7166 GI/202 3 (1) EXTRAORDINARY PART II —Section 3 —Sub-section ( ii) PUBLISHED BY AUTHORITY No. 4733] NEW DELHI, THURSDAY , NOVEMBER 16, 2023/ KARTIKA 25, 1945 CG-DL-E-16112023-250067 MINISTRY OF COAL NOTIFICATION New Delhi, the 14th November , 2023 S.O. 4942(E).— Whereas by the notification of the Government of India in the Ministry of Coal number S.O. 1438 (E), dated the 28th March, 2023 issued under sub -section (1) of section 4 of the Coal bearing Areas (Acquisition and Development) Act, 1957 (20 of 1957) (hereinafter referred as to the said Act) and published in the Gazette of India, Extraordinary, part II, section 3, sub section (ii), dated the 28th March, 2023, the Central Government gave notice of its intension to prospect for coal in 4.21 hectares (approximately) or 10.40 acres (approximately) of the land in the locality specified in the Schedule annexed to that notification; And whereas, the Central Government is satisfied that coal is obtainable in a part of the said land prescribed in the Schedule appended to this notification; Now, therefore, in exercise of the powers conferred by sub -section (1) of section 7 of the said Act, the Central Government hereby gives notice of its intention to acquire the land measuring 4.21 hectares (approximately) or 10.40 acres (approximately) and all rights in or over the said land described in the Schedule appended hereto. Note 1 : The p lan bearing number GM/JNR/LAND/2023 -24/CBA (Sec – 7)/63, dated the 25th July, 2023 of the area covered by this notification may be inspected at the office of the Collector, District Paschim Burdwan (West Bengal) or at the office of the Coal Controller, Co al Controller’s Organisation, Core -II, 5th Floor, Scope Minar, Delhi - 110 092 or at the office of the Director Technical (P and P), Eastern Coalfields Limited, Sanctoria, Post Office Dishergarh, Paschim Bardhaman, West Bengal – 713333. Note 2 : Attention is hereby invited to the provisions of section 8 of the said Act which provides as follows: - “8. Objection to acquisition. - (1) Any person interested in any land in respect of which a notification under section 7 has been issued, may, withi n thirty days of the issue of the notification, object to the acquisition of the whole or any part of the land or any rights in or over such land. Explanation. - It shall not be an objection within the meaning of this section for any person to say that he himself desires to undertake mining operation in the land for the production of coal and that such operations should not be undertaken by the Central Government of any other person. (2) Every objection under sub -section (1) shall be made to the compete nt authority in writing, and the competent authority shall give the objector an opportunity of being heard either in person or by a legal petitioner and shall, after hearing all such objections and after making such further inquiry, if any, as he thinks ne cessary, either make a report in respect of the land which has been notified under sub -section (1) of section 7 or of rights in or over such land, or make different reports in respect of different parcels of such land of rights in or over such land, to th e Central Government, containing his recommendations on the objections, together with the record of the proceedings held by him, the decision of that Government. (3) For purposes of this section, a person shall be deemed to be interested in land who would be entitled to claim an interest in compensation of the land or any rights in or over such land were acquired under this Act. Note 3 : The Coal Controller, Coal Controller’s Organisation, Core -II, 5th Floor, Scope Minar, Delhi -110 092 has been appointed by t he Central Government as the competent authority under section 3 of the said Act, vide notification number S.O. 2520, dated the 27th May, 1983 published the Gazette of India, part II, section 3, sub -section (ii), dated the 11th June, 1983. The plots lie in mouzas Chakbanbahal and Konardihi under Andal and Pandaveswar Block. The aforesaid polygons are described below: - Polygon - A1, A2, A3, A4, A5, A6, A7, A8, A9, A1: (1) Line A1 -A2 : The line starts from the point A1 on the common boundary of mouzas Ckakbanbahal, Jurisdiction List number 17 and Ckakbakala, Jurisdiction List number 19, moves towards east up to the point A2 across the middle of the Revenue Survey Plot number 340 of the mouza Ckakbanbahal, Jurisdiction List number 17. (2) Line A2 -A3: T he line starts from the point A2, moves towards north -east up to the point A3 within the Revenue Survey Plot number 340 of the mouza Ckakbanbahal, Jurisdiction List number 17. (3) Line A3 -A4: The line starts from the point A3 moves towards south -east up to the point A4 within the Revenue Survey Plot number 340 of the mouza Ckakbanbahal, Jurisdiction List number 17 .
