By notification G.S.R. 102(E), dated 6th February 2024, the Ministry of Personnel, Public Grievances and Pensions (Department of Personnel and Training), exercising powers under sub-section (1) of section 3 of the All India Services Act, 1951 (61 of 1951), and after consultation with the State Governments concerned, notifies the All India Services (Death-cum-Retirement Benefits) Amendment Rules, 2024, effective from the date of publication in the Official Gazette. The amendment inserts a new sub-rule (7A) after sub-rule (7) of rule 8 of the All India Services (Death-cum-Retirement Benefits) Rules, 1958, providing that a member of service deputed on foreign service to the United Nations Secretariat or other United Nations bodies, the International Monetary Fund, the International Bank for Reconstruction and Development, the Asian Development Bank, the Commonwealth Secretariat, or any other international organisation may opt either (a) to pay pension contributions for such foreign service at rates prescribed by the Central Government and have that service counted as qualifying for retirement benefits, or (b) not to pay such contributions and not have the foreign service counted as qualifying service, with any contributions already paid to be refunded if the member so opts. L.-33004/99 The Gazette of India CG-DL-E-06022024-251867 EXTRAORDINARY PART II-Section 3-Sub-section (i) PUBLISHED BY AUTHORITY No. 93] NEW DELHI, TUESDAY, FEBRUARY 6, 2024/MAGHA 17, 1945 822 GI/2024 MINISTRY OF PERSONNEL, PUBLIC GRIEVANCES AND PENSIONS (Department of Personnel and Training) NOTIFICATION New Delhi the 6th February, 2024 G.S.R. 102(E). — In exercise of the powers conferred by sub-section (1) of section 3 of the All India Services Act, 1951 (61 of 1951), the Central Government, after consultation with the Government of the States concerned, hereby makes the following rules further to amend the All India Services (Death-cum-Retirement Benefits) Rules, 1958, namely:— 1. (1) These rules may be called the All India Services (Death-cum-Retirement Benefits) Amendment Rules, 2024. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the All India Services (Death-cum-Retirement Benefits) Rules, 1958, in rule 8, after sub-rule (7), the following sub-rule shall be inserted, namely:- "(7A) A member of service who is deputed on foreign service to the United Nations' Secretariat or other United Nations' Bodies or the International Monetary Fund or the International Bank of Reconstruction and Development or the Asian Development Bank or the Commonwealth Secretariat or any other International organisation may opt – (a) to pay the pension contributions in respect of his foreign service, at such rates as the Central Government may, from time to time, prescribe and count such service as qualifying for retirement benefits under these rules; or (b) not to pay the pension contributions in respect of his foreign service and not to count such service as qualifying for retirement benefits under these rules: Provided that where a member of service opts for clause (b), pension contributions, if any, paid by the member of service, shall be refunded to him."
