For institutions in India, applications are submitted online to the President of the Board of Ayurveda or the Board of Unani, Siddha and Sowa-Rigpa (constituted under Section 18 of the Act) in Form-35A (undergraduate) or Form-35B (postgraduate); the Board verifies criteria such as institutional approval, nomenclature, course duration, syllabus and evaluation system, with deficiencies to be rectified within a specified timeframe or the application is rejected. An aggrieved institution may appeal to the Chairperson of the Commission in Form-35C within sixty days, with the Commission required to decide within two months; a further appeal lies to the Central Government (Secretary, Ministry of Ayush) within thirty days. Recognised qualifications are included in a list maintained by the Commission with a generated sequence code combining state/UT abbreviation, university serial number, institute code, year of recognition, and a qualification code (A for Graduation, B for Post-Graduation Non-Surgical, C for Post-Graduation Surgical, D for Post-Graduate Diploma, with further letters for new degrees and numbered suffixes for amendments). Under sub-section (8) of Section 35 of the Act, qualifications previously recognised under Schedules II and III of the Indian Medicine Central Council Act, 1970 (repealed 11-06-2021) continue to be listed without further modification. For institutions outside India, applications are submitted in Form-36A (undergraduate) or Form-36B (postgraduate) and scrutinised on the same criteria; appeals against refusal lie to the Central Government (Secretary, Ministry of Ayush) in Form-36C; recognised foreign qualifications are listed with a sequence code based on country, university, college, year of recognition and qualification nomenclature, and qualifications previously recognised under the Fourth Schedule of the Indian Medicine Central Council Act, 1970 continue to be listed.

No. Sec/NCISM/Reg(1)/2023. —In exercise of the powers conferred by sub -section 1 and clauses (zl), (zm), (zn), (zo), (zp) and (zq) of sub -section (2) of section 55 of the National Commission for Indian System of Medicine Act, 2020 (14 of 2020), th e National Commission for Indian System of Medicine hereby makes the following regulations, namely: - CHAPTER I PRELIMINARY 1. Short title and commencement. - (1) These regulations may be called the National Commission for Indian System of Medicine (Recognitio n of Qualifications) Regulations, 2023. (2) They shall come into force on the date of their publication in the Official Gazette. 2. Definitions . -(1) In these regulation, unless the context otherwise requires, - (a) “Act” means the National Commission for Indian Syste m of Medicine Act, 2020 (14 of 2020); (b) “Annexure” means Annexure appended to these regulations; (c) “Board” means the Board of Ayurveda or the Board of Unani, Siddha and Sowa -Rigpa, as the case may be, constituted under section 18 of the Act; (d) “Degree awarding body” means a university or a medical Institute that awards degree in Indian System of Medicine; (e) “Form” means a Form annexed to these regulations; (f) “medical qualification” means Undergraduate degree, Post Graduate degree, Post Graduate diploma, Post Graduate certificate, Post Graduate fellowship, Super Specialty degree or any other qualification in Ayurveda, Unani, Siddha and Sowa -Rigpa medical systems awarded by any recognised Medical Institution or University; (g) “sequence code” means the C ode given to a recognised medical qualification. (2) The words and expressions used herein and not defined but defined in the Act shall have the same meanings as respectively assigned to them in the Act. CHAPTER II RECOGNITION OF MEDICAL QUALIFICATIONS AWARDED BY THE INSTITUTIONS OR UNIVERSITIES ESTABLISHED IN INDIA 3. Procedure for recognition of Medical Qualification. - (1) The degree awarding body established in India duly approved by the National Commission for Indian System of Medicine or erstwhile Cen tral Council of Indian Medicine or Government of India, as the case may be, awarded or awarding degrees in Indian System of Medicine shall apply to the President, Board of Ayurveda or the President, Board of Unani, Siddha and Sowa - Rigpa for recognition of medical qualification. The application shall be submitted online in Form -35A appended as Annexure -I, for undergraduate course and in Form -35B appended as Annexure -II, for postgraduate degree or Post Graduate Diploma courses or any other degrees through web site of the National Commission for Indian System of Medicine. (2) The concerned Board shall verify the application on the following criteria, namely: - (a) the medical Institute or University is duly permitted by the Commission or erstwhile Central Council of Indian Medicine or by the Government of India; (b) the nomenclature of medical qualification awarded by a medical Institute or University is as specified under concerned regulations of the Commission or erstwhile Central Council of Indian Medicine; (c) the duration of the course of medical qualification is as specified by the Commission or erstwhile Central Council of Indian Medicine in the concerned regulations of Ayurveda, Unani, Siddha and