ORDER
New Delhi, the 11th December, 2023
S.O. 5295(E).—Whereas POWERGRID KPS3 Transmission Limited (a 100% wholly owned subsidiary of
Power Grid Corporation of India Ltd.) the applicant with its registered office at B -9, Qutab Institutional Area,
Katwaria Sarai, New Delhi, South Delhi, Delhi, India -110016, has applied for authorizat ion under Section 164 of the
Electricity Act, 2003 for laying of overhead transmission line under “Establishment of Khavda Pooling Station -3
(KPS3) in Khavda RE Park”.
And whereas, Central Electricity Authority (CEA), Ministry of Po wer, Government of India vide its letter
CEA -PS-11-23(20)/1/2018 -PSPA -I Division -Part(1)/84 -85 I/26209/2023 dated 10.02.2023 had granted prior approval
under section 68(1) of the Electricity Act, 2003 for the overhead line covered under “Establishment of K havda
Pooling Station -3 (KPS3) in Khavda RE Park”.
M/s POWERGRID KPS3 Transmission Limited had published notice for transmission scheme in local
newspapers The Times of India (in English) dated 07.07.2023, Rajasthan Patrika (in Hindi) dated 07.07.2023, Guj arat
Samachar (in Gujrati) dated 07.07.2023 and in Weekly Gazette of India dated 05.08.2023 for the general public to
make observations/representations on the proposed transmission route within 2 Months from the date of publication.
Subsequently, M/s POWER GRID KPS3 Transmission Limited has submitted an affidavit dated 22.11.2023 declaring
that no observation/representation was received within 2 Months from the date of Publication in the official gazette of
Government of India.
And now the applicant has req uested to confer upon him, all the powers under Section 164 of the Electricity
Act, 2003, which the telegraph authority possess under the Indian Telegraph Act, 1885 with respect to the placing of
telegraph lines and posts for the purpose of a telegraph est ablished or maintained by Government or to be so
established or maintained for laying of transmission line under “Establishment of Khavda Pooling Station -3 (KPS3) in
Khavda RE Park”. The following overhead line is covered under this scheme:
KPS3 - KPS2 765 kV D/C line.
The transmission line covered under the above scheme will pass through, over, around and between the following
villages, towns and cities of Gujarat:

Now, after careful consideration, Ministry of Power, Government of India, under section 164 of the Electricity Act,
2003, confers all the powers to M/s POWERGRID KPS3 Transmission Limited for laying above overhead line, w hich
telegraph authority possesses under the Indian Telegraph Act, 1885 with respect to placing of telegraph lines and posts
for the purposes of a telegraph established or maintained, by Government or to be established or maintained subject to
following te rms and conditions for installing the above mentioned line, namely:
i. The approval is granted for 25 years.
ii. The Applicant shall have to seek the consent of the concerned authorities i.e., local bodies, Railways,
National Highways, State Highways etc. before erection of proposed line.
iii. The Applicant shall have to follow regulations/codes of the Appropriate Commission regarding transmission,
O&M, open access, etc., framed under Electricity Act, 2003.
iv. The Applicant shall operate the line after approval of Electri cal Inspector / Chief Electrical Inspector of
Central Government.
v. The approval is subject to compliance of the requirement of the provisions of the Electricity Act, 2003 and
the rules made there under by the applicant.
vi. M/s POWERGRID KPS3 Transmission Limit ed shall have to submit the requisite clearances to Central
Electricity Authority after obtaining the same from concerned authorities like Civil Aviation, Defense etc., at
the time of Electrical Inspection.
vii. In case, the route of above overhead lines (or so me portion of the route of above overhead line ) falls in the
Great Indian Bustard (GIB) potential zone (or priority zone) marked in the map which is part of the order of
the Hon’ble Supreme Court order dated 19.04.2021, in the petition No.838 of 2019 rega rding Great Indian
Bustard (GIB) case, the applicant has to comply with the directions of the Hon’ble Supreme Court, with
regard to undergrounding of the above overhead transmission line and / or fixing of bird diverters, as the case
may be as per the Hon’ ble Supreme Court Order dated 19.04.2021 and the directions of the technical
committee constituted by the Hon’ble Supreme Court in this regard.
