Governor of National Capital Territory of Delhi under the powers conferred by clause (j) of sub-section (2) of section 180 and section 106 of the Electricity Act, 2003 (36 of 2003), read with the Government of India, Ministry of Home Affairs Notification No. F.No.U-11030/2/2003-UTL dated 20th February, 2004. The amendment specifically substitutes Rule 5 of the Delhi Electricity Regulatory Commission (Budget) Rules, 2006, which were originally published in the Delhi Gazette, Extraordinary vide notification number F.No. 11(167)/2005/Power/2870 dated 10th November, 2006, with a corrigendum vide notification No. F.11 (167)/ 2005/ Power/2977 dated 05.12.2007. The new Rule 5, titled "Sources of funding of the budget estimates and the revised estimates," stipulates that both initial budget estimates and any increase in revised estimates for the current year shall primarily be funded from the DERC Fund, and if insufficient, the shortfall will be provided by the Government as grant-in-aid and loans. These rules shall come into force on the date of their publication in the official Gazette.

Governor of National Capital Territory of Delhi, hereby makes the following rules, namely:- 1. Short title and commencement.- (1) These rules may be called the Delhi Electricity Regulatory Commission (Budget) (Amendment) Rules, 2025 (2) They shall come into force on the date of their publication in the official Gazette 2. In the Delhi Electricity Regulatory Commission (Budget) Rules, 2006, in rule 5, the following rule shall be substituted, namely:- "5. Sources of funding of the budget estimates and the revised estimates.- (1) The estimates, that is to say, the budget, so prepared shall be, at the first instance, funded from the DERC Fund and in case the DERC Fund is not sufficient, the short fall may be provided by the Government in the shape of grant-in-aid and loans. (2) Any increase in the revised estimates for the current year so prepared, shall be, at the first instance, funded from the DERC Fund and in case the DERC Fund is not sufficient, the short fall may be provided by the Government in the shape of grant-in-aid and loans.
