It amends Regulation 25(1) of the Delhi Electricity Regulatory Commission (Forum for Redressal of Grievances of the Consumers and Ombudsman) Regulations, 2018 (the Principal Regulations, published 8th March 2018, N.C.T.D. No. 463) to fix the Ombudsman's term at five years or age 67, whichever is earlier, with existing Ombudsmen below 67 getting the same term and needing to reapply for reappointment/extension thereafter at the Commission's sole discretion. It similarly amends Regulation 9(1) of the First Amendment Regulations, 2022 (published 24th February 2022, N.C.T.D. No. 176 GOVERNMENT OF INDIA SG-DL-E-03082023-247793 2 DELHI GAZETTE : EXTRAORDINARY PART III] DELHI ELECTRICITY REGULATORY COMMISSION NOTIFICATION Delhi, the 1st August, 202 3 Delhi Electricity Regulatory Commission (Forum for Redressal of Grievances of the Consumers and Ombudsman) (Second Amendment) Regulations, 2023 No. F. 11(1938 )/DERC/2021-22/7263/1011 .—In exercise of the powers conferred on it by sub- section (2) (r) of Section 181 read wi th sub-sections (5) and (6) of Section 42 of the Electricity Act 2003 , and all other powers enabling it in this behalf, and after previous publication, the DERC hereby makes the following Regulations to amend the “Delhi Electricity Regulatory Commission (Forum for Redressal of Grievances of the Consumers and Omb udsman) Regulations, 2018 ”, (hereinafter referred to as “ the Principal Regulations”) and Delhi Electricity Regulatory Commission (Forum for Redressal of Grievances of the Consumers and Omb udsman) (First Amendment) Regulations, 2022 (hereinafter referred to as “the First Amendment Regulations”) : 1.0 Short title and c ommencement: (1) These regulations may be called the Delhi Electricity Regulatory C ommission (Forum for Redressal of Grievances of the Co nsumers and Ombud sman) (Second Amendment) Regulations, 2023. (2) These regulations shall come into effect from the date of their publication in the official Gazette. 2.0 Amendment to Regulation 25 (1) of Principal Regulations: Sub- Regulation (1) of Regulation 25 of Principal Regulations shall be substituted as under : - (1) The term of the Ombudsman shall be for a period of five (5) years or till the age of sixty seven (67) years, whichever is earlier, from the date he enters the office. Provided that the tenure of the existing Ombudsman who has not attained the age of 67 years, shall now be for a period of five years or till the age of 67 years, whichever is earlier and thereafter he/she shall apply afresh for re -appointment/extension. It will be the sole discretion of the Commission to re - appoint/extend the tenure of the existing Ombudsman after completion of five (5) years. 3.0 Amendment to Regulation 9 (1) of First Amendment Regulations: Sub- Regulation (1) of Regulation 9 of First Amendment Regulations, shall be substituted as under: - (1) The Chairperson or Member shall hold office for a period of five (5) years or till the age of sixty seven (67 ) years, whichever is earlier, from the date they enter the office. Provided that the tenure of the existing Chairperson or Member who has not attained the age of 67 years, shall now be for a period of five years or till the age of 67 years, whichever is earlier and thereafter he/she shall apply afresh for re -appointment/extension. It will be the sole discretion of the Commission to re -appoint/extend the tenure of the existing Chairperson or Member after completion of five (5) years. RAJESH DANGI, Secy . Note: 1.
