The Ministry of Power, by Resolution No. 48-19/2/2023-NRE dated 17 November 2023, amended the Guidelines for Tariff Based Competitive Bidding Process for Procurement of Firm and Dispatchable Power from Grid Connected Renewable Energy Power Projects with Energy Storage Systems, originally notified vide Resolution No. 23/03/2023-R&R published in the Gazette of India (Extraordinary, Part I, Section 1) on 9 June 2023. Clause 14.5, concerning Early Commencement of Supply of Power from a single component outside the Power Purchase Agreement (PPA), is substituted: where a project has multiple components and one or more (wind, solar, or other renewable energy generating system) is ready for grid injection while the remaining component is not, the generator may commence supply from the ready component outside the PPA, after giving fifteen days' advance notice to the End Procurer(s) and Intermediary Procurer, who must accept the offer to avail such power within fifteen days; if neither accepts within that period, the developer may sell the unaccepted power through power exchanges or bilateral arrangements; where both accept, the End Procurer(s) are accorded priority in availing the power; and the tariff payable by the End Procurer(s) and Intermediary Procurer in such cases is up to 50% of the PPA tariff, or as specifically stipulated in the tender documents. EXTRAORDINARY PART I—Section 1 PUBLISHED BY AUTHORITY No. 294] NEW DELHI, FRIDAY, NOVEMBER 17, 2023/KARTIKA 26, 194 5 CG-DL-E-17112023-250106 MINISTRY OF POWER RESOLUTION New Delhi, the 17th November , 2023 Amendment to the Guidelines for Tariff Based Competitive Bidding Process for Procurement of Firm and Dispatchable Power from Grid Connected Renewable Energy Power Projects with Energy Storage Systems No. 48-19/2/2023 -NRE .—The Guidelines for Tariff Based Competitive Bidding Process for Procurement of Firm and Dispatchable Power from Grid Connected Renewable Energy Power Projects with Energy Storage Systems have been notified vide Resolution No. 23/03/2023 -R&Rpublished in the Gazette of India (Extraordinary) (Part1 - Section 1) on 9th June 2023 . 2. The Central Government hereby notifies the following amendment in the said guidelines dated 9th June 2023 :- Clause 14.5 of the existing guidelines is substituted with the following, Clause 14.5: Early Commencement of Supply of Power from single component outside PPA : In case of multiple project components and if one or more such component (wind or solar or other RE power generating system ) is ready for injection of power into the grid, but the remaining component is unable to commence supply of power, the Generator will be allowed to commence supply of power from such component which is ready outside the ambit of PPA. The developer shall give fifteen (15) days advance notice to both End Procurer(s) and Intermediary Procurer regarding the advance commissioning of full or part capacity. The End Procurer(s) and Intermediary Procurer shall give acceptance f or availing such power within 15 days from the date of service of notice. In case both the End Procurer(s) and Intermediary Procurer do not give their acceptance to purchase power within the stipulated period, the developer can sell the power to the extent not accepted by th e End Procurer(s) and Intermediary Procurer in the power exchanges or through bilateral arrangements. Provided that in case both the End Procurer(s) and Intermediary Procurer give their acceptance to purchase power, the End Procurer(s) will be accorded priority in availing such power. Provided further that in such cases tariff payable by the End Procurer(s) and Intermediary Procurer shall be up to 50% of the PPA tariff or specific provisions in this regard will be stipulated in the tend er documents.
