MINISTRY OF COAL
NOTIFICATION
New Delhi, the 15 th March, 2024
S.O. 1394 (E).—Whereas by the notification of the Government of India in the Ministry of Coal number S.O.
2151(E), dated the 9th May, 2023, issued u nder sub -section (1) of section 4 of the Coal Bearing Areas (Acquisition
and Development) Act, 1957 (20 of 1957) (hereinafter referred to as the said Act), and published in the Gazette of
India, Extraordinary, Part II, Section 3, Sub-section (ii), dated the 10th May, 2023, the Central G overnment gave
notice of its intention to prospect for coal in 350.68 hectares (approximately) or 866.16 acr es (approximately) of the
land in the locality specified in the Schedule annexed to that notification;
And whereas, the Central Gove rnment is satisfied that coal is obtainable in a part of the said lan d specified in
the Schedule appended to this notification;
Now, therefore, in exercise of powers conferred by sub -section (1) of section 7 of the said Act, the Centra l
Government hereby gives notice of its intention to acquire the land measuring 350.68 hectares (approximately) or
866.16 acres (approximately) and all rights in or over the said land as specified in the Schedule appended hereto;
Note1: The plan bearing n umber PVUNL/BAN/P3/SEC -7(1), dated the 28th August, 2023 , the area covered by this
notification may be inspected in the office of the Deputy Commissioner, District Latehar -829206, Jharkhand or at the
office of the Coal Controller, Coal Controller’s Organ isation, Ministry of Coal, Scope Minar, 5th floor, Core -II, Laxmi
Nagar, Delhi -110092 or at the office of the DGM (Chief Manager -Civil), Patratu Vidyut Utpadan Nigam Limited,
Patratu, District Ramgarh -829119, Jharkhand or at the office of the of the Additional General Manager (C hief
Manager ), Patratu Vidyut Utpadan Nigam Limited, Patratu, District Ramgarh -829119, Jharkhand.
Note 2: Attention is hereby invited to the provisions of section 8 of the said Act which provides as follows: -
“8. Objec tion to acquisition. - (1) Any person interested in any land in respect of which a notification under
section 7 has been issued, may, within thirty days of the issue of the notification, object to the acquisition of the
whole or any part of the land or an y rights in or over such land.
Explanation. - It shall not be an objection within the meaning of this section for any person to say that he himself
desires to undertake mining operation s in the land for the production of coal and that such operations should not
be undertake n by the Central Government or by any other person.
(2) Every objection under sub -section (1) shall be made to the competent authority in writing, and the competent
authority shall give the objector an opportunity of being heard either in person or by a legal practitioner and
shall, after hearing all such objections and after making such further inquiry, if any, as h e thinks necessary,
either make a report in respect of the land which has been notifi ed under sub -section (1) of section 7 or of
rights in or over such land, or make different reports in respect of different parcels of such land or of right in
or over such land, to the Central Government, containing his recommendations on the objections, t ogether
with the record of the proceedings held by him, for the decision of the Government.
(3) For the purpose of this section, a person shall be deemed to be interested in land who would be entitled to
claim an interest in compensation if the land or any rights in or over such lan d were acquired under this Act ”.
Note 3: The Coal Controller, Coal Controller’s Organis ation, Ministry of Coal, Scope Minar, 5th floor, Core -II,
Laxmi Nagar, Delhi -110 092 has been appointed by the Central Government as the competent authority under
section 3 of the said Act, vide notification number S.O. 2570(E), dated the 11th August, 2017, published in Part II,
Section 3, Sub -section (ii) of the Gazette of India, dated th e 11th August, 2017.
