No. 18-12/2021-BUSS (SID-UG-MES).—In exercise of the powers conferred by section 55 of the National Commission for Indian System of Medicine Act, 2020 (14 of 2020), and in supersession of the Indian Medicine Central Council (Requirements of Minimum Standard for Under-graduate Siddha Colleges and attached Hospitals) Regulations, 2016 and the Establishment of New Medical College, Opening of new or Higher Course of Study or Training and Increase of Admission Capacity by a Medical College Regulations,2019 except as respects things done or omitted to be done before such supersession, the National Commission for Indian System of Medicine hereby makes the following regulations, namely:- 1. Short title and commencement.- (1)These regulations may be called the National Commission for Indian System of Medicine (Minimum Essential Standards, Assessment and Rating for Undergraduate Siddha Colleges and Attached Teaching Hospitals) Regulations, 2024. (2) They shall come into force on the date of their publication in the Official Gazette. CHAPTER-I PRELIMINARY 2. Definitions.-(1) In these regulations, unless the context otherwise requires,- (a) ―Act‖ means the National Commission for Indian System of Medicine Act, 2020 (14 of 2020); (b) ―assessment of an institutions‖ means the act of verification of availability of minimum essential standards in terms of infrastructure, human resources and functionality of an institution and its attached teaching hospital; (c) ―attached teaching hospital‖ means a Siddha hospital that offers standard healthcare services, attached to a medical institution for the purpose of teaching and training to the students of Siddha System of Medicine; (d) "extended permission" means permission for admitting students extended by the Medical Assessment and Rating Board for Indian System of Medicine to medical institution fulfilling the criteria for ―extended permission status‖, so that the institution may participate in the counseling process for admitting students without waiting for permission from the Medical Assessment and Rating Board for Indian System of Medicine for admission every year unless otherwise denied or specified by the Medical Assessment and Rating Board for Indian System of Medicine; (e) ―Form‖ means Form annexed to these regulations; (f) ―fully established institution‖ means the institution or college completed all four phases of establishments and issued first, second and third renewal of permission by the Medical Assessment and Rating Board for Indian System of Medicine; (g) ―institution under establishment‖ means the new institution or college undergoing phase wise establishments, that is, first, second, third and fourth phase of establishment; (h) ―letter of intent‖ means preliminary approval, along with conditions and timelines, issued by the Medical Assessment and Rating Board for Indian System of Medicine to the applicant through the procedure to establish a new Siddha Medical College or institution or to increase student intake capacity in existing courses or programmes or to start any postgraduate or new course recognised by the National Commission for Indian System of Medicine; (i) "letter of permission" means permission granted to the applicant by the Medical Assessment and Rating Board for Indian System of Medicine through the procedure to establish a new Siddha Medical College or institution, or to increase student intake capacity in existing courses or programmes, or to start any postgraduate or new course recognised by the National Commission for Indian System of Medicine, and to admit the students as per the students intake capacity sanctioned by the Medical Assessment and Rating Board of Indian System of Medicine; (j) ―minimum essential standards‖ means mandatory minimum requirements in terms of infrastructure, human resources, and functionality as well as a level of quality or standards that is thought to be acceptable as a minimum and below the minimum which is unacceptable; (k) ―rating‖ of an institution means a score or measurement of how good an institution is. Rating of fully established recognised institutions through a rating process carried out by the Medical Assessment and Rating Board for Indian System of Medicine or any designated rating agency based on the standards and parameters laid down by the Board of Unani, Siddha and Sowa-Rigpa over and above the minimum essential standards; (l) ―renewal of permission‖ means the renewal of permission, that is, the first, second and third renewal granted by the Medical Assessment and Rating Board for Indian System of Medicine to a Siddha Medical College or institution under establishment, that is, undergoing second, third and fourth phase-wise establishments respectively through the procedure mentioned in these regulations during successive academic years after the issuance of letter of permission for admitting students as per the sanctioned student intake capacity by the Medical Assessment and Rating Board for Indian System of Medicine as specified in the renewal of permission; (m) ―Schedule‖ means schedule annexed to these regulations; (n) "teaching days" means the number of days attended or performed duty in a twelve-month period in the college and its attached teaching hospital as a full-time regular teacher wherein he or she has been appointed; and (o) ―yearly permission‖ means those institutions that are not fulfilling the criteria for ―extended permission‖ shall participate in the counseling process for admitting students, only after obtaining permission from the Medical Assessment and Rating Board for Indian System of Medicine every year. (2) Words and expressions used herein and not defined but defined in the Act shall have the same meanings as respectively assigned to them in the Act. CHAPTER-II MINIMUM ESSENTIAL STANDARD REQUIREMENTS OF A SIDDHA MEDICAL COLLEGE OR INSTITUTION AND ITS ATTACHED TEACHING HOSPITAL IN GENERAL 3. Admission capacity.-The annual admission capacity or students intake capacity of the Siddha Medical College or institution shall be in the slabs of 60, 100, 150 and 200. 4. Land requirement.