In exercise of the powers conferred by sections 3 and 4 of the Collection of Statistics Act, 2008 (7 of 2009), as amended in 2017 (21 of 2017) and through THE JAN VISHWAS (AMENDMENT OF PROVISIONS) ACT, 2023 NO. 18 OF 2023 in 2023, read with rules 5 and 7 of the Collection of Statistics Rules, 2024, Hon'ble Lieutenant Governor of the National Capital Territory of Delhi hereby directs Collection of Statistics on manufacturing and related activities through a statistical survey, hereinafter referred to as β€˜Annual Survey of Industries 2024-25 (State Sample)', as per the details mentioned in the Schedule-I. 2. Further, in exercise of the powers conferred by Sections 4, 15A and 15B of the Collection of Statistics Act, 2008 (7 of 2009), as amended, read with Rule 7 of the Collection of Statistics Rules, 2024, the Hon'ble Lieutenant Governor of the National Capital Territory of Delhi hereby appoints the officers specified in Schedule-II as Statistics Officer, in Schedule-III as Adjudicating Officer, and in Schedule- IV as Appellate Authority, in respect of the geographical units mentioned therein. 3. The persons authorized by the concerned Statistics Officer, after submission of undertaking in the prescribed format, namely, Form-I appended to the Collection of Statistics Rules, 2024 to the Statistics Officer, would be engaged in the geographical jurisdiction of the Statistics Officer for verification of information furnished by informants, for inspecting relevant records, and for seeking clarifications, as may be necessary, from informants. In accordance with these duties, each person authorized would carry a photo identity card and a letter of authorization issued by the concerned Statistics Officer. 4. The statistics collected in Part-I and Part-II in respect of the Annual Survey of Industries 2024-25 furnished by the informants, after due verification and scrutiny, will be processed by officials working at the Office of the Directorate of Economics and Statistics, Government of National Capital Territory of Delhi. 5. All persons engaged in any activity in respect of collection of statistics, processing of data and dissemination with respect to ASI 2024-25 are governed by the provisions under the Collection of Statistics Act, 2008 as amended in 2017 (21 of 2017) and through THE JAN VISHWAS (AMENDMENT OF PROVISIONS) ACT, 2023 NO. 18 OF 2023 in 2023 and the Collection of Statistics Rules, 2024. 6. Following powers have been delegated to the Statistics Officers: (a) A Statistics Officer is empowered to depute/authorize officials to collect statistics in respect of the aforementioned direction, to verify any information furnished by informants on the basis of business records and other records and to seek clarifications from any owner or occupier or person in-charge of a factory or establishment or management, as the case may be, at the premises where such records are kept. (b) A Statistics Officer is empowered to give one month notice or for the period deemed fit to each of the informant for furnishing return in the format, specified for the purpose of collection of statistics. 7. Powers of the adjudicating officer- An adjudicating officer appointed under section 15A of the Act to hold an inquiry and impose penalty, shall also have the powers to- (i) call for oral or written evidence on oath or on affidavit from parties including from any other person who has been summoned; (ii) peruse or inspect relevant documents, records or copies thereof; (iii) summon and enforce the attendance of any person acquainted with the facts and circumstances of the case. Any appropriate agency including the District Administration shall render such assistance on receiving a reference regarding enforcing the attendance of any person while discharging the duties of the adjudicating officer appointed under the Act. 8. Appeal against the order of adjudicating officer- (1) Whoever aggrieved by the order passed by the adjudicating officer under this Act, may prefer an appeal to the appellate authority, within thirty days from the date of receipt of order, in Form-III. (2) An appeal may be admitted even after the expiry of the period of thirty days if the appellant satisfies the appellate authority that he had sufficient cause for not preferring the appeal within that period. In case the appeal has been preferred against the order of the adjudicating officer, the operation of the order of the adjudicating officer shall be kept in abeyance, till the disposal of the appeal. (3) Whenever, such an appeal is received, the appellate authority shall hold a hearing, either in person or virtual or by any other admissible mode, as may be decided by the appellate authority. (4) The appellate authority shall issue a notice of hearing to the parties, including persons acquainted with the facts and circumstances of the case, by name, date, venue and mode of hearing, along with the relevant documents of the receipt on appeal, at least fifteen days before the scheduled date of hearing. (5) The notice of hearing may also provide for submission of