L.-33004/99 The Gazette of India CG-DL-E-25032025-261937 EXTRAORDINARY PART II-Section 3-Sub-section (ii) PUBLISHED BY AUTHORITY No. 1354] NEW DELHI, TUESDAY, MARCH 25, 2025/ CHAITRA 4, 1947 2022 GI/2025 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II-SEC. 3(ii)] MINISTRY OF COAL NOTIFICATION New Delhi, the 24th March, 2025 S.O. 1372(E).— Whereas by the notification of the Government of India in the Ministry of Coal number S.O.2467(E) dated 26th June 2024 issued under sub-section (1) of section 4 of the Coal Bearing Areas (Acquisition & Development) Act, 1957 (20 of 1957) (hereinafter referred to as the said Act), and published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii), dated the 26th June, 2024, the Central Government gave notice of its intention to prospect for coal in 202.113 hectares (approximately) or 499.42 acres (approximately) of the land in the locality specified in the Schedule annexed to that notification; And whereas the Central government is satisfied that coal is obtainable in a part of the said land specified in the Schedule appended to this notification; Now, therefore, in exercise of the powers conferred by sub-section (1) of section 7 of the said Act, the Central Government hereby gives notice of its intention to acquire the land measuring 202.113_hectares (approximately) or 499.42 acres (approximately) and all rights in or over the said land specified in the schedule appended hereto; Note 1: The plan bearing number SECL/BSP/GM(L&R)/Land/14 dated the 22th October, 2024 of the area covered by this notification may be inspected in the office of the Collector District Anuppur, Madhya Pradesh or in the office of the Coal Controller, Coal Controller's Organization, Ministry of Coal, Scope Minar, 5th Floor, Core II, Laxmi Nagar, Delhi 110092 or in the office of the South Eastern Coalfields Limited (Revenue Section), Seepat Road, Bilaspur 495006, Chhattisgarh or in the office of the General Manager (Land & Revenue), Seepat Road, Bilaspur 495006, Chhattisgarh. Note 2: Attention is hereby invited to the provisions of section 8 of the said Act which provides as follows: - 7 [PART II-SEC. 3(ii)] "8. Objection to acquisition. - (1) Any person interested in any land in respect of which a notification under section 7 has been issued, may, within thirty days of the issue of the notification, object to the acquisition of the whole or any part of the land or any rights in or over such land. Explanation:- It shall not be an objection within the meaning of this section for any person to say that he himself desires to undertake mining operation in the land for the production of coal and that such operations should not be undertaken by the Central Government or by any other person. (2) Every objection under sub section (1) shall be made to the competent authority in writing, and the competent authority shall give the objector an opportunity of being heard either in person or by a legal practitioner and shall, after hearing all such objections and after making such further inquiry, if any, as he thinks necessary, either make a report in respect of the land which has been notified under sub-section (1) of section 7 or of rights in or over such land, or make different reports in respect of different parcels of such land or of rights in or over such land, to the Central Government, containing his recommendations on the objections, together with the record of the proceedings held by him, the decision of that Government. (3) For the purposes of this section, a person shall be deemed to be interested in land who would be entitled to claim an interest in compensation if the land or any rights in or over such land were acquired under this Act. Note 3. The Coal Controller, Coal Controller's Organization, Ministry of Coal, Scope Minar, 5th Floor, Core II, Laxmi Nagar, Delhi 110092 has been appointed by the Central Government as the competent authority under section 3 of the said Act, vide notification number SO 905, dated the 20th March 1987, published in Part II, section 3, sub- section (ii) of the Gazette of India dated the 04th April, 1987.
