No. 25-16/18/2023-PG), issued under Section 164 of the Electricity Act, 2003, confers on M/s ReNew Surya Aayan Private Limited (registered at 138, Ansal Chambers-II, Bhikaji Cama Place, New Delhi-110066) all powers that a telegraph authority possesses under the Indian Telegraph Act, 1885 for laying a dedicated overhead 220 kV double-circuit transmission line connecting its 300 MW Solar Power Plant in Jaisalmer, Rajasthan (Renew Surya Aayan solar plant to Fatehgarh-III PS ISTS substation), passing through villages in Fatehgarh tehsil, Jaisalmer district and Sheo tehsil, Barmer district. The Central Electricity Authority had earlier granted prior approval under Section 68(1) of the Act via letter dated 8 June 2022; public notice was published in Indian Express, Dainik Navjyoti and Prabhat Abhinandan (all dated 12 April 2023) and in the Weekly Gazette of India dated 6 May 2023, with one objection from M/s Juniper Green Energy Private Limited later withdrawn. The 25-year approval is subject to conditions including obtaining consents from local bodies, Railways and Highways authorities, compliance with Appropriate Commission regulations, operation only after Electrical Inspector approval, submission of clearances from Civil Aviation and Defence authorities, and, where the route falls within Great Indian Bustard (GIB) potential/priority areas, compliance with the Hon'ble Supreme Court's order dated 19 April 2021 in Petition No. 838 of 2019 regarding undergrounding or bird diverters. L. -33004/99 EXTRAORDINARY PART II —Section 3 —Sub-section ( ii) PUBLISHED BY AUTHORITY No. 4245] NEW DELHI, WEDNESDAY , OCTOBER 11 , 2023/ ASVINA 19, 1945 CG-DL-E-11102023-249322 MINISTRY OF POWER ORDER New Delhi, the 11th October , 2023 S.O. 4416 (E).—Whereas M/s ReNew Surya Aayan Private Limited, the applicant with its registered address at 138, Ansal Chambers -II, Bhikaji Cama Place, New Delhi – 110066, India, has applied for authorization under Section 164 of the Elect ricity Act, 2003 for laying of overhead transmission line unde r “Installation of the dedicated overhead transmission line included in the transmission system for providing connectivity to Renew Surya Aayan Private Limited for its 300 MW Solar Power Plant in Jaisalmer, Rajasthan”. And whereas, Central Electricity Au thority (CEA), Ministry of Power, Government of India vide its letter CEA -PS-11-21(25)/1/2018 -PSPA -I Division -I/22099/2022 dated 08.06.2022 had granted prior approval under section 68(1) of the Electricity Act, 2003 for the overhead line covered under “Ins tallation of the dedicated overhead transmission line included in the transmission system for providing connectivity to Renew Surya Aayan Private Limited for its 300 MW Solar Power Plant in Jaisalmer, Rajasthan”. M/s ReNew Surya Aayan Private Limited has published notice for transmission scheme in local newspapers Indian Express (in English) dated 12.04.2023, Dainik Navjyoti (in Hindi) dated 12.04.2023, Prabhat Abhinandan (in Hindi) dated 12.04.2023 and in Weekly Gazette of India dated 06.05.2023 for the g eneral public to make observations/representations on the proposed transmission route within 2 Months from the date of publication. Subsequently, M/s Renew Surya Aayan Private Limited has submitted an affidavit dated 14.08.2023 declaring that one (01) obje ction was received from M/s Juniper Green Energy Private Limited (JGEPL) vide email dated 18.05.2023 within two months from the date of publication in Gazette. However, the same was withdrawn by M/s JGEPL vide email dated 12.06.2023. Further, no other obje ctions/representations have been received from the public within two (02) months from the date of publication of Public Notice for the above transmission scheme in Newspapers/ Gazette of India. And now the applicant has requested to confer upon him, all th e powers under section 164 of the Electricity Act, 2003, which the telegraph authority possess under the Indian Telegraph Act, 1885 with respect to the placing of telegraph lines and posts for the purpose of a telegraph established or maintained by Governm ent or to be so established or maintained for laying of electric lines under “Installation of the dedicated overhead transmission line included in the transmission System for providing connectivity to Renew Surya Aayan Private Limited for its 300 MW Solar Power Plant in Jaisalmer, Rajasthan”. The following overhead line is covered under this scheme: 1. Renew Surya Aayan Pvt. Ltd. solar power plant – Fatehgarh -III PS (new) (ISTS substation) 220 kV S/c line on D/c tower. The transmission line covered under the above scheme will pass through, over, around and between the following villages, towns and cities of Rajasthan: Sl. No. Name of Villages Tehsil District 1. Mandai, Neemba, Sanjeet, Rabri Chak Fatehgarh Jaisalmer 2. Matuon Ki Dhani, Kalijal, Negrada, Aant ra, Sheo Sheo Barmer Now, after careful consideration, Ministry of Power, Government of India, under section 164 of the Electricity Act, 2003, confers all the powers to M/s ReNew Surya Aayan Private Limited for laying above overhead line, which telegraph authority possesses under the Indian Telegraph Act, 1885 with respect to placing of telegraph lines and posts for the purposes of a telegraph established or maintained, by Government or to be established or maintained subject to following terms and conditi ons for installing the above mentioned line, namely: i. The approval is granted for 25 years. ii. The Applicant shall have to seek the consent of the concerned authorities i.e., local bodies, Railways, National Highways, State Highways etc. before erection of pro posed line. iii. The Applicant shall have to follow regulations/codes of the Appropriate Commission regarding transmission, O&M, open access, etc., framed under Electricity Act, 2003. iv. The Applicant shall operate the line after approval of Electrical Inspector / Chief Electrical Inspector of Central Government. v. The approval is subject to compliance of the requirement of the provisions of the Electricity Act, 2003 and the rules made there under by the applicant. vi. M/s ReNew Surya Aayan Private Limited shall have to submit the requisite clearances to Central Electricity Authority after obtaining the same from concerned authorities like Civil Aviation, Defense etc., at the time of Electrical Inspection. vii. In case, the route of above overhead lines (or some portion of the route of above overhead line) falls in the Great Indian Bustard (GIB) potential area (or priority area) marked in the map which is part of the order of the Hon’ble Supreme Court order dated 19.04.2021, in the petition No.838 of 2019 regarding GIB case, th e applicant has to comply with the directions of the Hon’ble Supreme Court, with regard to undergrounding of the above overhead transmission line and/or fixing of bird diverters, as the case may be as per the Hon’ble Supreme Court Order dated 19.04.2021 an d the directions of the technical committee constituted by the Hon’ble Supreme Court in this regard.
