By S.O. 4928(E) dated 7th November 2024, the Ministry of Power records that M/s Powergrid Bhadla III Transmission Limited (formerly Bhadla-III Transmission Limited), registered at B-9, Qutab Institutional Area, Katwaria Sarai, Hauz Khas, New Delhi-110016, applied under section 164 of the Electricity Act, 2003 for authorisation to lay an overhead transmission line under the scheme Transmission system for evacuation of Power from REZ in Rajasthan (20 GW) under phase-III Part-B1, for which the Central Electricity Authority had granted prior approval under section 68(1) vide File No. CEA-PS-11-21(25)/1/2018-PSPA-1-Part(1)/375-376 dated 25.10.2022; public notice was published in The Times of India (English) and Rajasthan Patrika (Hindi) both dated 30.12.2023 and in the Weekly Gazette of India dated 13.04.2024, and the applicant's affidavit dated 30.08.2024 declared that 16 observations/representations received within two months were resolved with no further objections; the Ministry of Power now confers on the applicant, for the Bhadla-III - Sikar-II 765 kV D/c line, all powers under section 164 of the Electricity Act, 2003 that a telegraph authority holds under the Indian Telegraph Act, 1885 for placing lines and posts, for 25 years, subject to conditions including obtaining consent of local bodies, Railways and Highway authorities, complying with Appropriate Commission regulations and Electrical Inspector approval, and complying with Supreme Court orders in Petition No. 838 of 2019 concerning the Great Indian Bustard (GIB) where the route falls within GIB habitat; the transmission line route passes through numerous villages, tehsils and districts of Rajasthan, including Nokha and Bajju Kolayat tehsils (Bikaner district), Pokaran tehsil (Jaisalmer district), Ladnu tehsil (Nagaur district), Sujangarh, Bidasar and Ratangarh tehsils (Churu district), and Laxmangarh, Sikar, Dhod, Palsana and Sikar Gramin tehsils (Sikar district); the order is signed by M.V.N. And whereas, Central Electricity Authority (CEA), Ministry of Power, Government of India vide its File No. CEA-PS-11-21(25) /1/2018-PSPA-1-Part(1)/375-376 dated 25.10.2022 had granted prior approval under section 68(1) of the Electricity Act, 2003 for the overhead line covered under the transmission scheme “Transmission system for evacuation of Power from REZ in Rajasthan (20 GW) under phase-III Part-B1”. M/s Powergrid Bhadla III Transmission Limited (formerly known as Bhadla-III Transmission Limited) had published notice for transmission scheme in local newspapers The Times of India (in English) dated 30.12.2023, Rajasthan Patrika (in Hindi) dated 30.12.2023 and in Weekly Gazette of India dated 13.04.2024 for the public to make observations/representations on the proposed transmission route within two months from the date of publication. Subsequently, M/s Powergrid Bhadla-III Transmission Limited (formerly known as Bhadla-III Transmission Limited) has submitted an affidavit dated 30.08.2024 declaring that 16 observations/representations were received within two months from the date of publication in the Newspaper / official gazette of Government of India, the same have been resolved by M/s Powergrid Bhadla III Transmission Limited and no further observation/representation was received. And now the applicant has requested to confer upon him, all the powers under section 164 of the Electricity Act, 2003, which the telegraph authority possess under the Indian Telegraph Act, 1885 with respect to the placing of telegraph lines and posts for the purposes of a telegraph established or maintained by Government or to be so established or maintained for laying of electric lines under the transmission scheme "Transmission system for evacuation of Power from REZ in Rajasthan (20 GW) under phase-III Part-B1". Ministry of Power, Government of India, under section 164 of the Electricity Act, 2003, confers all the powers to M/s Powergrid Bhadla III Transmission Limited (formerly known as Bhadla-III Transmission Limited) for laying above overhead line, which telegraph authority possesses under the Indian Telegraph Act, 1885 with respect to placing of telegraph lines and posts for the purposes of a telegraph established or maintained, by Government or to be established or maintained subject to following terms and conditions for installing the above mentioned line, namely: i. The approval is granted for 25 years. ii. The Applicant shall have to seek the consent of the concerned authorities i.e., local bodies, Railways, National Highways, State Highways etc. before erection of proposed line. iii. The Applicant shall have to follow regulations/codes of the Appropriate Commission regarding transmission, O&M, open access, etc., framed under the Electricity Act, 2003. iv. The Applicant shall operate the line after approval of Electrical Inspector / Chief Electrical Inspector of Central Government. v. The approval is subject to compliance of the requirement of the provisions of the Electricity Act, 2003 and the rules made there under by the applicant. vi. M/s Powergrid Bhadla-III Transmission Limited (formerly known as Bhadla-III Transmission Limited) shall have to submit the requisite clearances to Central Electricity Authority after obtaining the same from concerned authorities like Civil Aviation, Defense etc., at the time of Electrical Inspection. vii. In case, the route of above overhead lines (or some portion of the route of above overhead line) falls in the Great Indian Bustard (GIB) area, the applicant has to comply with the orders of the Hon'ble Supreme Court in the petition No.838 of 2019 regarding Great Indian Bustard (GIB) case, and the directions of the technical/expert committee constituted by the Hon'ble Supreme Court in this regard.
