Authorization under Section 164 of Electricity Act, 2003 to M/s Khidrat Renewable Energy Private Limited

2084 GI/202 4 (1) EXTRAORDINARY PART II —Section 3 —Sub-section ( ii) PUBLISHED BY AUTHORITY No. 1403] NEW DELHI, MON DAY , MARCH 1 8, 2024 /PHALGUNA 28, 1945 CG-DL-E-18032024-253208 MINISTRY OF POWER ORDER New Delhi, the 18th March , 2024 S.O. 1472(E).— Whereas M/s Khidrat Renewable Energy Private Limited has its registered address at 401, level 4, Salcon Rasvilas Building Sak et District Centre, New Delhi –110017, India has applied for authorization under Section 164 of the Electricity Act, 2003 for laying of overhead tran smission line under “Installation of the dedicated overhead transmission line included in the transmission system for providing connectivity to M/s Khidrat Renewable Energy Private Limited for its 300 MW Solar Power Plant in Bikaner, Rajasthan”. And where as, Ministry of Power, Government of India vide its letter No. 25 -17/7/2023 -PG dated 10.07.2023 had granted prior approval under section 68(1) of the Electricity Act, 2003 for the overhead line covered under “Installation of the dedicated overhead transmis sion line included in the transmission system for providing connectivity to M/s Khidrat Renewable Energy Private Limited for its 300 MW Solar Power Plant in Bikaner, Rajasthan”. M/s Khidrat Renewable Energy Private Limited had published notice for transmis sion scheme in local newspapers The Indian Express (in English) dated 07.08.2023, Dainik Navjyoti (in Hindi) dated 07.08.2023 and in Weekly Gazette of India dated 02.09.2023 for the general public to make observations/representations on the proposed transm ission route within 2 Months from the date of publication. Subsequently, M/s Khidrat Renewable Energy Private Limited has submitted an affidavit dated 27.12.2023 declaring that no observation/representation was received within 2 months from the date of Pub lication in the official gazette of Government of India. And now the applicant has requested to confer upon him, all the powers under section 164 of the Electricity Act, 2003, which the telegraph authority possess under the Indian Telegraph Act, 1885 with respect to the placing of telegraph lines and posts for the purpose of a telegraph established or maintained by Government or to be so established or maintained for laying of electric lines under “Installation of the dedicated overhead transmission line included in the transmission system for providing connectivity to M/s Khidrat Renewable Energy Private Limited for its 300 MW Solar Power Plant in Bikaner, Rajasthan”. The following overhead line is covered under this scheme: o Khidrat Renewable Energy Privat e Limited Solar Power Project (Generation Switchyard in Randheesar village, Bikaner District, Rajasthan) – Bikaner II PS (ISTS Substation) 220 kv S/c Line on D/c Tower The transmission line covered under the above scheme will pass through, over, around an d between the following villages, towns and cities of Rajasthan: Sl. Bhanipura Poogal Bikaner Now, after careful consideration, Ministry of Power, Government of India, under section 164 of the Electricity Act, 2003, confers all the powers to M/s Khidrat Renewable Energy Private Limited for laying above overhead line, which telegraph author ity possesses under the Indian Telegraph Act, 1885 with respect to placing of telegraph lines and posts for the purposes of a telegraph established or maintained, by Government or to be established or maintained subject to following terms and conditions fo r installing the above mentioned line, namely: i. The approval is granted for 25 years. ii. The Applicant shall have to seek the consent of the concerned authorities i.e., local bodies, Railways, National Highways, State Highways etc. before erection of proposed line. iii. The Applicant shall have to follow regulations/codes of the Appropriate Commission regarding transmission, O&M, open access, etc., framed under Electricity Act, 2003. iv. The Applicant shall operate the line after approval of Electrical Inspector / Chief Electrical Inspector of Central Government. v. The approval is subject to compliance of the requirement of the provisions of the Electricity Act, 2003 and the rules made there under by the applicant. vi. M/s Khidrat Renewable Energy Private Limited shall have to submit the requisite clearances to Central Electricity Authority after obtaining the same from concerned authorities like Civil Aviation, Defense etc., at the time of Electrical Inspection. vii. In case, the route of above overhead lines (or some portion of th e route of above overhead line) falls in the Great Indian Bustard (GIB) potential zone (or priority zone) marked in the map which is part of the order of the Hon’ble Supreme Court order dated 19.04.2021, in the petition No.838 of 2019 regarding Great India n Bustard (GIB) case, the applicant has to comply with the directions of the Hon’ble Supreme Court, with regard to undergrounding of the above overhead transmission line and / or fixing of bird diverters, as the case may be as per the Hon’ble Supreme Court Order dated 19.04.2021 and the directions of the technical committee constituted by the Hon’ble Supreme Court in this regard.
