The Committee, established under paragraph 6 to assist the Authority, is chaired by Dr. Avinash Kuma Sharda and includes nine other members, such as representatives from the Central Ground Water Board, Chandigarh, and Chandigarh Pollution Control Committee, and Scientist SD, Department of Environment, Chandigarh Administration, as Member Secretary. Both the Chairman and Members of the Authority and the Committee will hold office for three years from the notification's publication date. They are mandated to exercise powers and follow procedures as specified in S.O. 1533(E) dated 14th September, 2006. The Chairman and Members of the Authority shall hold office for a period of three years from the date of publication of this notification in the Official Gazette. 3. The Authority shall exercise such powers and follow such procedures as specified in the said notification. 4. The Authority shall take its decision on the recommendations of the Union territory Level Expert Appraisal Committee constituted under paragraph 6 of this notification. 5. All decisions of the Authority shall be taken in a meeting and shall be unanimous: Provided that, in case a decision is taken by majority, the details of views, for and against it, shall be clearly recorded in the minutes and a copy thereof sent to the Central Government. 6. The Chairman and Members of the Committee, shall hold office for a period of three years from the date of publication of this notification in the Official Gazette. 8. The Committee shall exercise such powers and follow such procedures as specified in the said notification. 9. The Committee shall function on the principle of collective responsibility and the Chairman shall endeavour to reach a consensus in each case, and if consensus cannot be reached, the view of the majority shall prevail. 10. In order to avoid any conflict of interest, (i) the Chairman and Members of the Authority and the Chairman and Member of the Committee shall, — (a) declare as to which consulting organisation they have been associated with and also the project proponents; and (b) not undertake any consultation or associate with regard to preparation of environment impact assessment and environment management plan for a project, which is to be decided by the Authority or to be appraised by the Committee during their tenure; and (ii) if the Chairman or any Member of the Authority or the Committee has provided consultancy services or conducted environment impact assessment studies for any project proponent during the preceding five years, in that event they shall recuse themselves from the meetings of the Authority or the Committee in the process of appraisal of any project proposed by such proponents. 11. The administration of Chandigarh shall notify an agency to act as Secretariat for the Authority and the Committee and the Secretariat shall provide all financial and logistic support including accommodation, transportation and such other facilities in respect of their functions under the said notification. 12. The sitting fees, travelling allowances and dearness allowances to the Chairman and Members of the Authority and the Committee shall be paid in accordance with the provisions of relevant rules of the Union territory administration.
