Issued by the Department of Law, Justice and Legislative Affairs, Government of the National Capital Territory of Delhi, as Notification No. F.1/37/2024-Judl./Supt.law/1116-1121, dated 3rd June 2024, this notification is made under the proviso to Article 309 of the Constitution read with Ministry of Home Affairs Notification No. F.1/2/70/DH(S) dated 29th May 1970 (as amended by Notification No. F.-DH(S) dated 25th July 1970); the Lieutenant Governor of the National Capital Territory of Delhi, in consultation with the High Court of Delhi, makes the Delhi Higher Judicial Service (Amendment) Rules, 2024, effective from the date of publication, substituting Rule 22 of the Delhi Higher Judicial Service Rules, 1970; the new Rule 22 provides that direct recruitment to the service is subject to reservation and other concessions, except age relaxation, for Scheduled Castes, Scheduled Tribes and Persons with Disability as provided under the Rights of Persons with Disabilities Act, 2016 and related Central Government orders; that Persons with Disability shall be considered for direct recruitment only if a Medical Board certifies they can efficiently discharge duties as a Judicial Officer; and that promotion-based recruitment under Rule 7(1)(a) and Rule 7(1)(b) is likewise subject to reservation and concessions (except age relaxation) for Persons with Disability; the notification is issued by order and in the name of the Lieutenant Governor and signed by Bharat Parashar, Principal Secretary.

Short title and commencement. - (1) These rules may be called the Delhi Higher Judicial Service (Amendment) Rules, 2024. (2) They shall come into force on the date of their publication in the Official Gazette. 2. Amendment of rule 22. - In the Delhi Higher Judicial Service Rules 1970, in place of existing Rule 22, the following shall be substituted, namely: - "22(1) Recruitment made to the service by direct recruitment shall be subject to provisions regarding reservation and other concessions (except age relaxation) for the Scheduled Castes, Schedules Tribes and Persons with Disability as provided by Rights of Persons with Disability Act, 2016 and the orders, notifications etc. issued in this respect by the Central Government from time to time. (2) Persons with Disability shall be considered for appointment through direct recruitment only if they are found capable of efficiently discharging duties as Judicial Officer as per the satisfaction of the Medical Board that may be constituted before or after their names are recommended for appointment. (3) Recruitment to service by way of promotion [in terms of Rule 7(1)(a) and Rule 7(1)(b)] shall be subject to provisions regarding reservation and other concessions (except age relaxation) for Persons with Disability as provided by Rights of Persons with Disability Act, 2016 and the orders, notifications etc. issued in this respect by the Central Government from time to time."
