This notification (F. No. A-42011/60/2020-HR, notified 11th July 2024) issued by the Airports Authority of India (AAI), under sub-section (2) read with sub-section (4) of Section 42 of the Airports Authority of India Act, 1994 (55 of 1994) and with Central Government approval, promulgates the Airports Authority of India (Leave) Amendment Regulations, 2024, deemed to have come into force retrospectively from 1st October 2020; the amendment substitutes clause (2) of sub-regulation (10) of Regulation 11 of the Airports Authority of India (Leave) Regulations, 2003 (originally published 13th June 2003) to provide that unutilized earned leave and half pay leave may be encashed on retirement up to a combined maximum of 300 days, with the cash equivalent for half pay leave calculated as leave salary admissible for half pay plus Dearness Allowance (with no commutation permitted to offset any shortfall in earned leave), applicable on (a) superannuation, (b) death in service, or (c) cessation of service (excluding disciplinary resignation) at age 50 provided the employee has at least 20 years of service in Government or a Public Sector Enterprise, including a minimum of one year with AAI; the Explanatory Memorandum states the amendment implements a decision of AAI's 195th Board Meeting aligning the policy with Department of Public Enterprises guidelines, as previously communicated via Corporate Human Resource Management Circular No. 68/2020 dated 28th October 2020 and made effective from 1st October 2020; signed by Sanjeev Kumar, Chairman.

No. A-42011/60/2020 -HR.— In exercise of the powers conferred by sub -section (2) read with sub -section (4) of section 42 of the Airports Authority of India Act, 1994 (55 of 1994), the Airports Authority of India, with the approval of the Central Government, hereby makes the following regulations to amend the Airports Authority of India (Leave) Regulations, 2003, namely: - 1. Short title and commencement - These regulations may be called the Airports Authority of India (Leave) Amendment Regulations, 2024. (2). These shall be deemed to have come into force on 1st day of October 2020. 2. In the Airports Authority of India (Leave) Regulations, 2003, for clause (2), of sub -regulation (10) of regulation 11, the following regulation shall be substituted, namely: - (2). Encashment of unutilized half pay leave – ------------------------- ------------ the unutilized earned leave and half pay leave can be considered for encashment of leave on retirement subject to the maximum limit of three hundred days and the cash equivalent payable for half pay leave shall be equal to the leave salary as admissible for half pay plus Dearness Allowance and that to make up the short fall in earned leave, no commutation of half pay leave shall be permissible. (a) leaving the service of Airports Authority of India on attaining the age of superannuation; (b) death while in service; (c) cessation of service including resignation other than on grounds of disciplinary action, on attaining the age of fifty years: Provided that the employee has rendered a minimum of twenty years of service in Government or Public Sector Enterprise including a minimum service of one year in the Airports Authority of India. (2A) Calculation of Encashment of Half Pay Leave. The formulation with respect to calculation and Encashment of half pay leave: - SANJEEV KUMAR , Chairman [ADVT. -III/4/Exty./499 /2024 -25] Note: The principal regulations were published in the Gazette of India, Extraordinary, Part -III, Section 4 vide No. AAI/PERS/EDPA/REG/2002 dated 13th June, 2003. Explanatory Memorandum: The Airports Authority of India Board in its 195th Board Meeting resolved that, the clause on encashment of Earned Leave & Half Pay Leave in Airports Authority of India Leave Regulations, 2003 be amended in line with Department of Public Enterprises Guidelines namely “earned leave and half -pay leave can be considered for encashment of leave on retirement subject to the overall limit of 300 days. The cash equivalent payable for half -pay leave would be equal to the leave salary as admissible for half -pay plus DA and that to make up the short fall in earned leave, no commutation of half -pay leave would be permissible”. The same was issued vide Corporate Human Resource Management Circular No. 68/2020 dated 28th October, 2020, which was made effective from 01st October , 2020. As such, the interest of no employee is being adversely affected by issuing the notification by retrospective effect from 1st day of October, 2020.
