L.-33004/99 The Gazette of India CG-DL-E-03092026-275970 EXTRAORDINARY PART II—Section 3—Sub-section (ii) PUBLISHED BY AUTHORITY No. 4672] NEW DELHI, TUESDAY, SEPTEMBER 1, 2026/BHADRA 10, 1948 MINISTRY OF POWER ORDER New Delhi, the 28th August, 2026 S.O. 4859(E).— Where as M/s Khaba Renewable Energy Private Limited having its registered office at 14th floor, Vatika Tower-S, DLF Golf Course Road, Sector 54, Gurgaon, Haryana-122003, has applied for authorization under Section 164 of the Electricity Act, 2003 for laying of overhead transmission line included in the transmission system for providing connectivity to M/s Khaba Renewable Energy Private Limited for its proposed 250 MW solar power project in Barmer, Rajasthan. And whereas, Ministry of Power, Government of India vide its letter no. 25-17/19/2026-POWERGRID (MoP) dated 15.01.2026 had granted prior approval under section 68(1) of the Electricity Act, 2003 for laying of overhead transmission line included in the transmission system for providing connectivity to M/s Khaba Renewable Energy Private Limited for its proposed 250 MW solar power project in Barmer, Rajasthan. M/s Khaba Renewable Energy Private Limited had published notice for transmission scheme in local newspapers The Indian Express (in English) dated 21.01.2026 & Maru Lehar (in Hindi) dated 21.01.2026 and in Weekly Gazette of India dated 07.02.2026 for the general public to make observations/ representations on the proposed transmission route within two months from the date of publication. Subsequently, M/s Khaba Renewable Energy Private Limited has submitted an affidavit dated 07.07.2026 declaring that no observation/ representation was received within two months from the date of Publication in the official Gazette of Government of India. M/s Khaba Renewable Energy Private Limited had submitted an Undertaking dated 29.07.2026 stating that the route of the proposed overhead transmission line(s) is located outside the Revised Great Indian Bustard (GIB) Priority Area of Rajasthan/Gujarat, as referred to in the judgment of the Hon'ble Supreme Court of India dated 19.12.2025 in Writ Petition (Civil) No. 838 of 2019; the applicant has further undertaken to comply with all directions of the Hon'ble Supreme Court as contained in the said judgment as well as with any subsequent directions issued by the competent authorities in pursuance of the above order by the Hon'ble Supreme Court, and has also stated that the transmission line alignment has been optimized, in such a way that they share maximum common stretch to the extent possible. And now the applicant has requested to confer upon him, all the powers under section 164 of the Electricity Act, 2003, which the telegraph authority possess under the Indian Telegraph Act, 1885 with respect to the placing of telegraph lines and posts for the purpose of a telegraph established or maintained by Government or to be so established or maintained for laying of electrical lines under the transmission scheme "Transmission System for providing connectivity to M/s Khaba Renewable Energy Private Limited for its proposed 250 MW solar power project in Barmer, Rajasthan". The following overhead transmission line is covered under this scheme: • 220 kV S/C transmission line on D/C& M/C towers from the generation switchyard of M/s Khaba Renewable Energy Private Limited located in Village Bohrasar, Bariyada/Bariyara Tehsil Sheo, District Barmer, Rajasthan to Fatehgarh- III PGCIL Substation, Rajasthan, along with associated line bays at both ends. The overhead transmission line covered under the above scheme will pass through, over, around and between the following villages, towns and cities of Rajasthan: +-----------------------------------+----------------+----------------+ | Name of Villages | Taluka | District | +===================================+================+================+ | Mati ka Gol, Bariyada/Bariyara, Khudal, Bohrasar | Sheo | Barmer | +-----------------------------------+----------------+----------------+ | Madai, Neemba, Kabirsar, Sawata par | Fatehgarh | Jaisalmer | +-----------------------------------+----------------+----------------+ Now, after careful consideration, Ministry of Power, Government of India, under section 164 of the Electricity Act, 2003, confers all the powers to M/s Khaba Renewable Energy Private Limited for laying above overhead transmission line, which telegraph authority possesses under the Indian Telegraph Act, 1885 with respect to placing of telegraph lines and posts for the purposes of a telegraph established or maintained, by Government or to be established or maintained subject to following terms and conditions for installing the above mentioned line, namely: i. The approval is granted for 25 years. ii. The Applicant shall have to seek the consent of the concerned authorities, i.e., local bodies, Railways, National Highways, State Highways etc. before erection of proposed line. iii. The Applicant shall have to follow regulations/ codes of the Appropriate Commission regarding transmission, O&M, open access, etc., framed under the Electricity Act, 2003. iv. The Applicant shall operate the line after approval of Electrical Inspector / Chief Electrical Inspector of Central Government. v. The approval is subject to compliance of the requirement of the provisions of the Electricity Act, 2003 and the rules made there under by the applicant. vi. M/s Khaba Renewable Energy Private Limited shall have to submit the requisite clearances to Central Electricity Authority after obtaining the same from concerned authorities like Civil Aviation, Defense etc., at the time of Electrical Inspection. vii. In case, the route of above overhead lines (or some portion of the route of above overhead line) falls in the Revised Great Indian Bustard (GIB) area, the applicant has to comply with the directions of Hon'ble Supreme Court of India in its order dated 19.12.2025 in Writ Petition (Civil) No. 838 of 2019 and any other directions given by competent authorities in pursuance of the above order by Hon'ble Supreme Court.
