The Health and Family Welfare Department, Government of the National Capital Territory of Delhi, dated 10th April 2024 (F. No. 50(6)/DC/Estt./2023/DS/HfW/1), in exercise of powers under the proviso to Article 309 of the Constitution read with Ministry of Home Affairs Notification No. S.O. 3532 dated 24.09.1968, and in supersession of Notification No. F.53/143/94-H&FW/4058 dated 29.01.2001, notified the Drugs Control Department, Junior Scientific Officer (Microbiology) Recruitment Rules, 2024, effective from the date of publication, after prior consultation with the Union Public Service Commission; the rules govern the single sanctioned post of Junior Scientific Officer (Microbiology) (01 post for 2024, subject to variation), classified as General Service, Non-Ministerial, Gazetted, Group B, at Pay Level 7 (Rs. 44,900-142,400), filled as a Selection Post; the rules include a disqualification bar on candidates who have contracted a bigamous marriage (with an exemption power for the Government), a power to relax provisions in consultation with the Union Public Service Commission, and a saving clause preserving reservations and age relaxations for Scheduled Castes, Scheduled Tribes, Other Backward Classes, Ex-servicemen and other special categories.

NOTIFICATION
Delhi, the 10th April, 2024

F. No. 50(6)/DC/Estt./2023/DS/HfW/1.—In exercise of the powers conferred by the proviso to Article 309
of the constitution read with Government of India, Ministry of Home Affairs Notification No. S.O. 3532dated
24.09.1968 and in supersession of the Notification No. F.53/143/94-H&FW/4058 dated 29.01.2001, except as respects
things done or omitted to be done before such supersession, the Lt. Governor of the National Capital Territory of
Delhiafter prior consultation with Union Public Service Commission, hereby makes following rules regulating the
method of recruitment to the post of Junior Scientific Officer (Microbiology) in the Drugs Control Department,
Government of National Capital Territory of Delhi, namely:

1.  Short title and commencement-
    (i) These rules may be called the Drugs Control Department, Junior Scientific Officer (Microbiology)
        Recruitment Rules, 2024
    (ii) They shall come into force on the date of their publication in the Official Gazette.

2.  Number of post, Classification and Pay Level in Pay Matrix- The number of the said post, its
    classification and the pay level in the pay matrix attached thereto shall be specified in columns (2) to (4) of
    the Schedule annexed to these rules.

3.  Method of recruitment, age limit, qualifications, etc.-The method of recruitment, age limit, qualifications
    and other matters relating to the said post shall be as specified in columns (5) to (13) of the said Schedule
    aforesaid.

4.  Disqualification.-No person,
    (a) Who has entered into or contracted a marriage with a person having a spouse living; or
    (b) Who, having a spouse living, has entered into or contracted a marriage with any person,
    Shall be eligible for appointment to the said post:
    Provided that the Government may, if satisfied that such marriage is permissible under the personal
    law applicable to such person and the other party to the marriage and that there are other grounds for so
    doing, exempt any person from the operation of this rule.

5.  Power to Relax- Where the Government is of the opinion that it is necessary or expedient so to do, it may,
    by order and for reasons to be recorded in writing, and in consultation with the Union Public Service
    Commission, relax any of the provisions of these rules with respect to any class or category of persons.

6.  Saving- Nothing in these rules, shall affect reservations, relaxation of age limit and other concessions
    required to be provided for the Scheduled Castes, the Scheduled Tribes, Other Backward Classes, Ex-
    servicemen and other special categories of persons in accordance with the orders issued by the Central
    Government from time to time in this regard.

NOTIFICATION

New Delhi, the 1st January, 2025

**F. No. [Your File No.]**—In exercise of the powers conferred by [Relevant Act/Regulation Name] and all other
powers enabling it in this behalf, the [Issuing Authority Name] hereby makes the following regulations, namely:—

**1. Short title and commencement.—**
    (1) These regulations may be called the [Name of Regulations], 2025.
    (2) They shall come into force on the date of their publication in the Official Gazette.

**2. Definitions.—**
    (1) In these regulations, unless the context otherwise requires,—
        (a) “Act” means the [Specific Act Name] (XX of YYYY);
        (b) “Authority” means the [Specific Authority Name] established under section [X] of the Act;
        (c) “Chairperson” means the Chairperson of the Authority;
        (d) “Member” means a Member of the Authority;
        (e) “Secretary” means the Secretary to the Authority;
        (f) words and expressions used herein and not defined but defined in the Act, shall have the same meanings
            respectively assigned to them in the Act.

