(i) These rules may be called the Indian Police Service (Pay) Amendment Rules, 2023. (ii) They shall be deemed to have come into force on the 1st day of January, 2016. 2. In the Indian Police Service (Pay) Rules, 2016, in rule 5, for sub -rule (9), the following sub -rule shall be substituted, namely: - “(9) On promotion from one grade to another in the Service, a member of the Service shall have an option to get his pay fixed in the Level of the higher post either from the date o f his promotion or from the date on which he subsequently earns an increment in the lower scale in the manner provided in the relevant sub-rule above; in the latter case, on the date of promotion, a member of Service shall be placed at the next higher cell in the Level to which he or she is promoted with further re -fixation to be done in the manner provided in relevant sub -rule above with effect from the 1st day of January or the 1st day of July, the date of accrual of the next increment in the lower scale. ” [F. ASHOK KUMAR, Director Explanatory Memorandum: The Central Government has decided to amend sub -rule 9 of rule 5 of the Indian Police Service (Pay) Rules, 2016 which provides for the fixation of pay of IPS officers on thei r promotion from one grade to another. The Indian Police Service (Pay) Rules, 2016 are being amended accordingly with effect from the 1st January, 2016. It is certified that no member of the Indian Police Service is likely to be adversely affected by givi ng retrospective effect to these rules. Note: The principal rules were published in the Gazette of India, Extraordinary, vide notification number GSR 910 (E) dated the 23rd September, 2016 and last amended vide notification number GSR 915(E) dated the 30th December, 2021.
