The Ministry of Power (S.O. 361(E), dated 29th January 2024, File No. 25-16/3/2024-PG) records that M/s TP Saurya Limited applied under Section 164 of the Electricity Act, 2003 for authorization to lay an overhead transmission line providing connectivity to its 300 MW Solar Power Project in Bikaner (the Bikaner-II PS overhead transmission line), after the Central Electricity Authority had granted prior approval under Section 68(1) of the Electricity Act, 2003 vide letter No. 25-17/15/2023-PG dated 16.08.2023; following publication of notice in Hindustan Times, Dainik Bhaskar, Indian Express and Rajasthan Patrika (all dated 20.08.2023) and in the Weekly Gazette of India dated 23.09.2023 and 14.10.2023, and receipt of no objections (per affidavit dated 28.12.2023), the Ministry of Power confers on TP Saurya Limited all powers of a telegraph authority under the Indian Telegraph Act, 1885 to lay the transmission line through the villages of Bandarewala, Bhanipura, Sarah Barola and Jaimalsar in Bikaner district, Rajasthan, subject to conditions including a 25-year approval period, consent from local bodies/Railways/Highways authorities, compliance with Appropriate Commission regulations, operation only after Electrical Inspector approval, submission of clearances from Civil Aviation and Defence, and compliance with the Supreme Court's order dated 19.04.2021 in Petition No. 838 of 2019 concerning Great Indian Bustard (GIB) protection where the route falls within a GIB potential or priority zone; the order is signed by M.V.N. L.-33004/99 The Gazette of India CG-DL-E-29012024-251630 EXTRAORDINARY PART II-Section 3-Sub-section (ii) PUBLISHED BY AUTHORITY No. 340] NEW DELHI, MONDAY, JANUARY 29, 2024 MINISTRY OF POWER NOTIFICATION New Delhi, the 29th January, 2024 S.O. 361(E).- Whereas M/s TP Saurya Limited, the applicant with its registered office at C/o The Tata Power Company Limited, Corporate Centre, 34, Sant Tukaram Road, Carnac Bunder, Mumbai-400009, Maharashtra, India, has applied for authorization under Section 164 of the Electricity Act, 2003 for laying of overhead transmission line under "Installation of the dedicated overhead transmission line included in the transmission system for providing connectivity to TP Saurya Limited for its 300 MW Solar Power Project in Bikaner". And whereas, Central Electricity Authority (CEA), Ministry of Power, Government of India vide its letter 25- 17/15/2023-PG dated 16.08.2023 had granted prior approval under section 68(1) of the Electricity Act, 2003 for the overhead transmission line covered under "Installation of the dedicated overhead transmission line included in the transmission system for providing connectivity to TP Saurya Limited for its 300 MW Solar Power Project in Bikaner". M/s TP Saurya Limited had published notice for transmission scheme in local newspapers Hindustan Times (in English) dated 20.08.2023, Dainik Bhaskar (in Hindi) dated 20.08.2023, Indian Express (in English) dated 20.08.2023, and Rajasthan Patrika (in Hindi) dated 20.08.2023 and in Weekly Gazette of India dated 23.09.2023 and 14.10.2023 for the general public to make observations/representations on the proposed transmission route within 2 months from the date of publication. Subsequently, M/s TP Saurya Limited has submitted an affidavit dated 28.12.2023 declaring that no observation/representation was received within 2 months from the date of publication in the official Gazette of Government of India. And now the applicant has requested to confer upon him, all the powers under section 164 of the Electricity Act, 2003, which the telegraph authority possess under the Indian Telegraph Act, 1885 with respect to the placing of telegraph lines and posts for the purpose of a telegraph established or maintained by Government or to be so established or maintained for laying of transmission line under "Installation of the dedicated overhead transmission line included in the transmission system for providing connectivity to TP Saurya Limited for its 300 MW Solar Power Project in Bikaner". The following overhead transmission line is covered under this scheme: Ο TP Saurya Limited Solar Power Project - Bikaner-II PS overhead transmission line The transmission line covered under the above scheme will pass through, over, around and between the following villages, towns and cities of Rajasthan: +--------+-------------------+---------+----------+ | Sl. No. | Name of Villages | Tehsil | District | +========+===================+=========+==========+ | 1. | Bandarewala | Poogal | Bikaner | +--------+-------------------+---------+----------+ | 2. | Bhanipura | Poogal | Bikaner | +--------+-------------------+---------+----------+ | 3. | Sarah Barola | Bikaner | Bikaner | +--------+-------------------+---------+----------+ | 4. | Jaimalsar | Bikaner | Bikaner | +--------+-------------------+---------+----------+ Now, after careful consideration, Ministry of Power, Government of India, under section 164 of the Electricity Act, 2003, confers all the powers to M/s TP Saurya Limited for laying above overhead transmission line, which telegraph authority possesses under the Indian Telegraph Act, 1885 with respect to placing of telegraph lines and posts for the purposes of a telegraph established or maintained, by Government or to be established or maintained subject to following terms and conditions for installing the above mentioned line, namely: i. The approval is granted for 25 years. ii. The Applicant shall have to seek the consent of the concerned authorities i.e., local bodies, Railways, National Highways, State Highways etc. before erection of proposed line. iii. The Applicant shall have to follow regulations/codes of the Appropriate Commission regarding transmission, O&M, open access, etc., framed under Electricity Act, 2003. iv. The Applicant shall operate the line after approval of Electrical Inspector / Chief Electrical Inspector of Central Government. v. The approval is subject to compliance of the requirement of the provisions of the Electricity Act, 2003 and the rules made there under by the applicant. vi. M/s TP Saurya Limited shall have to submit the requisite clearances to Central Electricity Authority after obtaining the same from concerned authorities like Civil Aviation, Defense etc., at the time of Electrical Inspection. vii. In case, the route of above overhead lines (or some portion of the route of above overhead line) falls in the GIB potential zone (or priority zone) marked in the map which is part of the order of the Hon'ble Supreme Court order dated 19.04.2021, in the petition No.838 of 2019 regarding GIB (Great Indian Bustard) case, the applicant has to comply with the directions of the Hon'ble Supreme Court, with regard to undergrounding of the above overhead transmission line and / or fixing of bird diverters, as the case may be as per the Hon'ble Supreme Court Order dated 19.04.2021 and the directions of the technical committee constituted by the Hon'ble Supreme Court in this regard.