**3. Composition of the Authority.—**
    (1) The Authority shall consist of a Chairperson and such number of Members, not exceeding [number], as the
        Central Government may appoint.
    (2) The Chairperson and the Members shall be appointed by the Central Government on the recommendation of a
        Selection Committee constituted for the purpose.

**4. Term of office and conditions of service.—**
    (1) The Chairperson and every Member shall hold office for such period not exceeding [number] years from the
        date on which he enters upon his office, or until he attains the age of [age] years, whichever is earlier.
    (2) The Chairperson or a Member may, by notice in writing under his hand addressed to the Central Government,
        resign his office:
        Provided that the Chairperson or a Member shall, unless he is permitted by the Central Government to relinquish
        his office sooner, continue to hold office until the expiry of three months from the date of receipt of such notice
        or until a person duly appointed as his successor enters upon his office or until the expiry of his term of office,
        whichever is the earliest.
    (3) The salaries and allowances payable to, and other terms and conditions of service of the Chairperson and
        Members shall be such as may be prescribed by the Central Government.

**5. Removal of Chairperson and Members.—**
    The Central Government may remove the Chairperson or any Member from office if he—
    (a) has been adjudged an insolvent; or
    (b) has been convicted of an offence which, in the opinion of the Central Government, involves moral turpitude; or
    (c) has become physically or mentally incapable of acting as Chairperson or a Member; or
    (d) has acquired such financial or other interest as is likely to affect prejudicially his functions as Chairperson or a
        Member; or
    (e) has so abused his position as to render his continuance in office detrimental to the public interest.

**6. Vacancies not to invalidate proceedings.—**
    No act or proceeding of the Authority shall be invalid merely by reason of—
    (a) any vacancy in, or any defect in the constitution of, the Authority; or
    (b) any defect in the appointment of a person as a Chairperson or a Member; or
    (c) any irregularity in the procedure of the Authority not affecting the merits of the case.

**7. Meetings of the Authority.—**
    (1) The Authority shall meet at such times and places, and shall observe such rules of procedure in regard to the
        transaction of business at its meetings (including the quorum at such meetings) as may be specified by
        regulations.
    (2) The Chairperson or, if for any reason he is unable to attend any meeting of the Authority, any other Member
        chosen by the Members present from amongst themselves at the meeting, shall preside at the meeting.
    (3) All questions which come up before any meeting of the Authority shall be decided by a majority of votes of the
        Members present and voting, and in the event of an equality of votes, the Chairperson or, as the case may be, the
        person presiding shall have a second or casting vote.

**8. Officers and other employees of the Authority.—**
    (1) The Authority may appoint such officers and other employees as it considers necessary for the efficient
        discharge of its functions under the Act.
    (2) The method of appointment, the conditions of service, and the scales of pay of the officers and other employees
        of the Authority shall be such as may be specified by regulations.

**9. Power to make regulations.—**
    (1) The Authority may, by notification in the Official Gazette, make regulations consistent with the Act and these
        regulations to carry out the provisions of this Act.
    (2) In particular, and without prejudice to the generality of the foregoing power, such regulations may provide for all
        or any of the following matters, namely:—
        (a) the times and places of the meetings of the Authority and the procedure to be followed at such meetings
            under sub-section (1) of section [X];
        (b) the method of appointment, the conditions of service and the scales of pay of the officers and other
            employees of the Authority under sub-section (2) of section [Y];
        (c) any other matter which is required to be, or may be, specified by regulations, or in respect of which
            provision is to be made by regulations.
    (3) Every regulation made under this Act shall be laid, as soon as may be after it is made, before each House of
        Parliament, while it is in session, for a total period of thirty days which may be comprised in one session or in
        two or more successive sessions, and if, before the expiry of the session immediately following the session or the
        successive sessions aforesaid, both Houses agree in making any modification in the regulation or both Houses
        agree that the regulation should not be made, the regulation shall thereafter have effect either in such modified
        form or be of no effect, as the case may be; so, however, that any such modification or annulment shall be
        without prejudice to the validity of anything previously done under that regulation.

**10. Savings.—**
    (1) All rules, orders, or directions made or issued by the Central Government or any other authority in relation to
        any matter for which provision is made in these regulations, and in force immediately before the commencement
        of these regulations, shall, so far as they are not inconsistent with the provisions of these regulations, continue to
        be in force and operate until repealed or amended.
    (2) Any action taken or decision made prior to the commencement of these regulations, which would have been
        validly taken or made if these regulations had been in force at that time, shall be deemed to have been validly
        taken or made under these regulations.
