No. 11/17/2024/HP -II/2204 to 2239 .—In exercise of powers conferred under sub -section (1) of section 176 of Bharatiya Nagarik Suraksha Sanhita, 2023, read with the Ministry of Home Affairs, Govt. of India’s Notification No. S.O. 2506(E), dated 28th June, 2024 (F. No. U -11030/3/2024 -UTL), Hon’ble Lt. Govern or, Delhi is pleased to direct tha t notwithstanding anything contained in any Rules or Instructions, the Officer -in-Charge of a Police Station under the said provision of the Bharatiya Nagarik Suraksha Sanhita, 2023 is empowered to depute any subordinate o fficer to investigate cases as men tioned below: 1. Inspectors: To investigate all cases under Bharatiya Nyaya Sanhita, 2023 and Local & Special Law unless anything contrary is specified in such local or special laws or the power of investigation in such loca l or special laws is conferred upon any police officer of specified rank. 2. Sub-Inspectors/Assistant Sub -Inspectors: To investigate all cases under Bharatiya Nyaya Sanhita, 2023 and Local & Special Laws except Murder under section 103(1) BNS, unless anythi ng contrary is specified in such local or special laws or the power of investigation in such local or special laws is conferred upon any police officer of specified rank. 3. Head Constables: To investigate all cases under Bharatiya Nyaya Sanhita, 2023 and Local & Special Laws which have the maximum prescribed punishment of upto seven (7) years, unless anything contrary is specified in such local or special laws or the power of investigation in such local or special laws is conferred upon any police officer of specified rank. 4. Constable with G raduate degree and 10 years of regular service and having passed a training in investigation as prescribed by the Commissioner of Police, Delhi: To investigate all cases under Bharatiya Nyaya Sanhita, 2023 and Local & S pecial Laws which have the maximum pr escribed punishment of upto three (3) years, unless anything contrary is specified in such local or special laws or the power of investigation in such local or special laws is conferred upon any police officer of specif ied rank. The afore -mentioned officer s shall have the power to carry out investigation, including making entries in the Daily Diary, writing case diaries and case files, drafting final reports, effecting arrests, seizures, submit progress as wel l as appea rance in Courts and carrying out all o ther functions as required for investigation and trial of cases under the Bharatiya Nagarik Suraksha Sanhita, 2023.