Sowa - Rigpa; (d) the syllabus or curriculum adopted for the course is as recommend ed by the Commission or erstwhile Central Council of Indian Medicine; and (e) the evaluation system for the course is in accordance with the policies laid down by the Commission or erstwhile Central Council of Indian Medicine; (3) on verification, if any deficienc y found, same shall be intimated to the degree awarding body for rectification within the timeframe specified by the concerned Board; (4) on rectification of deficiency, if the application fulfills the requisite criteria, the Board shall notify the same as sp ecified in the regulation 5. (5) after rectification, if application is found not fulfilling the requisite criteria, the application shall be rejected with mentioning the reason thereof. 4. Appeal. - (1) The University or degree awarding medical Institutes, if aggrieved by the order of the Board, may prefer an Appeal to the Chairperson of the Commission online or offline in Form -35C in Annexure -III, along with all enclosures as specified within a period of sixty days from the date on which a copy of the order of t he Board is made available to the University or degree awarding medical Institutes . (2) The Commission shall, within a period of two months from the date of receipt of the Appeal, examine the appeal on the criteria mentioned in clauses (a), (b), (c), (d) and ( e) of sub -regulation (2) of regulation 3 and after examination, if the Commission decides that recognition may be granted to such medical qualification, the Commission shall direct the concerned Board to grant recognition. (3) On examination, if the Appeal is found to be defective, the Commission may reject the appeal and before rejection of appeal, the degree awarding body shall be given a reasonable opportunity of hearing. (4) In the event of refusal of grant of recognition or failure to decide within specified period of two months by the Commission, the University or degree awarding medical Institutes may prefer a second Appeal to the Central Government addressed to the Secretary, Ministry of Ayush, Government of India, within a period of thirty days from the da te of communication of such decision or lapse of specified period by the Commission. (5) The Central Government shall examine such second appeal on the criteria mentioned in clauses (a), (b), (c), (d) and (e) of sub -regulation (2) of regulation 3 and if the Ce ntral Government decides that recognition may be granted to such medical qualification, it may direct the Commission to grant recognition and include such qualifications as per regulation 5. (6) If, the Central Government is of the opinion that recognition ma y not be granted to such medical qualification, the Central Government may reject and dispose such appeal with the reasons to be recorded in writing. 5. Inclusion of medical qualification. - (1) Once a medical qualification has been granted recognition under this Chapter, the Board of Ayurveda or the Board of Unani, Siddha and Sowa -Rigpa, as the case may be, shall include such recognised medical qualification along with the date of effect of such recognition in the list separately maintained by the respective Board in the format appended as Annexure -VII, for communicating the details to all States or Union territory Administration which shall be displayed in the Commission‟s website in the format appended as Annexure -VIII. (2) For the purposes of inclusion and list ing of recognised medical qualifications, a sequence code will be generated which shall be a combination of the abbreviated name of the State or Union territory, serial number of the University or the degree awarding institute, college or Institute code, y ear of grant of recognition followed by the qualification code and amendments, if any, wherein, - (a) State or Union territory Administration shall be denoted by the abbreviated name of the State or Union territory, as the case may be, in which the University or degree awarding Institute is located as per the following Table, namely: - TABLE -1 (Codes of State or Union territory Administration) Serial number States or Union territories Administration Abbreviation (1) (2) (3) 1. Union territory of Ladakh LA (b) University or degree awarding institute shall be numbered as per their sequential order of application for grant of recognition, for example, first application shall be numbered as „01‟, second as „02‟ and so on. (c) Institute or College code shall be the Institutional ID, allotted by the Medical Assessment and Rating Board for Indian System of Medicine. (d) Year shall be the year of grant of recognition to the medical qualification by the respective board. Any new degrees approved by the National Commission for Indian System of Medicine shall be coded consequently E, F, G and so on. 6. Amendments, if any: Any modifications such as change of nomenclature, addition of subjects and the like, shall be coded as A 1 , A2 A3….B 1, B2, B3…an so on. (3) As per sub -section (8) of section 35 of the Act, all the degrees or qualificati ons recognised or included under Schedule -II and Schedule -III of the Indian Medicine Central Council Act, 1970 (repealed on 11 - 06-2021) shall