Detailed Summary

The Ministry of Coal, vide S.O. 1398(E) dated 15th March 2024, records that by earlier notification S.O. 4070(E) dated 14th September 2023 issued under sub-section (1) of section 4 of the Coal Bearing Areas (Acquisition and Development) Act, 1957 (20 of 1957), the Central Government had given notice of intention to prospect for coal in approximately 360.97 hectares (891.96 acres) of land in Ballarpur Area, Chandrapur district, Maharashtra; being satisfied that coal is obtainable in part of that land, the Central Government, in exercise of powers under sub-section (1) of section 7 of the said Act, now gives notice of its intention to acquire 360.97 hectares (891.96 acres) and all rights therein, for the Ballarpur North-West Opencast Mine as per plan number C-I(E)/III/JJJR/0224/1010 dated 22nd February 2024, comprising plot numbers 26 to 33 in village Manoli and numerous listed plot numbers in village Kolgaon, with the area broken down as 14.12 hectares (tenancy, part) in Manoli and 346.85 hectares (334.64 hectares tenancy plus 12.21 hectares government, part) in Kolgaon; objections under section 8 of the Act may be raised within thirty days to the competent authority, the Coal Controller, Coal Controller Organisation, Scope Minar, Laxmi Nagar, Delhi, appointed vide notification S.O. 2519 dated 27th May 1983; the notification is signed by Bhabani Prasad Pati, Joint Secretary, under file number F. MINISTRY OF COAL NOTIFICATION New Delhi, the 15th March , 2024 S.O. 1 398(E).—Whereas by the notification of the Government of India in the Ministry of Coal number S. O. 4070(E), dated the 14th September, 2023 issued under sub -section (1) of section 4 of the Coal Bearing Areas ( Acquisition and Development) Act, 1957 (20 of 1957) (hereinafter referred to as the said Act), published in the Gazette of India, Extraordinary, Part II, Section 3, Sub -section (ii), dated the 14th September, 2023, the Central Government gave notice of its intention to prospect for coal in 360.97 hectares (approximately) or 891.96 acres (approximately) of the land in the locality specified in the Schedule annexed to that notification; And whereas the Central Govern ment is satisfied that coal is obtainable in a part of the said land specified in the Schedule appended to this notification; Now, therefore, in exercise of the powers conferred by sub -section (1) of section 7 of the said Act, the Central Government her eby gives notice of its intention to acquire the land measuring 360.97 hectares (approximately) or 891.96 acres (approximately) and all rights in or over the said land specified in the Schedule appended hereto; Note 1: The plan bearing number C -I(E)/III/J JJR/0224/1010, dated the 22nd February, 2024, the area covered by this notification may be inspected in the office of the Collector, District Chandrapur (Maharashtra) or in the office of the Coal Controller, Coal Controller Organisation, Scope Minar, 5th floor, Core -2, Laxmi Nagar, Delhi -110092 or in the office of the General Manager, Western Coalfields Limited (Revenue Department), Coal Estate, Civil Lines, Nagpur (Maharashtra) -440001. Note 2 : Attention is hereby invited to the provisions of section 8 of the aforesaid Act which provides as follows: - ―8. Objections to acquisition. - (1) Any person interested in any land in respect of which a notification under section 7 has been issued, may, within thirty days of the issue of the notification, object to th e acquisition of the whole or any part of the land or of any rights in or over such land. Explanation. - It shall not be an objection within the meaning of this section for any person to say that he himself desires to undertake mining operations in the land for the production of coal and that such operations should not be undertaken by the Central Government or by any other person. (2) Every objection under sub -section (1) shall be made to the competent authority in writing, and the competent authority shall give the objector an opportunity of being heard either in person or by a legal practitioner and shall, after hearing all such objections and after making such further inquiry, if any, as he thinks necessary, either make a report in respect of the land whi ch has been notified under sub -section (1) of section 7 or of rights in or over such land, or make different reports in respect of different parcels of such land or of rights in or over such land, to the Central Government, containing his recommendations o n the objections, together with the record of proceedings held by him, for the decision of that Government. (3) For the purpose of this section, a person shall be deemed to be interested in land who would be entitled to claim an interest in compensation if the land or any rights in or over such land were acquired under this Act.‖ Note 3 : The Coal Controller, Coal Controller Organisation, Scope Minar, 5th floor, Core -2, Laxmi Nagar, Delhi - 110092 has been appointed by the Central Government as the competent a uthority under section 3 of the said Act, vide notification number S.O. 2519, dated the 27th May, 1983, published in Part II, Section 3, Sub -section (ii) of the Gazette of India, dated the 11th June, 1983.
