No. 8/108/NCORD/2023/HP-II/275-286.— In accordance with the Prevention of Illicit Traffic in Narcotic Drugs and Psychotropic Substances Act, 1988 and the Operational Manual issued there-under, and for the purpose of streamlining the procedure relating to preventive detention cases, the Competent Authority hereby constitutes a Screening Committee comprising the following officers to examine, review and recommend cases of preventive detention under the said Act, as proposed by the sponsoring authority:— • Composition of the Screening Committee: 1. Commissioner of Police, Delhi | Chairman 2. Pr. Secretary (LJ & LA) | Member 3. Jt. Commissioner of Police (Crime) | Member 4. Zonal Director, NCB Delhi (Or his nominee) | Member 5. Representative of Directorate of Revenue Intelligence (DRI) | Member 6. Representative of Central Bureau of Investigation (CBI) | Member [PART IV | DELHI GAZETTE : EXTRAORDINARY | 3 • Functions of the Screening Committee:- o To scrutinize proposals received from sponsoring agencies for preventive detention under PITNDPS Act, 1988. o To evaluate the material evidence, nature of offences, and threat to public order posed by the accused. o To make recommendations to the Detaining Authority based on its findings. o The recommendations of the Screening Committee shall be advisory in nature and not binding on the Detaining Authority. • Procedure of Screening Committee:- o The Screening Committee shall meet as and when required. o The Committee may seek additional information or clarification from the sponsoring agency, if necessary. o The final decision on issuing detention orders shall rest with the Detaining Authority, based on subjective satisfaction.
