Delhi, the 15th April, 2024
**F. No. 50(7)/DC/Estt./2023/SS/HFW/420.-**In exercise of the powers conferred by the proviso to Article
309 of the constitution read with Government of India, Ministry of Home Affairs Notification No. S.O. 3532 dated
24.09.1968 and in supersession of the Notification No. F.53/143/94-H&FW/4064 dated 29.01.2001, except as respects
things done or omitted to be done before such supersession, the Lt. Governor of the National Capital Territory of
Delhi after prior consultation with Union Public Service Commission, hereby makes following rules regulating the
method of recruitment to the post of Senior Scientific Assistant (Chemistry) in the Drugs Control Department,
Government of National Capital Territory of Delhi, namely:
**1. Short title and commencement—**
(i) These rules may be called the Drugs Control Department, Senior Scientific Assistant (Chemistry)
Recruitment Rules, 2024
(ii) They shall come into force on the date of their publication in the Official Gazette.
**2. Number of post, Classification and Pay Level in Pay Matrix—** The number of the said post, its
classification and the pay level in the pay matrix attached thereto shall be specified in columns (2) to (4) of
the Schedule annexed to these rules.
**3. Method of recruitment, age limit, qualifications, etc.—**The method of recruitment, age limit, qualifications
and other matters relating to the said post shall be as specified in columns (5) to (13) of the said Schedule
aforesaid.
**4. Disqualification.—**No person,
(a) Who has entered into or contracted a marriage with a person having a spouse living; or
(b) Who, having a spouse living, has entered into or contracted a marriage with any person,
Shall be eligible for appointment to the said post:
Provided that the Government may, if satisfied that such marriage is permissible under the personal law
applicable to such person and the other party to the marriage and that there are other grounds for so
doing, exempt any person from the operation of this rule.
**5. Power to Relax—** Where the Government is of the opinion that it is necessary or expedient so to do, it may,
by order and for reasons to be recorded in writing, and in consultation with the Union Public Service
Commission, relax any of the provisions of these rules with respect to any class or category of persons.
**6. Saving—** Nothing in these rules, shall affect reservations, relaxation of age limit and other concessions
required to be provided for the Scheduled Castes, the Scheduled Tribes, Other Backward Classes, Ex-
servicemen and other special categories of persons in accordance with the orders issued by the Central
Government from time to time in this regard.

NOTIFICATION
Delhi, the 15th April, 2024
**G.S.R. 293(E).—**In exercise of the powers conferred by section 78 of the Employees’ State Insurance Act, 1948 (34 of 1948) and in supersession of the Employees’ State Insurance (Central) Rules, 1950, except as respects things done or omitted to be done before such supersession, the Central Government, after consultation with the Employees’ State Insurance Corporation, hereby makes the following rules, namely:—
**1. Short title and commencement.—**
(1) These rules may be called the Employees’ State Insurance (Central) Rules, 2024.
(2) They shall come into force on the date of their publication in the Official Gazette.
