Authorization under Section 164 of the Electricity Act, 2003 for laying of electric line

L. -33004/99 EXTRAORDINARY PART II —Section 3 —Sub-section ( ii) PUBLISHED BY AUTHORITY No. 4342] NEW DELHI, MONDAY , OCTOBER 16, 2023/ ASVINA 24, 1945 CG-DL-E-16102023-249463 MINISTRY OF POWER ORDER New Delhi, the 16th October , 2023 S.O. 4513(E).— whereas M/s ReNew Surya Jyoti Private Limited, the applicant with its registered office at 138, Ansal Chambers -II, Bhikaji Cama Place, New Delhi -110066, has applied for authorization under Section 164 of the Electricity Act, 2003 for laying of electr ic line under “Installation of the dedicated overhead transmission line included in the Transmission System for providing Connectivity to M/s Renew Surya Jyoti Private Limited for its 210 MW Solar Power Plant in Jaisalmer, Rajasthan”. And whereas, CEA, Min istry of Power, Government of India vide its letter no. I/26179//2023 dated 08.02.2023 had granted prior approval under section 68(1) of the Electricity Act, 2003 to M/s ReNew Surya Jyoti Private Limited for the overhead lines covered under “Installation o f the dedicated overhead transmission line included in the Transmission System for providing Connectivity to “M/s Renew Surya Jyoti Private Limited” for its 210 MW Solar Power Plant in Jaisalmer, Rajasthan”. M/s ReNew Surya Jyoti Private Limited had publis hed notice for transmission scheme in local newspapers dated 20.04.2023 (Indian Express, Prabhat Abhinandan and Dainik Navjyoti) and in Weekly Gazette of India dated 06.05.2023 to 12.05.2023 for the general public to make observations/representations on th e proposed transmission route within 60 days from the date of publication. Subsequently, M/s ReNew Surya Jyoti Private Limited has submitted an affidavit dated 10.08.2023 declaring 01 objection was received from M/s Juniper Green Energy Private Limited (JG EPL), within two months from the date of publication in gazette. However, the same was withdrawn by M/s JGEPL vide email dated 12.06.2023. Further, no other objections/representations have been received from the public within two months of publication of P ublic Notice for the above transmission scheme in Newspapers/ Gazette of India. And now the applicant has requested to confer upon him, all the powers under section 164 of the Electricity Act, 2003, which the telegraph authority possess under the Indian Telegraph Act, 1885 with respect to the placing of telegraph lines and posts for the purpose of a telegraph established or maintained by Government or to be so established or maintained for laying of electric li nes under “Installation of the dedicated overhead transmission line included in the Transmission System for providing Connectivity to “Renew Surya Jyoti Private Limited” for its 210 MW Solar Power Plant in Jaisalmer, Rajasthan”. The following overhead line s are covered under this transmission scheme: “Common Pooling Station of Renew Surya Jyoti Pvt. Ltd. Solar Power Plant (210 MW) & Renew Surya Pratap Pvt. Ltd. Solar Power Plant (210 MW) at Renew Surya Jyoti -Fatehgarh -III PS 220 kV S/C line on D/C and M/C towers.” The above overhead lines included under the scheme will pass through, over, around and between the following villages, towns and cities: Sl. No. Village Tehsil District State 1 Sanjeet, Mandai, Neemba, Modha, Kotha, Harbha, Bogniyai, Toga, Rabri Chak, Morha, Tejmalta Fatehgarh Jaisalmer Rajasthan 2 Barsinga, Kalijal, Sheo, Swami Ka Gaon, Matuon ki Dhani Sheo Barmer Now, after careful consideration, Ministry of Power, Government of India, under section 164 of the Electricity Act, 2003, confers all the powers to M/s ReNew Surya Jyoti Private Limited for laying above overhead lines, which telegraph authority possesses under the Indian Telegraph Act, 1885 with respect to placing of telegraph lines and posts for the purposes of a telegraph established or maintained, by Government or to be established or maintained subject to following terms and conditions for installing the ab ove mentioned lines, namely: i. The approval is granted for 25 years; ii. The Applicant shall have to seek the consent of the concerned authorities i.e. local bodies, Railways, National Highways, State Highways etc. before erection of proposed lines; iii. The Applican t shall have to follow regulations/codes of the Appropriate Commission regarding transmission, O&M, open access, etc., framed under the Electricity Act, 2003. iv. The Applicant shall operate the lines after approval of Electrical Inspector / Chief Electrical I nspector of Central Government. v. The approval is subject to compliance of the requirement of the provisions of the Electricity Act, 2003 and the rules made there under by the applicant. vi. M/s ReNew Surya Jyoti Private Limited shall have to submit the requisit e clearances to Central Electricity Authority after obtaining the same from concerned authorities like Civil Aviation, Defence etc., at the time of Electrical Inspection. vii. In case, the route of above overhead lines (or some portion of the route of above ove rhead line) falls in the Great Indian Bustard (GIB) potential area (or priority area) marked in the map which is part of the order of the Hon’ble Supreme Court order dated 19.04.2021, in the petition No.838 of 2019 regarding GIB case, the applicant has to comply with the directions of the Hon’ble Supreme Court, with regard to undergrounding of the above overhead transmission line and/or fixing of bird diverters, as the case may be as per the Hon’ble Supreme Court Order dated 19.04.2021 and the directions of the technical committee constituted by the Hon’ble Supreme Court in this regard.
