Exercising powers under the proviso to Article 309 of the Constitution read with Ministry of Home Affairs Notification No. F.24/78/68-DH(S) dated 24.09.1968, and in supersession of the Health and Family Welfare Department's earlier Notification No. F.11(6)/97-PHC/TRC/3044-3050 dated 03.02.2000 (save as respects things already done or omitted before supersession), the Lt. Governor of the National Capital Territory of Delhi, vide Notification F. No. 50(12)/DC/Estt./2023/62 dated 1st February 2024 issued by the Health and Family Welfare Department, has made the Drugs Control Department, Laboratory Assistant (Chemistry) Recruitment Rules, 2024, which come into force on the date of publication in the Official Gazette; the rules govern recruitment to one post (2024, number subject to variation depending on workload) of Laboratory Assistant (Chemistry) in the Drugs Control Department, Government of NCT of Delhi, classified as General Central Service, Non-Ministerial, Non-Gazetted, Group 'C', carrying pay Level 4 (Rs. 25500-81100) in the Pay Matrix, filled entirely by direct recruitment (not a selection post) with a two-year probation period; direct recruits must be aged 18-25 years (relaxable up to 40 years for departmental candidates per Central Government instructions, or 18-27 years if filled by all-India open competition, with the crucial date for age determination as advertised by the DSSSB or competent authority), and must hold a Bachelor's degree in Pharmacy or Science (with Chemistry, Botany and Zoology subjects) plus one year's experience in chemical analysis of drugs from a recognised institution, both relaxable at the discretion of the Competent Authority for otherwise well-qualified candidates or for Scheduled Caste/Scheduled Tribe candidates where sufficient experienced candidates from these communities are not available; vacancies vacant for one year or more due to deputation, long illness or study leave of the incumbent may alternatively be filled on deputation from Central Government/State Government/Union Territory officers holding analogous posts with the prescribed qualifications, subject to a maximum deputation age of 56 years as on the closing date for applications; confirmation is considered by a Group 'C' Departmental Promotion Committee comprising the Principal Secretary/Secretary (PWD), GNCTD as Chairperson, the Head of the Department concerned, GNCTD, and the Deputy Secretary (UD), GNCTD as Members (with the senior-most member acting as Chairperson if the notified Chairperson is junior to another member); consultation with the Union Public Service Commission is stated to be unnecessary; rule 4 disqualifies from appointment any person who has married or contracted to marry while having a living spouse, or who has married a person while that person has a living spouse, subject to exemption by the Government where satisfied the marriage is permissible under applicable personal law and other grounds exist; rule 5 empowers the Government to relax any provision of the rules for any class or category of persons for recorded reasons; and rule 6 preserves existing reservations, age-limit relaxations and other concessions for Scheduled Castes, Scheduled Tribes, Other Backward Classes, Ex-servicemen and other special categories under Central Government orders. No. 50(12)/DC/Estt./2023/62.—In exercise of the powers conferred by the proviso to Article 309 of the constitution read with Government of India, Ministry of Home Affairs Notification No. F.24/78/68-DH(S) dated 24.09.1968 and in supersession of the Notification No. F.11(6)/97-PHC/TRC/3044-3050 dated 03.02.2000 issued by this Government, except as respects things done or omitted to be done before such supersession, the Lt. Governor of the National Capital Territory of Delhi hereby makes rules regulating the method of recruitment to the post of Laboratory Assistant (Chemistry) in the Drugs Control Department, Government of National Capital Territory of Delhi as following, namely: 1. Short title and commencement- (i) These rules may be called the Drugs Control Department, Laboratory Assistant (Chemistry) Recruitment Rules, 2024 (ii) They shall come into force on the date of their publication in the Official Gazette. 2. Number of post, classification and pay level in pay matrix- The number of the said post, its classification and the pay level in the pay matrix attached thereto shall be specified in columns (2) to (4) of the Schedule annexed to these rules. 3. Method of recruitment, age limit, qualifications, etc.-The method of recruitment, age limit, qualifications and other matters relating to the said post shall be as specified in columns (5) to (13) of the said Schedule aforesaid. 4. Disqualification.-No person, (a) Who has entered into or contracted a marriage with a person having a spouse living; or (b) Who, having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the said post provided that the Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule. 5. Power to Relax- Where the Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons. 6. Saving- Nothing in these rules, shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Other Backward Classes, Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.
