Detailed Summary

The Ministry of Environment, Forest and Climate Change, vide G.S.R. 487(E) dated 22nd July, 2025, has published the Environment (Protection) Sixth Amendment Rules, 2025. These rules, made in exercise of powers conferred by sections 6 and 25 of the Environment (Protection) Act, 1986 (29 of 1986), amend the Environment (Protection) Rules, 1986, which were originally published as S.O.844(E) dated 19th November, 1986, and last amended vide G.S.R. 482(E) dated 21st July, 2025. The amendment specifically substitutes serial number 40 and its related entries in Schedule-I of the 1986 Rules, introducing new environmental standards for the Pesticide Industry. The new standards cover Effluent Standards (Compulsory and Additional Parameters), Emission Standards, and Emission Standards for Incinerators, along with provisions for Effluent from Incinerators and Storm Water. For the Pesticide Industry, compulsory effluent parameters include COD (250 mg/l for technical grade, 150 mg/l for formulation grade), BOD (30 mg/l), pH (6.5-8.5), Oil and Grease (10 mg/l), Suspended Solids (100 mg/l), and a Bioassay Test (90% survival of fish after 96 hours as per IS: 6582-1971). Additional parameters like Cyanide (0.1 mg/l), Arsenic (0.1 mg/l), Mercury (0.01 mg/l), and various pesticides are also specified. The rules state that these effluent standards are not applicable to industries discharging to Common Effluent Treatment Plants but apply to discharges to land and surface water bodies, including treated wastewater for horticulture or irrigation. State Pollution Control Boards or Committees are to prescribe limits for Total Dissolved Solids, Sulphates, and Chlorides. Emission standards include limits for HCl (20 mg/Nm³), Cl2 (5 mg/Nm³), NH3 (30 mg/Nm³), and various pesticide compounds (20 mg/Nm³), with a total cumulative solvent loss not exceeding 5 percent annually. Incinerator emission standards specify limits for Particulate Matter (50 mg/Nm³), HCl (50 mg/Nm³), SO2 (200 mg/Nm³), CO (100 mg/Nm³ daily average), Total Organic Carbon (20 mg/Nm³), and Total Dioxins and Furans (0.1 ngTEQ/Nm³). Specific operational requirements for incinerators, including minimum temperatures (e.g., 1100°C for halogenated organic waste <1%, 850±25°C in primary and 1100°C in secondary chambers for >1%) and ash/residue quality, are also detailed. Effluent from incinerator scrubbers and floor washings must comply with specified standards, including Schedule VI of the Environment (Protection) Rules, 1986, and total dissolved solids buildup shall not exceed 1000 mg/l over raw water TDS. Storm water management provisions are also included.

No. Q-15017/06/2019-CPW] NEELESH KUMAR SAH, Joint Secretary MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 22nd July, 2025 G.S.R. 487(E).—Whereas, the draft of certain rules further to amend the Environment (Protection) Rules, 1986 were published, vide notification of the Government of India in the Ministry of Environment, Forest and Climate Change, number, G.S.R. 753(E), dated 17th October, 2023, in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i), dated the 18th October, 2023, inviting objections or suggestions from all persons likely to be affected thereby before the expiry of a period of sixty days from the date on which copies of the Gazette containing the said notifications were made available to the public; And whereas, the copy of the said Gazette notification was made available to the public on the 18th October, 2023; And Whereas, objections and suggestions received from all persons and stakeholders in response to the aforesaid notification have been duly considered by the Central Government; Now, therefore, in exercise of the powers conferred by sections 6 and 25 of the Environment (Protection) Act, 1986 (29 of 1986), the Central Government hereby makes the following rules further to amend the Environment (Protection) Rules, 1986, namely: - 1. Short title and commencement.—(1) These rules may be called the Environment (Protection) Sixth Amendment Rules, 2025. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Environment (Protection) Rules, 1986, in Schedule-l, for serial number 40 and the entries relating thereto, the following serial number and entries shall be substituted, namely:- | S. The concerned State Pollution Control Board or Pollution Control Committee shall prescribe limits of Total Dissolved Solids, Sulphates and Chlorides depending on the usages of recipient water body in downstream, in which effluent shall be disposed off. 3. (ii) The CO2 concentration in tail gas shall not be less than 7%. (iii) In case, halogenated organic waste is less than 1% by weight input waste, all the facilities in single chamber incinerators shall be designed so as to achieve a minimum temperature of 1100°C in the incinerator. For fluidized bed technology based incinerator, temperature shall be maintained at 950°C. (iv) In case halogenated organic waste is more than 1% by weight in input waste, waste shall be incinerated only in twin chamber incinerators and all the facilities shall be designed to achieve a minimum temperature of 850±25°C in primary chamber and 1100°C in secondary combustion chamber with a gas residence time in secondary combustion chamber not less than two seconds. (v) Scrubber meant for scrubbing emissions shall not be used as quencher. (vi) Incineration plants shall be operated (combustion chambers) with such temperature, retention time and turbulence, as to achieve Total Organic Carbon (TOC) content in the incineration ash and residue less than 3% and their loss on ignition is less than 5% of the dry weight. In case of nonconformity, ash and residue as the case may be, shall be re-incinerated. (vii) The incinerator shall have a chimney of at least thirty meters height. E. Effluent from Incinerator Note: (i) Effluent from scrubber(s) and floor washings shall flow through closed conduit or pipe network and be treated to comply with the effluent standards mentioned at 'B' above read with Schedule VI: General Standards for Discharge of Environment Pollutions (Part A : Effluents) notified under the Environment (Protection) Rules, 1986. (ii) The build-up in Total Dissolved Solids in wastewater or floor washings shall not exceed 1000 mg/l over and above the Total Dissolved Solids of raw water used. F. Storm water Note: (i) Storm water shall be allowed to mix with scrubber water and/or floor washings. (ii) Storm water shall be channelized through separate drains passing through a High Density Polyethylene lined pit having holding capacity of 10 minutes (hourly average) of rainfall." [F.
