(C) 9173/2015 and connected applications (Vinod Rajoria vs. DDA & Ors.) directing time-bound completion of the acquisition process under Chapter-IV of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, declares under Section 19(1) of the Act read with Rule 10 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement (Compensation, Rehabilitation and Resettlement, Development Plan) Rules, 2015 that 0.1876 hectares of land bearing khasra no. 4//21 in Village Bharthal, Kapashera sub-division, South-West District, Delhi, already utilised for road construction (road no. 226 access), is under acquisition, following the prior Section 11 notification No. ADM/LAC/SW/2023-24/5938 dated 18th January 2024; the land is recorded as owned by Vinod Kumar Rajoria, no rehabilitation or resettlement is required as the matter is subsumed in the pending writ petition, and the declaration is signed by Ashwani Kumar, Additional Chief Secretary (Revenue) cum Divisional Commissioner, with Lakshay Singhal named as Land Acquisition Collector/DM, District South-West.

No. ADM/LAC/SW/2023-24/17861.—Whereas the Hon'ble High Court of Delhi vide order dated 08/12/2023 in W.P. (C) 9173/2015 & CM APPL. 51495/2019, CM APPL. 21613/2021, CM APPL. 17886/2022, CM APPL. 20392/2022, CM APPL. 45299/2022, CM APPL. 6186/2023 titled as Vinod Rajoria Vs. DDA &ors directed Government of National Capital Territory of Delhi for time bound completion of process under Chapter-IV of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013with respect to the land already utilized in the construction of road. Whereas it appears to the Government that a total land of 0.1876 Hectares is required in the Village-Bharthal, Sub-Division of Kapashera in District South-West, Delhi for the public purpose namely for providing the access of road no. 226 in Bharthal village. Whereas, the Notification under sub-section (1) of section 11 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 was published vide notification no. ADM/LAC/SW/2023-24/5938 dated:18-01-2024 in the Delhi Gazette dated 24-01-2024 notifying that the land bearing khasra no. 4//21 (0.1876 Hectares) total land measuring (0.1876 Hectares) in village Bharthal is required for public purpose namely for providing the access of road no. 226 in Bharthal village. Now, therefore, in accordance with the provisions of Section 19 (1) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 read with Rule 10 the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement (Compensation, Rehabilitation and Resettlement, Development Plan) Rules, 2015) the declaration is made that a piece of land measuring 0.1876 Hectares is under acquisition for the above said project in the Village Bharthal. There is no need for rehabilitation and resettlementin this case as already settled by Hon'ble High Court of Delhi in its aforesaid order dated 08/12/2023. Mines, Coal, Iron-Stone, Slate or other minerals lying under the said land or any particular portion of the said land, except such parts of the mines and minerals which may be required to be dug or removed or used during the construction phase of the project for the purpose of which the land is being acquired, are not needed. A plan of the land may be inspected in the office of the Collector, South-West on any working day and the same shall also be available on the website of the Revenue Department and the District Magistrate, (South-West), Delhi.