written communication, which may be relevant for deciding the appeal, by the parties, if they so desire at least five days before the date of hearing. (6) The notice of hearing shall be served in the following modes, namely:β€” a. by speed post or registered post; b. by electronic mail in case electronic address is available; and proof of deliveries shall be kept on the record of the case file. (7) The parties may be present in person or through his duly authorised representative by the specified mode of hearing as decided by the appellate authority including video conferencing, if the facility of video conferencing is available, at the time of hearing of the case. (8) The appellate authority may, after giving the parties to the appeal an opportunity of being heard, pass such order as he may think fit. SCHEDULE-I 1. Subject and purpose for collection of Statistics:-Statistics relating to the growth, composition and structure of organized manufacturing sector comprising activities related to manufacturing processes, repair services, gas and water supply and cold storage is collected through Annual Survey of Industries 2024-25. 2. Geographical area for collection of Statistics:-The Annual Survey of Industries 2024-25 will be conducted in the whole of National Capital Territory of Delhi. 3. Method of data collection:-A notice will be issued by the Statistics Officer to the informants under his jurisdiction, indicating therein the date by which, the officer or office to whom, the unit or units for which, and the formats in which information is required to be furnished. The Statistics Officer may permit an informant to file the prescribed information in electronic form, subject to such other conditions that he may specify in the notice. 4. Nature of informants from whom data may be collected:-The informants are owners or occupiers or person in-charge, of factories registered under the Factories Act. 1948 or of establishments registered under the Beedi & Cigar Workers (Conditions of Employment) Act, 1966 or the units registered under any of the following Acts/Boards/Authority viz., Companies Act, 2013, Shops and Commercial Establishments Act, Societies Registration Act, Cooperative Societies Act, Khadi and Village Industries Board, Directorate of Industries (District Industries Centre) who would be issued notice by Statistics Officer for furnishing information under the aforementioned direction. 4.1 A Statistics Officer may require such owner or occupier or person in-charge to furnish consolidated information in respect of two or more units under single management, in case information is not separately available for individual units and subject to such other conditions, as he may specify, in the notice. 5. Period during which collection of Statistics may be completed:-The date for submission of information by each informant would be mentioned in the notice and it would fall during April, 2026 to September, 2026. 6. Reference Period: Information is required to be furnished for the financial year commencing from 1st April 2024 and ending on 31st March 2025 or for the accounting year of a unit ending on any date between 1st April 2024 and on 31st March 2025. 7. Nature of information to be collected:-The information required has two parts. Part-I relates to information on assets and liabilities, employment and labour cost, receipts, expenses, input items - indigenous and imported, products and by-products, distributive expenses etc. Part-II relates to information on different aspects of labour statistics, namely, working days, mandays worked, absenteeism, labour turnover, man-hours worked, earning and social security benefits. 8. Language in which information is to be furnished by informant:-Every informant shall furnish information in the prescribed format either in Hindi or in English. 9. Obligation of informant:-The owner or occupier or person in charge of a unit shall furnish information in the manner and by the date mentioned in the notice received by him from the Statistics Officer. He should also furnish relevant records for inspection, and answer questions in relation to the information sought, as may be required by the Statistics Officer or a person authorized by him. 10. Nature of business records and other records which may be inspected:-Business records of a unit such as balance sheet, profit and loss account, muster rolls, attendance register, labour register, pay rolls, Director's report or any other legal document in support of the information furnished by the unit may be inspected by the Statistics Officer or a person authorized by him. 11. The manner of inspection:-The Statistics Officer or a person authorized by him may verify the information furnished by a unit under the aforementioned direction on the basis of business records and other records of the unit and seek clarifications, at the premises where such records are kept, from the concerned owner or occupier or a person in-charge of a factory or establishment or management, as the case may be, or a person authorized by him of the unit.