be listed and maintained as well as displayed on the Commission‟s website by the concerned Board of the Commission and there shall not be any further addition or insertion or modification. CHAPTER III RECOGNITION OF MEDICAL QUALIFICATIONS AWARDED BY THE INSTITUTIONS OR UNIVERSITIES ESTABLISHED OUTSIDE INDIA 6. Procedure of recognition of medical qualifications outside India. - The Universities or medical Institutions situated outside India duly authorised by the apex bodies or regulatory authorities of their respective countries awarding degrees in Ayurveda, Siddha, Unani and Sowa -Rigpa systems of medicine are eligible to apply through online portal in Form -36A appended as Annexure -IV, as available on the Commission‟s website for undergraduate course and in Form -36B appended as Annexure -V, for postgraduate degree or postgraduate diploma courses and any o ther degrees . 7. Scrutiny of Application .- (1) The Commission shall examine the application on the criteria mentioned in clauses (a), (b), (c), (d) and (e) of sub -regulation (2) of regulation 3 and process the same, submitted under regulation 6 and i f, on scrutiny, the a pplication is found to be in order, it shall be duly registered and given a sequence code as provided in sub -regulation (2) of regulation 9. (2) On scrutiny, if the application is found to be defective, and the defect noticed is formal in nature, the Commissio n may allow the University or medical institution or apex body or regulatory authority of the respective country to rectify the application, and if the said defects are not formal in nature, the Commission may allow the University or medical institution such time to rectify the defects as it deems fit. (3) If the University or medical institution or apex body or regulatory authority of the respective country fails to rectify the defects within the time allowed under sub -regulation (2), the Commission may, by order and for reasons to be recorded in writing, declare not to grant the University or medical institution the recognition to such medical qualification and the same shall be communicated to the applicant as well as apex or regulatory authority of the coun try. (4) Before refusing a grant of recognition to a University or medical institution or apex body or regulatory authority , the Commission shall give a reasonable opportunity of being heard to such University or medical institution or apex body or regulatory authority. (5) After hearing such University or medical institution or apex body or regulatory authority, if the Commission is of the opinion that recognition may be granted to such medical qualification, it shall include such qualification and communicate th e same to the University or medical institution, apex body or regulatory authority, as the case may be, of their respective country in the format appended as Annexure -IX specified in this regulation and displayed on commission‟s website in the format appen ded as Annexure -X in these regulation. 8. Appeal .- (1) The University or medical institution or apex body or regulatory authority, as the case may be, of the respective Country, if aggrieved by the order of the Commission may prefer an Appeal to the Central Government addressed to the Secretary to the Government of India, Ministry of Ayush , in Form -36C appended as Annexure -VI. (2) The Central Government shall examine the appeal on the criteria mentioned in clauses (a), (b), (c), (d) and (e) of sub -regulation ( 2) of regulation 3 and if it is of the opinion that recognition may be granted to such medical qualification, it may direct the Commission to grant recognition and include such qualifications in the manner as provided in regulation 9. (3) If the Central Gov ernment is of the opinion that recognition may not be granted to such medical qualification, the Central Government may reject and dispose such appeal with the reasons to be recorded in writing. 9. Inclusion of medical qualification. - (1) Once a medical quali fication has been granted recognition under this chapter, the Commission shall include the same in the list separately maintained for Ayurveda, Unani, Siddha and Sowa -Rigpa systems of medicine in the specified format appended as Annexure -IX to these regula tions and the same shall be displayed in the Commission‟s website as specified in the format appended as Annexure -X. (2) For the purposes of inclusion and listing of recognised medical qualification, a sequence code shall be generated which shall be an abbrevi ated combination in the following order and manner, namely: - (a) Name of the Country in which University is located; (b) Name of the University or medical institution; (c) Name of the College; (d) The year of recognition by the Commission; and (e) Nomenclature of the recognis ed qualifications. (3) As per sub -section (4) of section 36 of the Act, all the degrees or qualifications recognised or included under Fourth Schedule of the Indian Medicine Central Council Act, 1970 (repealed on 11 -06-2021) shall be listed and maintained as w ell as displayed on the Commission‟s website by the concerned Board of the Commission and there shall not be any further addition or insertion or modification.
