7389 GI/202 3 (1) EXTRAORDINARY PART II —Section 3 —Sub-section ( ii) PUBLISHED BY AUTHORITY No. 4866] NEW DELHI , WEDNES DAY , NOVEMBER 29, 2023/ AGRAHAYANA 8, 1945 CG-DL-E-30112023-250323 MINISTRY OF COAL NOTIFICATION New Delhi, the 29th November , 2023 S.O. 5082(E).—Whereas by the notification of the Government of India in the Ministry of Coal number S.O. 1316 (E) , dated the 20th March, 2023 issued und er sub -section (1) of section 4 of the Coal bearing Areas (Acquisition and Development) Act, 1957 (20 of 1957) (hereinaf ter referred as to the said Act) and publishe d in the Gazette of India, Extraordina ry, part II, section 3, sub -section (ii) , dated the 20th March, 2023 , the Central Government gave notice of its intension to prospect for coal in 0.17 hectare s (approximately) or 0.42 acres (approximately) of the land in the locality specified in the Schedu le annexed to that notification; And whe reas, the Central Government is satisfied that coal is obtainable in a part or of the said lan d prescribed in the Schedule appended to this notifi cation; Now, therefore, in exercise of the powers conferred by sub-section (1) of section 7 of the said Act, the Central Government hereby gives notice of its intention to acquire the land measuring 0.17 hectare s (approximately) or 0.42 acres (approximat ely) and all rights in or over the said land described in the Schedu le appended hereto . Note 1 : The plan bearing number GM/JNR/LAND/ 2022 -23/CBA (Sec-7)/65, dated the 25th July, 2023 of the area covered by this notification may be inspected at the office of the Collector, District Paschim Bardhaman (West Bengal ) or at the office of the Coal Controller, Coal Controller’s Organisation, Core -2, 5th Floor, Scope Minar, Delhi - 110 092 or at the Office of the Director Technical (P and P), Eastern Coalfields Li mited, Sanctoria, P ost Office, Dishergarh, District Paschim Bardha man (West Bengal) – 713333 . Note 2 : Attention is hereby invited to the provisions of section 8 of the said Act which provides as follows: — “8. Objection to acquisition .- (1) Any person i nterested in any land in respect of which a notification under section 7 has been issued, may, within thirty days of the issue of the notification, object to the acquisition of the whole or any part of the land or any rights in or over suc h land. Explanati on.-It shall not be an objection within the meaning of this section for any person to say that he himself desires to undertake mining operation in the land for the production of coal and that such operations should not be undertaken by th e Central Governme nt of any other person. (2) Every objection under sub -section (1) shall be made to the competent authority in writing, and the competent authority shall give the objector an opportunity of being heard either in person or by a legal petitioner and shall, after hearing all such objections and after making such further inqu iry, if any, as he thinks necessary, either make a report in respect of the land which has been notified under sub -section (1) of section 7 or of rights in or over such land, or make diff erent reports in respect of different parcels of such land of rights in or over such land, to the Central Government, containing his recommendations on the objections, together with the record of the proceedings held by him, t he decision of that Government . (3) For purposes of this section, a person shall be deemed to be interested in land who would be entitled to claim an interest in compensation of the land or any rights in or over such land were acquired under this Act .” Note 3 : The Coal Controller, Coal Controller ’s Organisation, Core -II, 5th Floor, Scope Minar, Delhi -110 092 has been appointed by the Central Government as the competent authority under section 3 of the said Act, vide notification number S .O. 2520, dated the 27th May, 1983 published the Gazette of India, part II, section 3, sub-section (ii), dated the 1 1th June, 1983.
