Detailed Summary

The Ministry of Environment, Forest and Climate Change, by notification S.O. 3372(E) dated 26th July 2023, recited that its earlier notification S.O. 3250(E) dated 20th July 2022 had directed all standalone re-rolling units or cold rolling units in existence and operation as on the date of that notification, holding valid Consent to Establish and Consent to Operate from the concerned State Pollution Control Board or Union Territory Pollution Control Committee, to apply online for grant of Terms of Reference (ToR) followed by Environment Clearance, and that such units would be granted Standard Terms of Reference per item 3(a) of notification S.O. 1533(E) dated 14th September 2006 and exempted from public consultation, provided the application was made within one year of the said notification; the Central Government deemed it necessary to extend this period by a further six months. In exercise of powers under Section 3 of the Environment (Protection) Act, 1986 (29 of 1986), the Central Government amended notification S.O. 3250(E) dated 20th July 2022 by substituting, in paragraph 1's proviso, the words 'one year and six months' for 'one year'. L. -33004/99 EXTRAORDINARY PART II —Section 3 —Sub-section ( ii) PUBLISHED BY AUTHORITY No. 3227] NEW DELHI , WEDNES DAY, JULY 26, 2023/ SHRAVANA 4, 1945 CG-DL-E-27072023-247634 MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFI CATION New Delhi, the 26th July, 2023 S.O. 3372(E).—WHEREAS, the Central Government, vide notification number S.O. 3250(E), dated the 20th July, 2022, directed that all the standalone re -rolling units or cold rolling units, which are in existence and in operation as on the date of this notification, with valid Consent to Establish and Consent to Operate from the conce rned State Pollution Control Board or the Union territory Pollution Control Committee, as the case may be, shall apply online for grant of Terms of Reference (ToR) followed by Environment Clearance and the said units shall be granted Standard Terms of Refe rence as per item 3(a) of the notification of the Government of India in the, erstwhile Ministry of Environment, Forest and Climate Change number S.O 1533(E ), dated the 14th September, 2006 and shall be exempted from the requirement of public consultation , provided that the application for the grant of ToR shall be made within a period of one year from the date of the said notification. AND WHEREAS, the Central Government deems it necessary to extend the said period by a further period of six months; NOW, THEREFORE, in exercise of the powers conferred by section 3 of the Environment (Protection) Act, 1986 (29 of 1986), the Central Government hereby makes the following amendment in the notification of the Government of India in the Ministry of Environm ent, Forest and Climate Change number S.O. 3250(E), dated the 20th July, 2022, namely: - In the said notification, in paragraph 1, in the proviso, for the words, “one year” the words “one year and six months” shall be substituted.
