The Ministry of Environment, Forest and Climate Change, by Order S.O. 4751(E) dated 31st October, 2023 (F.No. J-17011/18/96-IA.III, signed by Dr. Sujit Kumar Bajpayee, Joint Secretary), exercising powers under sub-section (3) of Section 3 of the Environment (Protection) Act, 1986 (29 of 1986), constitutes the Daman and Diu Coastal Zone Management Authority for a period of three years from the date of publication, comprising twelve ex officio, expert and non-government members including the Secretary (Environment and Forests), Dadra and Nagar Haveli and Daman and Diu as ex officio Chairman; the Head of Department, Department of Environment and Forests, Daman; the Collectors of Daman and of Diu; the Chief Town and Country Planner; the Director, Fisheries, Daman & Diu; the Director, National Centre for Sustainable Coastal Management, Chennai; the Director, Space Applications Centre, Indian Space Research Organisation, Ahmedabad; expert members Shri Nischal Joshi and Shri Gaurang H. Trivedi; the Gujarat Institute of Desert Ecology as the Non-Government Organisation member; and the Director, Environment Department as Member-Secretary. The Authority's headquarters is at Moti Daman, Daman and Diu, with a quorum of one-third of total members; non-ex officio members receive allowances as decided by the Central Government and must recuse themselves from appraisal of projects on which they have provided consultancy, to avoid conflict of interest. The Authority is tasked with examining project proposals for approval under the Coastal Regulation Zone notifications S.O. 19(E) dated 6th January, 2011 and G.S.R. 37(E) dated 18th January, 2019, within sixty days of receipt of application; regulating developmental activities in Coastal Regulation Zone areas; issuing directions under Section 5 of the Act per notification S.O. 4650(E) dated 30th September, 2022; taking action per notification S.O. 4648(E) dated 30th September, 2022; filing complaints under Section 19 of the Act; recommending changes to Coastal Regulation Zone classification and the Coastal Zone Management Plan to the National Coastal Zone Management Authority; inquiring into violations of the Act and rules; maintaining a public website disclosing its functioning; and furnishing activity reports to the National Coastal Zone Management Authority at least once every six months.

The Headquarter of the Authority shall be at Moti Daman, Daman and Diu. 3. The quorum for t he meeting of the Authority shall be one third of the total number of its members of the Authority. 4. The member, other than an ex officio member, shall be paid allowances as per the terms and conditions decided by the Central Government in this behalf. 5. In order to avoid any conflict of interest, the member shall recuse himself from the meeting of the Authority, in the process of appraisal of any project, for which they have rendered consultancy service. 6. The Authority shall take following measures fo r protecting and improving the quality of the coastal environment and preventing, abating and controlling environmental pollution in the Coastal Regulation Zone areas in the Union territory of Daman and Diu, namely: - (i) examine the proposals received fro m the project proponent for approval of project proposal, in accordance with the approved Coastal Zone Management Plan and within the requirements of the notification issued by the Government of India vide number S.O.19(E), dated the 6 th January, 2011 or notification issued vide number G.S.R. 37(E), dated the 18th January, 2019 (hereinafter referred to as the said notification), and make recommendation for approval of project to the concerned authority, as specified in the said notification, within a perio d of sixty days from the date of receipt of application; (ii) regulate all developmental activities in the Coastal Regulation Zone areas as specified in the said notification; (iii) issue directions under section 5 of the said Act, as specified in the noti fication of the Government of India in the Ministry of Environment, Forest and Climate Change published in the Gazette of India, Extraordinary, Part II, Section 3, Sub -section (ii), vide number S.O. 4650(E), dated the 30 September, 2022; (iv) take action a gainst the persons as per the notification of the Government of India in the Ministry of Environment, Forest and Climate Change published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii), vide number S.O. 4648(E), dated the 30 S eptember, 2022; (v) file complaint under section 19 of the said Act; (vi) examine the proposals received from the Union territory of Daman and Diu for changes or modifications in the classification of Coastal Regulation Zone areas and in the Coastal Zone M anagement Plan and make specific recommendations thereon, to the National Coastal Zone Management Authority; (vii) inquire into cases of alleged violation of the provisions of the said Act or the rules made thereunder, and review the cases involving violat ion or contravention of the provisions of the said Act and the rules made thereunder; and (viii) inquire and review cases of violation or contravention of the said notification suo-moto or on the basis of a complaint made by any individual or body or organ isation before it; 7. The Authority shall be responsible for enforcement and monitoring of the implementation of the provisions of the said notification. 8. The Authority shall, for the purposes of maintaining transparency in its functioning, create a de dicated website and post the information relating to its functions, including the agenda in its meeting, minutes of the meeting, decision taken in the meeting, recommendation for matters on violation and contravention of the said notification and action taken on such violation and court matter including the order of the court and the approved Coastal Zone Management Plan of the Union territory of Daman and Diu. 9.
