Detailed Summary

The Ministry of Civil Aviation, through Notification G.S.R. 136(E) dated 17th February, 2026, has published draft rules, the Aircraft (Investigation of Accidents and Incidents) (First Amendment) Rules, 2026. These rules are proposed by the Central Government under the powers conferred by Sections 11, 12, 19, Sub-section (4) of Section 25, Sections 30 and 33 of the Bharatiya Vayuyan Adhiniyam, 2024 (16 of 2024), with publication mandated by Section 34 of the same Act. The draft rules aim to amend the principal Aircraft (Investigation of Accidents and Incidents) Rules, 2025, which were published on 10th November, 2025, via G.S.R. 829(E) dated 7th November, 2025. A key amendment proposed in Rule 2 of the draft rules is the substitution of the preamble's enabling clause in the principal rules to explicitly include "and in supersession of the Aircraft (Investigation of Accidents and Incidents) Rules, 2017, except as respects things done or omitted to be done before such supersession." The public is given fifteen days from the Gazette's availability to submit objections or suggestions to the Director-General of Aircraft Accident Investigation Bureau at Udaan Bhawan, Aurobindo Marg, New Delhi-110003, or via email to dg.aaib-moca@gov.in or aaib.moca@nic.in for consideration by the Central Government. These amendment rules are slated to come into force upon their publication in the Official Gazette.
