The Ministry of Environment, Forest and Climate Change, by notification G.S.R. 46(E) dated 16th January 2024, in exercise of powers under clause (i) of sub-section (1) of Section 63 read with clause (b) of sub-section (4) of Section 44 of the Wild Life (Protection) Act, 1972 (53 of 1972), and on supersession of the Wild Life (Protection) Licensing (Additional Matters for Consideration) Rules, 1983, makes the Wild Life (Protection) Licencing (Additional Matters for Consideration) Rules, 2024, effective from the date of publication; the rules direct that the Chief Wild Life Warden or authorised officer, when granting a licence under Section 44(1), must additionally consider the applicant's capacity to handle the business (facilities, equipment, premises suitability), the source and manner of obtaining supplies, the number of existing licences for the same business in the area, and the implications of the licence on hunting or trade of the wild animals concerned, with a proviso that no licence may be granted for any animal listed in Schedule I to the Act without prior consultation with the Central Government; the notification is issued under File No. WL-1/27/2023-WL and signed by Bivash Ranjan, Additional Director General of Forests (WL) and Director, Wild Life Preservation.

Short title and commencement. (1) These rules may be called the Wild Life (Protection) Licencing (Additional Matters for Consideration) Rules, 2024'. (2) They shall come into force on the date of their publication in the Official Gazette. 2. Additional matters for consideration for grant of licence.- For the purpose of granting a licence referred to in sub-section (1) of section 44 of the Wild Life (Protection) Act, 1972, the Chief Wild Life Warden or the authorised officer, as the case may be, shall in addition to the matters specified in clause (b) of sub-section (4) of that section, have regard to the following other matters, namely:- (i) capacity of the applicant to handle the business concerned with reference to facilities, equipment and suitability of the premises for such business; (ii) source and the manner in which the supplies for the business concerned would be obtained; (iii) number of licence for the relevant business already in existence in the area concerned; (iv) implications which the grant of such licence would have on the hunting or trade of wild animals concerned: Provided that no such licence shall be granted if it relates to any wild animal specified in Schedule I to the Act, except with the previous consultation of the Central Government.
