The Ministry of Civil Aviation, vide G.S.R. 468(E) dated 28th June 2023, exercising powers under the proviso to Article 309 of the Constitution, notifies the Ministry of Civil Aviation (Commissioner of Metro Railway Safety) Recruitment Rules, 2023, effective from publication, establishing recruitment for the Group 'A' Gazetted, Non-ministerial post of Commissioner of Metro Railway Safety (one post as of 2023, subject to variation by workload) in General Central Service, Level-15 of the pay matrix (Rs. 182,200-224,100), to be filled exclusively by absorption of officers from the Indian Railway Service of Engineers, Indian Railway Service of Mechanical Engineers, Indian Railway Service of Electrical Engineers, Indian Railway Service of Signal Engineers, or Indian Railway Traffic Service holding a Bachelor's degree, who either hold an analogous post on a regular basis or have five years' regular service at pay level 14 (Rs. 1,44,200-2,18,200) and at least one year's experience in a Metro Railway organisation, subject to a maximum absorption age of fifty-six years and mandatory consultation with the Union Public Service Commission; the rules bar appointment of persons in bigamous marriages (subject to Central Government exemption), permit relaxation of provisions by the Central Government, and preserve reservations for Scheduled Castes, Scheduled Tribes, Other Backward Classes, ex-servicemen and other special categories; the notification, filed under F. G.S.R . 468(E) .—In exercise of the powers conferred by proviso to article 309 of the Constitution, the President hereby makes the following rules regulating the method of recruitment to Group 'A' post of Commissioner of Metro Railway Safety in the Commission of Railway Safety under the Ministry of Civil Aviation, namely: - 1. Short title and commencement .—(1) These rules may be called the Ministry of Civil Aviation (Commissioner of Metro Railway Safety) Recruitment Rules, 2023. (2)They shall come into force on the date of their publication in the Official Gazette. 2. Initial Constitution .—The incumbe nts holding the posts of Commissioner of Metro Railway Safety, who were appointed on the regular basis to the said post before the commencement of these rules, shall be deemed to have been appointed to the said posts under these rules and the services rend ered by them in the said post before such commencement shall be taken into account for the purposes of probation, confirmation, promotion, etc. 3. Number of posts, Classification and level in the pay matrix. The number of said post, its classification and level in the pay matrix attached thereto, shall be as specified in columns (2) to (4) of the Schedule annexed to these rules. 4. Method of recruitment, age -limit, qualifications etc. .— The method of recruitment, age -limit, qualifications and other matt ers relating to the said post shall be as specified in columns (5) to (13) of the said Schedule. 5. Disqualification .— No person, - (a) who has entered into or contracted a marriage with a person having a spouse living; or (b) who, having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to any of the said posts: Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicabl e to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule. 6. Power to relax .—Where the Central Government is of the opinion that it is necessary or expedient so to do it may, by order, for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons or posts. 7. Saving .—Nothing in these rules shall affect reservation, relaxation of age -limit and o ther concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the ex -servicemen, the other Backward Classes and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard. (11) Absorption: Officers of the Indian Railway Service of Engineers, Indian Railway Service of Mechanical Engineers, Indian Railway Service of Electrical Engineers, Indian Railway Service of Signal Engineers and Indian Railway Traffic Service having Bachelors degree in any discipline from a recognised University or institution and: (a)(i) holding analogous post on regular basis in the parent cadre or department or equivalent; or (ii) With five years regular service in the grade rendered after appointment thereto on a regular basis in the pay level 14 (Rs. 1,44,200/ - - 2,18,200/ -) or equivalent in the parent cadre or department. (b) At least one year experience of working in a Metro Railway organisation. Note: The maximum age -limit for appointment by absorption sha ll not exceed fifty six years as on the closing date of the receipt of application.