**2. Definitions.—**
(1) In these rules, unless the context otherwise requires,—
(a) “Act” means the Employees’ State Insurance Act, 1948 (34 of 1948);
(b) “appointed day” means the date on which these rules come into force;
(c) “benefit period” means the period specified in rule 6;
(d) “Corporation” means the Employees’ State Insurance Corporation constituted under the Act;
(e) “dependant” means any of the following relatives of a deceased insured person, namely:—
(i) a widow, a minor legitimate or adopted son, an unmarried legitimate or adopted daughter;
(ii) a widowed mother;
(iii) if wholly dependent on the earnings of the insured person at the time of his death, a legitimate or adopted son or daughter who has attained the age of eighteen years and is infirm;
(iv) if wholly or in part dependent on the earnings of the insured person at the time of his death,—
(A) a parent other than a widowed mother;
(B) a minor illegitimate son, an unmarried illegitimate daughter, or a daughter legitimate or adopted or illegitimate if married and a minor or if widowed and a minor;
(C) a minor brother or sister, a widowed daughter-in-law, a minor child of a deceased son or a minor child of a deceased daughter where no parent of the child is alive, or a paternal grandparent if no parent of the insured person is alive;
(f) “Director-General” means the Director-General of the Corporation;
(g) “Family” means all or any of the following relatives of an insured person, namely:—
(i) a spouse;
(ii) a minor legitimate or adopted child dependent upon him;
(iii) a child who is wholly dependent on the earnings of the insured person and who is—
(A) receiving education till he attains the age of twenty-five years; or
(B) an unmarried daughter;
(iv) a child who is infirm by reason of any physical or mental abnormality or injury and is wholly dependent on the earnings of the insured person, irrespective of his age;
(v) a dependent parent whose monthly income from all sources does not exceed the limit specified by the Corporation for parents;
(vi) a dependent married daughter whose husband is permanently disabled or dies and she is residing with her parents;
(vii) a dependent widowed sister residing with the insured person and whose husband has died and she has no income, as may be specified by the Corporation;
(viii) a dependent divorced or separated daughter residing with the insured person and who has no income, as may be specified by the Corporation;
(ix) a dependent widowed daughter-in-law residing with the insured person whose husband has died and she has no income, as may be specified by the Corporation;
(h) “Government” means the Central Government;
(i) “insured person” means a person who is or was an employee in respect of whom contributions are or were payable under the Act and who is by reason thereof entitled to any of the benefits provided by the Act;
(j) “medical practitioner” means a person holding a qualification granted by an authority specified or notified under section 3 of the Indian Medical Degrees Act, 1916 (7 of 1916) or included in any of the Schedules to the Indian Medical Council Act, 1956 (102 of 1956), and who is enrolled in a State Medical Register;
(k) “wage period” means the period in respect of which contributions are payable;
(l) “wage limit” means the maximum amount of wages specified by the Central Government under sub-section (5) of section 2 of the Act;
(m) words and expressions used herein and not defined, but defined in the Act, shall have the meanings respectively assigned to them in the Act.
(2) For the purposes of these rules, a person shall be deemed to be a minor if he is under the age of eighteen years.
**3. Powers and functions of the Corporation and Standing Committee.**
(1) The Corporation shall have the power to administer the Employees’ State Insurance Scheme and to make bye-laws, consistent with the provisions of the Act and these rules, for the administration of its affairs and for carrying into effect the provisions of the Act and these rules.
(2) The Standing Committee shall exercise such powers and perform such functions as are assigned to it by the Corporation or as may be delegated to it by the Corporation from time to time.
**4. Benefit period.—**
(1) A benefit period shall be of one of the following durations, namely:—
(a) six months; or
(b) twelve months.
(2) The Corporation shall fix the benefit period for each insured person from time to time, as it may deem fit.
(3) Where the Corporation has fixed a benefit period of six months for an insured person, the corresponding contribution period shall be a period of six consecutive months, commencing on the first day of the calendar month in which the contribution period begins and ending on the last day of the sixth calendar month thereafter.
(4) Where the Corporation has fixed a benefit period of twelve months for an insured person, the corresponding contribution period shall be a period of twelve consecutive months, commencing on the first day of the calendar month in which the contribution period begins and ending on the last day of the twelfth calendar month thereafter.
**5. Contributions.—**
(1) The rate of contribution payable by the employer and employee shall be such as may be specified by the Central Government from time to time by notification in the Official Gazette.
(2) The contributions shall be payable in respect of each wage period during which an employee is employed:
Provided that where the employee is employed for part of a wage period, the contribution shall be payable for the whole of such wage period.
**6. Method of payment of contributions.—**
(1) The employer shall pay the contributions in respect of each employee, whether directly employed by him or through a contractor, by depositing the amount in such bank or through such electronic means as may be specified by the Corporation.
(2) The employer shall furnish to the Corporation such returns and information relating to the contributions as may be specified by the Corporation.
