The Ministry of Civil Aviation, in Notification F. No. AV-19032/5/2015-AAI-MOCA dated 11th July 2023, in exercise of powers under sub-section (a) of Section 26 of the National Civil Aviation Policy, 2016 and with the approval of the Competent Authority, made a further amendment to the National Civil Aviation Policy, 2016 (originally published in the Gazette of India, Extraordinary, Part I, Section 1, dated 29th June 2016) by inserting a proviso in clause (d) of paragraph 14 exempting from the GAGAN mandate: aircraft for which the aircraft/avionics Original Equipment Manufacturers have communicated that the aircraft cannot be made GAGAN-compliant due to technology challenges and design change is not feasible, as ascertained by the Directorate General of Civil Aviation, and aircraft manufactured prior to 1st July 2021; the notification was signed by Rubina Ali, Joint Secretary.

EXTRAORDINARY PART I—Section 1 PUBLISHED BY AUTHORITY No. 173] NEW DELHI, WEDNES DAY, JULY 12, 2023/ASHADHA 21, 194 5 CG-DL-E-12072023-247246 MINISTRY OF CIVIL AV IATION NOTIFICATION New Delhi, the 11th July, 2023 F. No. AV-19032/5/2015 -AAI-MOCA.—In exercise of the powers conferred by sub -section (a) of section 26 of the National Civil Aviation Policy, 2016, the Central Government with the approval of the Competent Authority, hereby makes the following further amendments in the National Civil Aviation Policy, 2016, namely: - In the said Policy, in paragraph 14, in clause (d), the following proviso shall be inserted namely: - “The following category of aircraft may be considered for exemption from the GAGAN mandate: (i) Aircraft, wherein the aircraft/ avionics OEMs have communicated that the airc raft cannot be made GAGAN compl iant due to technology challenges and the possibility of the design change is not feasible and the same has been ascertained by DGCA . (ii) Aircraft which have been manufactured prior to 01.07.2021. ” RUBINA ALI, Jt. Secy.
