No. 14021/01/2023-AIS-II), exercising powers under sub-sections (1) and (1A) of section 3 of the All India Services Act, 1951 (61 of 1951), these rules, titled the Indian Forest Service (Pay) Amendment Rules, 2023 and deemed to have come into force from 1 January 2016, substitute sub-rule (10) of rule 5 of the Indian Forest Service (Pay) Rules, 2016 (originally notified vide GSR 924(E) dated 28 September 2016 and last amended vide GSR 916(E) dated 30 December 2021) to provide that on promotion to a higher grade, a member of the Service may opt to have pay fixed in the higher Level either from the date of promotion or from the date of subsequent increment in the lower scale, with the Explanatory Memorandum certifying that no member of the Indian Forest Service is likely to be adversely affected by the retrospective effect.

L. -33004/99 EXTRAORDINARY PART II —Section 3 —Sub-section ( i) PUBLISHED BY AUTHORITY No. 692] NEW DELHI, TUESDAY , DEC EMBER 5, 2023/ AGRAHAYANA 14, 1945 CG-DL-E-05122023-250438 [फा. सं. 14021/01/2023 -अ.भा.से.-II] MINISTRY OF PERSONNEL, PUBLIC GRIEVANCES AND PENSIONS (Department of Personnel and Training ) NOTIFICATION New Delhi, the 5th December , 2023 G.S.R. 875(E).— In exercise of the powers conferred by sub -sections (1) and (1A) of section 3 of the All India Services Act, 1951 (61 of 1951), the Central Government hereby makes the following rules further to amend the Indian Forest Service (Pay) Rules, 2016, namely: ─ 1. (i) These rules may be called the Indian Forest Service (Pay) Amendment Rules, 2023. (ii) They shall be deemed to have come into force on the 1st day of January, 2016. 2. In the Indian Forest Service (Pay) Rules, 2016, in rule 5, for sub -rule (10), the following sub -rule shall be substituted, namely: - “(10) On promotion from one grade to another in the Service, a member of the Service shall have an option to get his pay fixed in the Lev el of the higher post either from the date of his promotion or from the date on which he subsequently earns an increment in the lower scale in the manner provided in the relevant sub -rule above; in the latter case, on the date of promotion, a member of Ser vice shall be placed at the next higher cell in the Level to which he or she is promoted with further re -fixation to be done in the manner provided in relevant sub -rule above with effect from the 1st day of January, or the 1st day of July, the date of accr ual of next increment in the lower scale.” [F. ASHOK KUMAR , Director Explanatory Memorandum: The Central Government has decided to amend sub -rule 10 of rule 5 of the Indian Forest Service (Pay) Rules, 2016 which provides for the fixation of pay of IFS officers on their promotion from one grade to anot her. The Indian Forest Service (Pay) Rules, 2016 are being amended accordingly with effect from the 1st January, 2016. It is certified that no member of the Indian Forest Service is likely to be adversely affected by giving retrospective effect to these rules.
