Issued by the Ministry of Power (S.O. 3256(E), dated 20 July 2023), this Order grants M/s POWERGRID ER NER Transmission Limited (PENTL), registered at Core-4, Scope Complex 7, Lodhi Road, South Delhi (present address B-9, Qutab Institutional Area, Katwaria Sarai, New Delhi), the powers under section 164 of the Electricity Act, 2003 that a telegraph authority possesses under the Indian Telegraph Act, 1885 for placing telegraph lines and posts, in order to lay the 220 kV D/C transmission line from Kathalguri (NEEPCO) to Namsai (POWERGRID) under the transmission scheme "System Strengthening Scheme for Eastern and North Eastern Regions," passing through listed villages in Namsai district, Arunachal Pradesh, and in the Margherita, Doom Dooma and Tengakhat areas of Tinsukia and Dibrugarh districts, Assam; it recites that the Central Electricity Authority (CEA), Ministry of Power, had granted prior approval under section 68(1) of the Electricity Act, 2003 vide letter No. CEA-PS-12-15/20/2018-PSPA-II Division dated 22 June 2022, that PENTL published notice of the transmission scheme in local newspapers on 19 October 2022 (The Assam Tribune, The Arunachal Times, Asomiya Praditin) and 22 November 2022 (Khabor Morcha, Purvanchal Prahari) and in the Weekly Gazette of India from 14 to 20 January 2023 inviting objections within 60 days, that PENTL submitted its application on the NSWS portal on 31 March 2023, and filed an affidavit dated 25 April 2023 declaring no objections were received; the authorization is subject to conditions including a 25-year approval term, obtaining consent of local bodies, Railways, National Highways and State Highways authorities before erection, compliance with the Appropriate Commission's regulations/codes on transmission and open access, operation only after approval of the Electrical Inspector/Chief Electrical Inspector of the Central Government, compliance with the Electricity Act, 2003 and rules thereunder, and submission of clearances from authorities such as Civil Aviation and Defence to the Central Electricity Authority at the time of electrical inspection; the Order is signed by Sanjeev Jain, Under Secretary, under file number 25-16/3/2023-PG.

And whereas, Central Electricity Authority (CEA), Ministry of Power, Government of India vide its letter no. CEA -PS-12-15/20/2018 -PSPA -II Division dated 22.06.2022 had granted prior approval under section 68 (1) of the Electricity Act, 2003 to M/s PENTL for the overhead lines covered under the transmission scheme “System Strengthening Scheme for Eastern and North Eastern Regions”. M/s PENTL has published notice for transmission scheme in local newspapers dated 19.10.2022 (The Assam Tribune, The Arunachal Tim es, and Asomiya Praditin) and 22.11.2022 (Khabor Morcha and Purvanchal Prahari) and in Weekly Gazette of India dated 14.01.2023 to 20.01.2023 for the general public to make observations/ representations on th e proposed transmission route within 60 days fro m the date of publication. Subsequently, M/s PENTL has submitted the application online at NSWS portal on 31.03.2023 and submitted an affidavit dated 25.04.2023 declaring that no objection has been received f rom public within 60 days of publication of Pub lic Notice in newspapers / Gazette of India. And now the applicant has requested to confer upon him, all the powers under section 164 of the Electricity Act, 2003, which the telegraph authority possess under t he Indian Telegraph Act, 1885 with respect to t he placing of telegraph lines and posts for the purpose of a telegraph established or maintained by Government or to be so established or maintained for laying of electric lines under the transmission scheme “ System Strengthening Scheme for Eastern and Nor th Eastern Regions”. The approval is granted for 25 years. ii. The Applicant shall have to seek the consent of the concerned authorities i.e., Local bodi es, Railways, National Highways, State Highways etc. before erection of proposed lin es. iii. The Applicant shall have to follow regulations/codes of the Appropriate Commission regarding transmission, O&M, open access, etc., framed under Electricity Act, 2003. iv. The Applicant shall operate the lines after approval of Electrical Inspector / Chief Electrical Inspector of Central Government. v. The approval is subject to compliance of the requirement of the provisions of the Electricity Act, 2003 and the rules made t here under by the applicant. vi. M/s PENTL shall have to submit the requisite clearances to Central Electricity Authority after obtaining the same from concerned authorities like Civil Aviation, Defense etc., at the time of Electrical Inspection.
