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Cable Television Networks Rules, 1994, (hereinafter referred to as the said rules), in rule 2, - (i) after clause (aa), the following clause shall be inserted, namely:- "(ab) "designated portal" means the Broadcast Seva Portal or any other portal notified by the Central Government;”. (ii) for clause (e), the following clause shall be substituted, namely: - "(e) "registering authority" means the registering authority notified under clause (h) of section 2 of the Act;" 3. In the said rules, for rule 3, the following rule shall be substituted, namely: - "3. Application for registration as a local cable operator in India. - (1) Every application for registration as a local cable operator shall be made online and may be renewed after every five years. (2) The application for registration or renewal of registration shall be made online to the registering authority in Form 1. (3) Every application for registration or renewal of registration shall be accompanied by- (i) a processing fee of rupees five thousand only ; and (ii) the requisite documents mentioned in Form 1; and, (iii) declaration in Form 2. (4) The processing fee for registration or renewal of registration shall be paid as per the option provided in the designated portal. (5) The application for renewal of registration by a cable operator under rule 5 shall be made at least ninety days before the expiry of registration. Provided that the registering authority may condone the delay after considering the reasons furnished by the applicant, if such application is made before the expiry of registration.". 4. In the said rules, for rule 5, the following rule shall be substituted, namely: "5. Registration of local cable operator: - (1) On receipt of application for registration or renewal of registration as the case may be for local cable operator, complete in all respects, certified by the applicant and verified in an automated manner, the registering authority, may (a) if deemed necessary, undertake further verification on specific applications, selected on predetermined criteria to ensure that the applicant fulfils eligibility criteria under rule 2A and the requirements of rule 3; and (b) subject to the requirements of rule 3 and terms and conditions specified in rule 5A, issue certificate of registration or renewal of registration, as the case may be, in Form 3. (2) Where the registering authority is satisfied that registration or renewal of registration cannot be granted, it shall inform the applicant of the reasons for such refusal. (3) The applicant may file an appeal to the Central Government as referred to in second proviso to sub-section (5) of section 4 of the Act against the refusal of grant or renewal of registration online within a period of thirty days of receipt of communication of such refusal. (4) The registration granted to local cable operators shall be valid throughout the territory of India.” 5. In the said rules, in rule 11C, after sub-rule (2), the following proviso shall be inserted namely: "Provided that the applicant may prefer an appeal against the order of the registering authority refusing grant or renewal of registration, to the Central Government within a period of thirty days of receipt of communication of such refusal." 6. (iii) Copy of PAN card of the association. (iv) Copy of last Income-Tax return, if any. (v) Copy of GST Registration Certificate, if any. (C) In case of companies (i) A copy of the certificate of Incorporation of the company along with copies of Memorandum of Association and Articles of Association, details of Board of Directors, chief executives and shareholding pattern. (ii) Proof of identity of Directors, chief executives and shareholders with 10% or more shares. (iii) Copy of PAN Card of the company. (iv) Copy of last Income-Tax return, if any (v) Copy of GST registration certificate, if any. (Note 1- Copy of Aadhaar Card to serve as proof of identity. Any person desirous of applying for registration, who does not possess Aadhaar number or is unwilling to furnish Aadhaar number shall be required to furnish the PAN along with one of the following documents as proof of identity, namely;- (i) Bank or Post office Passbook with Photo; or (ii) Passport; or (iii) Ration Card; or (iv) Voter Identity Card; or (v) Driving License issued by the Licensing Authority under the Motor Vehicles Act, 1988(59 of 1988); or (vi) Certificate of identity having photo of such person issued by a Gazetted Officer or a Tehsildar on a official letter head; or (vii) Any other document as specified by the Ministry of Information and Broadcasting. Note 2- In case of any change in the above particulars, same shall be intimated to the registering authority within a period of thirty days of such changes taking place through online designated portal. 10. Declaration in Form 2 on a stamp paper of Rs. 10 enclosed Yes / NO PART B 1. Name of Applicant (individual/firm/company/association of persons/body of individuals) * 2. This certificate is only valid throughout the territory of India. 3. This certificate is subject to the condition that the applicant shall not carry any programming service provided on the channel generated at the level of such cable operator, which is in violation of the programme and advertisement code laid down in rule 6 and 7 respectively of the Cable Television Networks Rules, 1994. 4. This registration certificate is not transferable. 5. The certificate shall remain valid for the period indicated above or till the holder carries on the cable service or till the surrender of the certificate is accepted by the competent authority.
