Core Purpose

The Central Government promulgates the Aircraft (Demolition of Obstructions caused by Buildings and Trees etc.) Rules, 2026, superseding the 1994 rules to regulate obstructions around aerodromes.

Detailed Summary

The Ministry of Civil Aviation, through G.S.R. 236(E) dated March 31, 2026, has promulgated the Aircraft (Demolition of Obstructions caused by Buildings and Trees etc.) Rules, 2026. These rules are made in exercise of powers conferred by sub-section (1) and clause (zc) of sub-section (2) of section 10 read with sections 11 and 18 of the Bharatiya Vayuyan Adhiniyam, 2024 (16 of 2024), and supersede the Aircraft (Demolition of obstructions caused by Buildings and Trees etc.) Rules, 1994. The draft rules, Aircraft (Demolition of obstructions caused by Buildings and Trees etc.) Rules, 2025, were previously published as G.S.R. 396(E) on June 18, 2025, inviting objections which were duly considered. The 2026 rules define 'building' to include structures and trees within a 'specified area' not exceeding twenty kilometres from an aerodrome reference point. They outline procedures for dealing with obstructions: an officer-in-charge serves a notification (Form A) to the owner regarding non-compliance with Central Government notifications issued under section 18(1) of the Adhiniyam. The Director General may order owners to furnish building details within sixty days, extendable by sixty days. Physical verification of premises by the officer-in-charge requires an order from the Director General, valid for fifteen days. The Director General can issue a demolition or height reduction order (Rule 6) if a building does not comply, after providing the owner a reasonable opportunity of being heard. Aggrieved persons can appeal to an appellate authority within thirty days of receiving the order, using Form B and paying a fee of rupees one thousand. Owners must comply with final orders within sixty days. Compensation for loss or damage can be claimed under section 22 of the Adhiniyam, with an exception for buildings erected in contravention after receiving a notification under section 18. Non-compliance leads to the officer-in-charge reporting the matter to the District Collector, who will then carry out the demolition or height reduction.
