No. 1/4/2024/HP-I/Estt./464 to 472.—In exercise of the powers conferred under sub-section (3) of Section 48 of The Bharatiya Nagarik Suraksha Sanhita, 2023 (Act 46 of 2023), read with Notification bearing S.O. No. 2506(E), dated 28.06.2024 of the Ministry of Home Affairs, Government of India, New Delhi, the Lieutenant Governor of NCT of Delhi is pleased to notify the following rules:- 1. Short title and commencement- (i) These rules may be called as 'Delhi BNSS (Arrest Information) Rules, 2025'. (ii) These rules shall extend to the whole of the National Capital Territory of Delhi. (iii) These rules shall come into force from the date of their publication in the official Gazette. 2. Definitions- (1) In these rules, unless the context otherwise requires- (a) "Electronic Communication” means the communication of any written, verbal, pictorial information or video content transmitted or transferred (whether from one person to another or from one device to another or from a person to a device or from a device to a person) by means of an electronic device including telephone, mobile phone, or other wireless communication device, or a computer, or audio- video player or camera or any other electronic device or electronic form, as defined in section 2(i) of the Sanhita; (b) Mode of Information: means the mode of intimation regarding arrest to relatives, friend or such other persons as may be disclosed or nominated by the arrested person given through electronic mode i.e. mobile phone, social media apps (including whatsapp), sms, Landline phone, email as well as physical mode. (c) Police Station- means the place as defined under clause (u) of Sub-Section (1) of Section 2 of The Bharatiya Nagarik Suraksha Sanhita, 2023. (d) "Sanhita" means the Bharatiya Nagarik Suraksha Sanhita, 2023 (Act 46 of 2023). (e) "State Government” means the administrator appointed under article 239 of Constitution for National Capital Territory of Delhi and designated as Lieutenant Governor by the President. (2) All other words and expressions shall have the same meaning as assigned to them in the BNSS. 3. Every Police Officer or other person making any arrest under "Sanhita", shall forthwith give the information regarding such arrest and place where the arrested person is being held to any of his relatives, friends or such other persons as may be disclosed or nominated by the arrested person for the purpose of giving such information and also to the designated police officer in the district. 4. Every Police Station shall maintain a register for entering the details in respect of arrested person(s) and an entry of the fact as to who has been informed of the arrest of such person as given at Schedule-I. 5. Saving of the powers of the Court: Nothing in these rules shall be deemed to limit or otherwise affect the power of the Court as given in the Sanhita or any other law for the time being in force.
