Detailed Summary

The Andaman and Nicobar Islands Co-operative Societies (Amendment) Regulation, 2025 (No. 5 OF 2025), promulgated by the President in the Seventy-sixth Year of the Republic of India, amends the Andaman and Nicobar Islands Co-operative Societies Regulation, 1973 (Reg. 3 of 1973). This Regulation extends to the entire Union territory of the Andaman and Nicobar Islands and will come into force on a date appointed by the Administrator via notification in the Official Gazette. In exercise of powers conferred by article 240 of the Constitution, the Regulation primarily substitutes section 6 of the principal Regulation with a new provision stating that no member of a co-operative society, other than the Government, shall hold more than one-fifth of the total subscribed share capital. Additionally, it amends section 41 of the principal Regulation by substituting the third proviso, stipulating that the dividend rate declared by the society shall be decided in the General Body meeting, subject to the allocation of a reserve fund under section 41 and the Co-operative Education Fund under section 43. The Regulation was issued by the Ministry of Law and Justice (Legislative Department) on November 10, 2025, and signed by President Droupadi Murmu and Dr. Rajiv Mani, Secretary to the Govt. of India.

(1) This Regulation may be called the Andaman and Nicobar Islands Co-operative Societies (Amendment) Regulation, 2025. (2) It extends to the whole of the Union territory of the Andaman and Nicobar Islands. (3) It shall come into force on such date as the Administrator may, by notification in the Official Gazette, appoint. Short title, extent and commencement. For section 6 of the Andaman and Nicobar Islands Co-operative Societies Regulation, 1973 (hereinafter referred to as the principal Regulation), the following section shall be substituted, namely:— "6. No member of a co-operative society, other than the Government, shall hold more than one-fifth of the total subscribed share capital of such society.". 3. In section 41 of the principal Regulation, for the third proviso, the following proviso shall be substituted, namely:— "Provided also that the rate of dividend, to be declared by the society, shall be decided in the General Body meeting, subject to allocation of reserve fund under this section and the Co-operative Education Fund under section 43.".