- (1) The minimum requirement of land for Siddha Medical College or institution and its attached teaching hospital shall not be less than three acres, five acres, seven acres and nine acres for 60, 100, 150 and 200 student intake capacity, respectively. (2) The land shall not be more than two plots or piece of lands and the radial distance between the two plots shall not exceed five kilometers. (3) If the plots are separated by a road or canal or rivulet but connected with a bridge shall be treated as one piece of land: Provided that in case of Tier I and Tier II cities (X and Y categories), North-Eastern States, hilly areas and notified tribal areas, the minimum requirement of land for 60, 100, 150 and 200 student intake capacity shall not be less than two and half acres, three and half acres, five acres and six acres respectively and the college or institution shall have a certificate obtained from the concerned local authorities to establish the specific category of land (as applicable) as a proof. Provided further that the land shall not be in more than two plots and the radial distance between two plots shall not be more than ten kilometres; If the plots are separated by a road or canal or rivulet but connected with a bridge shall be treated as one piece of land. (4) The designated land for a Siddha Medical College or institution, its attached teaching hospital and hostels shall be clearly demarcated and should not be used for any other purpose other than activities of medical institution. (5) The land shall be owned by the college or possessed on lease, in the name of the college, for a period not less than thirty years or the maximum permissible period as per rules or regulations of the respective State Government or Union territory Administration and the renewal of lease shall, however, be required on expiry of lease. 5. Minimum Constructed Area.- (1) For sixty students intake capacity, the Siddha Medical College and attached teaching hospital shall have the minimum constructed area of 3115 and 3200 square meters. (2) For one hundred students intake capacity, the Siddha Medical College and attached teaching hospital shall have the minimum constructed area of 5205 and 4450 square meters, respectively. (3) For one hundred and fifty students intake capacity, the Siddha Medical College and attached teaching hospital shall have the minimum constructed area of 7020 and 5785 square meters, respectively. (4) For two hundred students intake capacity, the Siddha Medical College and attached teaching hospital shall have the constructed area of 8785 and 7075 square meters, respectively as mentioned in the First Schedule and the Second Schedule. (5) The total minimum constructed area of the Siddha Medical College and attached teaching hospital shall be 6315 square meters (60 students intake capacity), 9655 square meters (100 students intake capacity), 12805 square meters (150 students intake capacity) and 15860 square meters (200 students intake capacity). (6) The minimum constructed area and the total constructed area mentioned from sub-regulations (1) to (5) shall be the same for the Siddha Medical College and attached teaching hospital constructed in Tier I and Tier II cities (X and Y categories). (7) The college and hospital shall be constructed in separate buildings with its departments or sections or units as per the details specified in the First Schedule and the Second Schedule. (8) The requirement of separate college and hospital buildings shall be applicable only to the colleges established after the 19th day of February, 2013. 6. The College Campus and general considerations.- (1) The campus designated for Siddha Medical College or institution shall accommodate- (a) Siddha Medical College or institution along with Departments, ancillary sections or units or facilities; (b) teaching hospital along with ancillary sections or units or facilities; (c) hostels, separately for boys and girls including interns, with or without staff quarters; (d) in case of two plots, hostel for interns, male and female separately, shall be in the teaching hospital campus. (2) The campus designated for Siddha Medical College or institution and attached teaching hospital shall have proper road, well-constructed compound wall with proper arrangements for security. (3) Every building shall have all relevant permissions from concerned authorities. (4) There shall be fire safety, fire No Objection Certificate (if applicable), sewage treatment plan, permission from pollution control board, disaster management measures, bio-medical waste management etc. as per extant norms. (5) Institution must provide a barrier free environment for the independence, convenience, and safety of the physically challenged persons apart from ramp and lift. (6) The campus shall have an appropriate layout plan for free vehicular movement and demarcated parking area. (7) The parking area shall be labeled or marked for higher officials, employees, and students. (8) The campus shall have adequate water supply, proper drainage system, and electricity supply including power back-up system. (9) There shall be a central workshop or maintenance cell in the campus, equipped suitably as per the requirements of the college or institution, along with site-engineer (as per the Sixth Schedule), appropriate technical staff or outsourced staff for the maintenance-related works in the areas such as electrical, plumbing, carpentry, sanitary, civil works, water supply, waste management, drainage, housekeeping, and other matters. (10) The Siddha Medical College or institution shall be fully functional and shall provide teaching and training to students of Siddha as per the course curriculum and syllabus as specified by the Commission by establishing an educational ecosystem and shall be ready to impart education as per the minimum essential standards specified by the Commission. (11) An educational ecosystem of the Siddha Medical College or institution shall be established in which all stakeholders of the college or institution, all the Departments, and other units or sections of the college or institution shall function in coordination and collaboration with each other to provide comprehensive education to students in an ideal academic environment
