The Ministry of Power, vide Resolution No. 48-19/2/2023-NRE dated 17th November 2023, amends the Guidelines for Tariff Based Competitive Bidding Process for Procurement of Power from Grid Connected Wind Power Projects (originally notified vide Resolution No. 27/02/2023-RCM published 26th July 2023) by substituting Clause 14.4 on 'Early Commencement of Supply of Power', permitting Wind Power Generators (WPG) to commence supply from full or part capacity even before the Scheduled Commercial Operation Date subject to transmission connectivity and Long-Term Access/General Network Access availability, requiring fifteen days' advance notice to the End Procurer(s) and Intermediary Procurer, who must accept within fifteen days of notice or else the developer may sell the unaccepted power via power exchanges or bilateral arrangements, with the End Procurer(s) accorded priority and tariff for both Procurers equal to the PPA tariff; the resolution is signed by Hemant Kumar Pandey, Chief Engineer (R&R).

EXTRAORDINARY PART I—Section 1 PUBLISHED BY AUTHORITY No. 290] NEW DELHI, FRIDAY, NOVEMBER 17, 2023/KARTIKA 26, 194 5 CG-DL-E-17112023-250104 MINISTRY OF POWER RESOLUTIO N New Delhi, the 17th November, 2023 Amendment to the Guidelines for Tariff Based Competitive Bidding Process for Procurement Power from Grid Connected Wind Power Projects No. 48 -19/2/2023 -NRE .—The Guidelines for Tariff Based Competitive Bidding Process f or Procurement of Power from Grid Connected Wind Power Projects have been notified vide Resolution No.27/02/2023 -RCM published in the Gazette of India (Extraordinary) (Part1 - Section 1) on 26th July 2023. 2. The Central Government hereby notifies the following amendment in the said guidelines dated 26th July, 2023: - Clause 14.4 of the existing guidelines is substituted with the following, Clause 14.4 . Early Commencement of Supply of Power: The WPG shall be permitted for c ommencement of supply from full as well as part capacity of the Project even prior to the SCSD subject to availability of transmission connectivity and Long -Term Access (LTA)/General Network Access (GNA). In cases of early part or full commencement of supp ly of power, the developer shall give fifteen (15) days advance notice to both End Procurer(s) and Intermediary Procurer regarding the advance commissioning of full or part capacity. The End Procurer(s) and Intermediary Procurer shall give acceptance for a vailing such power within 15 days from the date of service of notice. In case, both the End Procurer(s) and Intermediary Procurer do not give their acceptance to purchase power within the stipulated period, the developer can sell the power to the extent no t accepted by the End Procurer(s) and Intermediary Procurer in the power exchanges or through bilateral arrangements. Provided that in case both the End Procurer(s) and Intermediary Procurer give their acceptance to purchase the power, the End Procurer(s) will be accorded priority in availing such power. Provided further that in such cases tariff payable by the End Procurer(s) and the Intermediary Procurer shall be equal to the PPA tariff.
