Via S.O. 3804(E) dated 25th August 2023, the Ministry of Environment, Forest and Climate Change, in exercise of powers under sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) and in pursuance of notification S.O. 1533(E) dated 14th September 2006, constituted the State Level Environment Impact Assessment Authority (SEIAA) for Sikkim, comprising Shri B.S. Siktel (Chief Conservator of Forest, Retd.) as Chairman, Dr. Laxuman Sharma (Professor and Head, Department of Horticulture, Sikkim University) as Member, and the Chief Conservator of Forest (Environment & Soil Conservation) as Member-Secretary, each to hold office for three years from publication. It also constituted, in consultation with the State Government of Sikkim, the State Level Expert Appraisal Committee (SEAC) comprising Shri J.B. Subba (Chairman), Shri B.K. Chettri (Chief Scientific Officer, State Pollution Control Board), Shri M.K. Pradhan (Chief Fire Officer, Retd.), Shri D.G. Shrestha (Principal Director, Department of Science, Technology and Climate Change), Shri Ganesh Chandra Khanal, and the Conservator/Director/Additional Director (Environment and Soil Conservation) as Member-Secretary, also for three-year terms. The notification prescribes conflict-of-interest disclosure and recusal requirements for members, directs the Sikkim State Government to designate a secretariat agency for financial and logistical support, and specifies that sitting fees and travel/dearness allowances shall be paid per applicable State Government rules. L. -33004/99 EXTRAORDINARY PART II —Section 3 —Sub-section ( ii) PUBLISHED BY AUTHORITY No. 3644] NEW DEH I FRIDAY , AUGUST 25, 2023/ BHADRA 3, 1945 CG-DL-E-25082023-248339 CG-DL-E-25082023-248339 MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 2 5th August, 2023 S.O. 3 804(E).—In exercise of the powers conferred by sub -section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) and in pursuance of the notification of the Government of India in the erstwhile Ministry of Environment and Forests, number S.O. 1533(E), dated the 14th September, 2006 (hereinafter referred to as the said notification), the Central Government, hereby constitutes the State Level Environment Impact Assessment Authority for Sikkim (hereinafter referred to as the Authority) comprising of the following perso ns, namely: - (i). Shri B.S. Siktel, Chief Conservator of Forest (Retd.), Forest and Environment Department, Government of Sikkim, 6th Mile, Tadong, Gangtok, Near Mahindra & Mahindra Showrooom, Ranipool PS, Gangtok - 737102, Sikkim. -Chairman; (ii). Dr. Laxuman Sharma, Professor and Head, Department of Horticulture, -Member; Sikkim University, Gangtok -737102, Sikkim. (iii). Chief Conservator of Forest (Environment & Soil Conservation), Forest and Environment Department, Government of Sikkim, Forest Secretariat, Deorali, Gangtok -737102, Sikkim. -Member -Secretary. 2. The Chairman and Members of the Authority shall hold office for a period of three years from the date of publication of this notification in the Of ficial Gazette. 3. The Authority shall exercise such powers and follow such procedures as specified in the said notification. 4. The Authority shall take its decision on the recommendations of the State Level Expert Appraisal Committee constituted under paragraph 5 for the State of Sikkim. 5. The Central Government, in consultation with the State Government of Sikkim, for the purpose of assisting the Authority, hereby constitutes the State Level Expert Appraisal Committee (hereinafte r referred to as the Committee), comprising of the following persons, namely: - (i). Shri. J.B Subba, H.No -Gtk/016/L/2 (1), Manbir Colony, Indira Byepass Road, Lower Burtuk, Gangtok -737101, Sikkim -Chairman; (ii). Shri. B.K Chettri Chief Scientifi c Officer, State Pollution Control Board, Sikkim, Forest Secretariat, Deorali, Gangtok -737102, Sikkim. -Member; (iii). Shri M.K Pradhan, Chief Fire Officer (Retd.), Government of Sikkim, Bar Pipal Area, Sichey, East Sikkim -737101. -Member; (iv). Shri D.G Shrestha, Principal Director, Department of Science, Technology and Climate Change, Vigyan Bhawan, Deorali, Gangtok -737102, Sikkim. -Member; (v). Ganesh Chandra Khanal Bahai School Road, Tadong, Gangtok, Sikkim -737102 -Member; (vi). Conservato r of Forest or Director or Additional Director, (Environment and Soil Conservation), Forest and Environment Department, Government of Sikkim, Forest Secretariat, Deorali, Gangtok -737102, Sikkim. -Member -Secretary. 6. The Chairman and Members of th e Committee, shall hold office for a period of three years from the date of publication of this notification in the Official Gazette. 7. In order to avoid any conflict of interest, - (i) the Chairman and Members of the Authority, and the C ommittee shall - (a) declare to which consulting organisation they have been associated with and also the project proponents; (b) not undertake any consultation or associate with regard to preparation of Environment Impact Assessment and Environment Manag ement Plan for project, which is to be decided by the Authority, or to be appraised by the Committee during their tenure; and (ii) if in the preceding five years, the Chairman or any Member of the Committee has provided consultancy services or conduct ed Environment Impact Assessment studies for any project proponent, in that situation they shall recuse themselves from the meetings of the Committee from the process of appraisal of any project proposed by such proponents. 8. The Committee shall ex ercise such powers and follow such procedures as specified in the said notification. 9. The Committee shall function on the principle of collective responsibility and the Chairman shall endeavour to reach consensus in each case, and if they fail t o reach consensus, the view of the majority shall prevail. 10. (1) The State Government of Sikkim shall specify an agency to act as secretariat of the Authority and the Committee. (2) The secretariat shall provide financial and logistic support includ ing accommodation, transportation and such other facilities in respect of their functions under the said notification. 11. The siting fee, travelling allowances and dearness allowances to the Chairman and Members of the Authority and the Committee, shall be paid in accordance with the provisions of relevant rules for the time being inforce of the State Government of Sikkim.
