L. -33004/99 EXTRAORDINARY PART II —Section 3 —Sub-section ( ii) PUBLISHED BY AUTHORITY No. 3012 ] NEW DEL HI, FRIDAY, JULY 14, 2023/ASHADHA 23, 194 5 CG-DL-E-14072023-247345 MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATI ON New Delhi, the 14th July, 2023 S.O. 3141(E).— Whereas the Central Government, in exercise of the power conferred by sub section (1) and clauses (v) and (xiv) of sub -section (2) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the En vironment (Protection) Rules, 1986 issued in the Gazette of India, Extraordinary, Part - II, Section 3, sub -section (ii), vide number S.O. 680 (E), dated the 29th March, 2012; And whereas the Central Government is of the opinion that it is necessary and expe dient in the public interest to amend the said notification; And whereas sub -rule (4) of rule 5 of the Environment (Protection) Rules, 1986 provides that whenever it appears to the Central Government that it is in the public interest to do so, it may dispe nse with the requirement of notice under clause (a) of sub -rule (3) of rule 5 of the Environment (Protection) Rules, 1986; And whereas the Central Government is of the opinion that it is in the public interest to dispense with the requirement of notice und er clause (a) of sub rule (3) of rule 5 of the Environment (Protection) Rules, 1986 for amending the notification number S.O. 680 (E), dated the 29th March, 2012 ; Now, therefore, in exercise of the powers conferred by sub -section (1) and clauses (v) and (x iv) of sub - sections (2) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub -rule (4) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby makes the following amendments in the notification of th e Government of India, Ministry of Environment, Forest and Climate Change, published in the Gazette of India, Extraordinary, Part -II, Section 3, Sub -section (ii), vide notification number S.O. 680 (E), dated the 29th March, 2012, namely: - In the said not ification, - (i) in paragraph 2, – (a) for sub -paragraph (1), the following sub -paragraph shall be substituted, namely: - “(1) The State Government shall, prepare a Zonal Master Plan, for the purposes of the Eco -sensitive Zone, in consultation with local people an d in accordance with this notification, within a period of two years from the date of publication of this amendment notification.”; (b) in sub -paragraph (6), the words, “and approval thereof by the Central Government”, shall be omitted; (ii) in paragraph 4, in sub-paragraph (2) for clause (a) to (h) , the following clauses shall be substituted, namely: - “ Serial number Constituents Designation (i) The Commissioner of Kolhan Revenue Division Chairman; (ii) A representative of the Central Pollution Control Board, constituted under subsection 1 of section 3 of the Water (Prevention and Control of Pollution) Act, 1 974 ( 1 6 of 1974) Member; (iii) A representative of the Department of Forests and Environment, Government of Jharkhand Member; (iv) A representative of the Depa rtment of Mines, Government of Jharkhand Member; (v) A representative of the Department of Industries, Government of Jharkhand Member; (vi) A representative of the Department of Revenue, Government of Jharkhand Member; (vii) A representative of the Department of Irrigation, Government of Jharkhand Member; (viii) A representative of the Department of Public Works, Government of Jharkhand Member; (ix) A representative of Non -governmental Organi zations working in the field of environment (including heritage conservation) to be nominated by the State Government for a period not exceeding 3 years in each case Member; (x) The Regional Officer, Jharkhand State Pollution Control Board, Ranchi Member; (xi) The Senior Town Planner, Government of Jharkhand Member; (xii) One expert in the area of ecology and environment to be nominated by the State Government for a period not exceeding 3 years in each case Member; (xiii) The Divisional Forest Officer, In -charge of the Dalma Wildlife Sanctuary Convener ”.