**7. Records to be maintained by the employer.—**
(1) Every employer shall maintain such records and registers as may be specified by the Corporation, including—
(a) an attendance register;
(b) a wage register;
(c) a contribution register; and
(d) such other records as may be necessary for the purpose of these rules.
(2) The employer shall preserve the records and registers for a period of five years from the date of the last entry therein.
**8. Inspection of records.—**
(1) Any Inspector appointed under the Act may, at any reasonable time, enter any establishment or premises where an employee is employed and inspect any records, registers, or other documents relating to the contributions payable under these rules.
(2) The employer shall provide all necessary facilities to the Inspector for the purpose of inspection.
**9. Medical benefit.—**
(1) An insured person and his family members shall be entitled to medical benefit, as may be specified by the Corporation, which may include medical treatment, attendance, consultation, diagnostic services, medicines, injections, and hospitalization.
(2) The medical benefit shall be provided at such hospitals, dispensaries, clinics, or other medical institutions as may be established or recognized by the Corporation.
**10. Sickness benefit.—**
(1) An insured person shall be entitled to sickness benefit for such period as may be specified by the Corporation, subject to the fulfillment of such conditions as may be prescribed.
(2) The sickness benefit shall be at such rate as may be specified by the Central Government from time to time by notification in the Official Gazette.
**11. Maternity benefit.—**
(1) An insured woman shall be entitled to maternity benefit for such period as may be specified by the Corporation, subject to the fulfillment of such conditions as may be prescribed.
(2) The maternity benefit shall be at such rate as may be specified by the Central Government from time to time by notification in the Official Gazette.
**12. Disablement benefit.—**
(1) An insured person who sustains an employment injury shall be entitled to disablement benefit, as may be specified by the Corporation, which may include temporary disablement benefit and permanent disablement benefit.
(2) The disablement benefit shall be at such rate as may be specified by the Central Government from time to time by notification in the Official Gazette.
**13. Dependants’ benefit.—**
(1) Where an insured person dies as a result of an employment injury, his dependants shall be entitled to dependants’ benefit, as may be specified by the Corporation.
(2) The dependants’ benefit shall be at such rate as may be specified by the Central Government from time to time by notification in the Official Gazette.
**14. Funeral expenses.—**
(1) Where an insured person dies, the person who incurs the expenditure on his funeral shall be entitled to receive funeral expenses, as may be specified by the Corporation.
(2) The funeral expenses shall be at such rate as may be specified by the Central Government from time to time by notification in the Official Gazette.
**15. Rehabilitation allowance.—**
(1) An insured person who is undergoing physical or occupational rehabilitation at an institution specified by the Corporation shall be entitled to rehabilitation allowance, as may be specified by the Corporation.
(2) The rehabilitation allowance shall be at such rate as may be specified by the Central Government from time to time by notification in the Official Gazette.
**16. Other benefits.—**
(1) The Corporation may provide such other benefits to insured persons and their family members as it may deem fit, consistent with the provisions of the Act and these rules.
(2) The Central Government may, by notification in the Official Gazette, specify any other benefit to be provided under these rules.
**17. Payment of benefits.—**
(1) All benefits payable under these rules shall be paid in such manner and at such intervals as may be specified by the Corporation.
(2) No benefit shall be assignable or transferable, nor shall it be liable to attachment or sale in execution of any decree or order of any court.
**18. Adjudication of disputes.—**
(1) Any dispute or question arising under these rules shall be decided by the Employees’ Insurance Court established under section 74 of the Act.
(2) An appeal shall lie from an order of the Employees’ Insurance Court to the High Court in accordance with the provisions of section 82 of the Act.
**19. Miscellaneous provisions.—**
(1) The Corporation may, with the previous approval of the Central Government, make bye-laws for carrying into effect the provisions of these rules.
(2) The Central Government may, by order, amend or vary any of the provisions of these rules.
(3) All orders, instructions, and directions issued by the Central Government or the Corporation, consistent with the provisions of the Act and these rules, shall be binding on all persons concerned.
