Via S.O. 5436(E) dated 22nd December 2023, the Ministry of Power granted M/s Juniper Nirjara Energy Private Limited (JNEPL, formerly Spring Nirjara Energy Private Limited), registered at F-9, First Floor, Manish Plaza-1, Sector-10, Dwarka, New Delhi, authorization under Section 164 of the Electricity Act, 2003, conferring upon it all powers that a telegraph authority possesses under the Indian Telegraph Act, 1885, for laying the dedicated overhead transmission line connecting its 50 MW Solar Power Project to the Bikaner II (ISTS) Pooling Station via a 220kV line. Prior approval for the scheme had been granted under section 68(1) of the Electricity Act, 2003 vide Ministry of Power letter No. 25-17/14/2023-PG dated 10.08.2023; public notice was published in Indian Express and Dainik Bhaskar on 17.08.2023 and in the Weekly Gazette of India on 02.09.2023, and JNEPL affirmed via affidavit dated 02.11.2023 that no objections were received within the two-month period. The transmission line passes through Nokha Daiya and Nokha (Kolayat Tehsil), Kawani, Jaimalsar and Sarah Borla (Bikaner Tehsil), and Bhanipura (Pugal Tehsil), all in Bikaner District, Rajasthan. The authorization is granted for 25 years, subject to conditions including consent of local bodies, Railways and Highway authorities, compliance with Appropriate Commission regulations, operation only after Electrical Inspector approval, submission of Civil Aviation and Defence clearances to the Central Electricity Authority, and, where the route falls in a Great Indian Bustard (GIB) potential/priority zone, compliance with the Supreme Court's order dated 19.04.2021 in Petition No. 838 of 2019 regarding undergrounding of lines or bird diverters. 7907 GI/202 3 (1) EXTRAORDINARY PART II —Section 3 —Sub-section ( ii) PUBLISHED BY AUTHORITY No. 5206] NEW DELHI, FRIDAY , DECEMBER 22, 2023/ PAUS HA 1, 1945 CG-DL-E-23122023-250853 MINISTRY OF POWER ORDER New Delhi, the 22nd December, 2023 S.O. 5436(E).— Whereas M/s Juniper Nirjara Energy Private Limited (JNEPL)(erstwhile M/s Spring Nirjara Energy Private Lim ited), the applicant with its registered address at F -9, First Floor, Manish Plaza -1, Plot No. 7 MLU, Sector -10, Dwarka New Delhi -110075has applied for authorization under Section 164 of the Electricity Act, 2003 for laying of overhead transmission line un der the scheme “Installation of the dedicated overhead transmission line included in the transmission system for providing connectivity to Juniper Nirjara Energy Private Limited for its 50 MW Solar Power Project in Bikaner District of Rajasthan”. And where as, Ministry of Power, Government of India vide its letter No. 25 -17/14/2023 -PG dated 10.08.2023 had granted prior approval under section 68(1) of the Electricity Act, 2003 for the overhead line covered under the scheme “Installation of the dedicated overh ead transmission line included in the transmission system for providing connectivity to Juniper Nirjara Energy Private Limited for its 50 MW Solar Power Project in Bikaner District of Rajasthan”. M/s Juniper Nirjara Energy Private Limited had published not ice for transmission scheme in local newspapers Indian Express (in English) dated 17.08.2023, Dainik Bhaskar(in Hindi) dated 17.08.2023 and in Weekly Gazette of India dated 02.09.2023 for the general public to make observations/representations on the propo sed transmission route within Two Months from the date of publication. Subsequently, M/s Juniper Nirjara Energy Private Limited has submitted an affidavit dated 02.11.2023 declaring that no observation/representation was received within Two Months from the date of publication in the official gazette of Government of India. And now the applicant has requested to confer upon him, all the powers under section 164 of the Electricity Act, 2003, which the telegraph authority possess under the Indian Telegraph Ac t, 1885 with respect to the placing of telegraph lines and posts for the purpose of a telegraph established or maintained by Government or to be so established or maintained for laying of transmission line underthe scheme“Installation of the dedicated over head transmission line included in the transmission system for providing connectivity to Juniper Nirjara Energy Private Limited for its 50 MW Solar Power Project in Bikaner District of Rajasthan”. The following overhead transmission line is covered under t his scheme:  Juniper Nirjara Energy Private Limited (Solar Power Project) – Bikaner II (ISTS) Pooling Station 220kV line The transmission line covered under the above scheme will pass through, over, around and between the following villages, towns and citi es of Rajasthan: S. No. Name of Villages Tehsil District 1 NokhaDaiya, Nokha Kolayat Bikaner 2 Kawani, Jaimalsar, Sarah Borla Bikaner Bikaner 3 Bhanipura Pugal Bikaner Now, after careful consideration, Ministry of Power, Government of India, under section 164 of the Electricity Act, 2003, confers all the powers to M/s Juniper Nirjara Energy Private Limited for laying above overhead transmission line, which telegraph authority possesses under the Indian Telegraph Act, 1885 with respect to placing of telegraph lines and posts for the purposes of a telegraph established or maintained, by Government or to be established or maintained subject to following terms and conditions for installing the above mentioned line, namely: i. The approval is granted for 25 years. ii. The Applicant shall have to seek the consent of the concerned authorities i.e., local bodies, Railways, National Highways, State Highways etc. before erection of proposed line. iii. The Applicant shall have to follow regulations/codes of the Appropriate Commission regarding transmission, O&M, open access, etc., framed under Electricity Act, 2003. iv. The Applicant shall operate the line after approval of Electrical Inspector / Chief Electrical Inspector of Central Government. v. The approval is subject to compli ance of the requirement of the provisions of the Electricity Act, 2003 and the rules made there under by the applicant. vi. M/s Juniper Nirjara Energy Private Limited shall have to submit the requisite clearances to Central Electricity Authority after obtainin g the same from concerned authorities like Civil Aviation, Defense etc., at the time of Electrical Inspection. vii. In case, the route of above overhead lines (or some portion of the route of above overhead line ) falls in the GIB potential zone (or priority zo ne) marked in the map which is part of the order of the Hon’ble Supreme Court order dated 19.04.2021, in the petition No.838 of 2019 regarding GIB (Great Indian Bustard) case, the applicant has to comply with the directions of the Hon’ble Supreme Court, wi th regard to undergrounding of the above overhead transmission line and / or fixing of bird diverters, as the case may be as per the Hon’ble Supreme Court Order dated 19.04.2021 and the directions of the technical committee constituted by the Hon’ble Supre me Court in this regard.
