The Health and Family Welfare Department, Government of the National Capital Territory of Delhi, acting under the proviso to Article 309 of the Constitution read with Ministry of Home Affairs Notification No. S.O.3532 dated 24.09.1968, and in supersession of its earlier Notification No. F.2(37)/85-S.II dated 01.09.1986, notifies vide F. No. 50(52)/DC/Estt./2022/475 dated 19th August 2024 the Drugs Control Department, Drug Controller Recruitment Rules, 2024, made by the Lt. Governor of Delhi after prior consultation with the Union Public Service Commission, governing recruitment to the single post of Drug Controller (General Central Service, Non-Ministerial, Gazetted, Group A, Pay Level 13, Rs. 123100-215900) in the Drugs Control Department; the rules bar appointment of persons who have contracted bigamous marriages (subject to exemption where permissible under personal law), empower the Government to relax provisions in consultation with the UPSC, preserve reservations for Scheduled Castes, Scheduled Tribes, Other Backward Classes, Ex-servicemen and other special categories, and prescribe that the post is filled 100% by promotion of a Deputy Drugs Controller (Level 12) with five years' regular service and a postgraduate degree in Chemistry, Pharmaceutical Chemistry, Bio-Chemistry, Pharmacy or Pharmacology, failing which by deputation of officers with five years' regular service in Level 12 posts from Central/State Governments or Union Territories.

No. 50(52)/DC/Estt./2022/475.—In exercise of the powers conferred by the proviso to Article 309 of the constitution read with Government of India, Ministry of Home Affairs Notification No. S.O.3532 dated 24.09.1968 and in supersession of this Government Notification No. F.2(37)/85-S.II dated 01.09.1986, except as respects things done or omitted to be done before such supersession, the Lt. Governor of the National Capital Territory of Delhi, after prior consultation with Union Public Service Commission, hereby makes following rules regulating the method of recruitment to the post of Drug Controller in the Drugs Control Department, Government of National Capital Territory of Delhi as following, namely: 1. Short title and commencement— (i) These rules may be called the Drugs Control Department, Drug Controller Recruitment Rules, 2024 (ii) They shall come into force on the date of their publication in the Official Gazette. 2. Number of post, Classification and Pay Level in Pay Matrix- The number of the said post, its classification and the pay level in the pay matrix attached thereto shall be specified in columns (2) to (4) of the Schedule annexed to these rules. 3. Method of recruitment, age limit, qualifications, etc.- The method of recruitment, age limit, qualifications and other matters relating to the said post shall be as specified in columns (5) to (13) of the said Schedule aforesaid. 4. Disqualification.- No person, (a) Who has entered into or contracted a marriage with a person having a spouse living; or (b) Who, having a spouse living, has entered into or contracted a marriage with any person, Shall be eligible for appointment to the said post: Provided that the Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule. 5. Power to Relax- Where the Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing, and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons. 6. Saving- Nothing in these rules, shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Other Backward Classes, Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.
