The Ministry of Environment, Forest and Climate Change, by notification S.O. 5238(E) dated 8th December 2023, in exercise of powers under sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) and in supersession of Notification S.O. 1008(E) dated 17th September 2002, confirms that the Central Government, vide Notification No. S.O. 3946(E) dated 5th September 2023, constituted a permanent authority known as the Central Empowered Committee to monitor and ensure compliance with orders of the Supreme Court in Writ Petitions (Civil) No. 202/1995 and 171/1996, covering environment, forest and wildlife matters, and to recommend measures to State and Central Governments for effective implementation of the Act and Court orders. The following are appointed to the Committee with immediate effect for three years or until age 66, whichever is earlier: Sri Siddhant Das (Chairman), Sri Chandra Prakash Goyal (Member), Sri Sunil Limaye (Member), Dr. J.R. Bhatt (Member), and Ms. Banumathi G, Assistant Inspector General of Forests (Member Secretary). Members are appointed in their personal capacity; the Committee functions under the administrative control of the Ministry of Environment, Forest and Climate Change, headquartered in Delhi, with jurisdiction extending to the whole of India, and the Ministry is to provide office accommodation, manpower and budgetary support and to meet the Committee's expenditure. 7605 GI/202 3 (1) EXTRAORDINARY PART II —Section 3 —Sub-section ( ii) PUBLISHED BY AUTHORITY No. 5009 ] NEW DELHI, FRIDAY , DECEMBER 8, 2023/ AGRAHAYANA 17, 1945 CG-DL-E-09122023-250520 MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 8th December , 2023 S.O. 5 238(E).—In exercise of the powers conferred by sub -section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1988) (hereinafter referred to as the said Act) and in supersession of the Notification S.O. 1008 (E) dated 17th September 2002, the Central Government has vide Notification No S.O. 3946 (E) dated 5th September,2023 constituted a permanent authority to be known as the Centra l Empowered Committee, (hereinafter referred to as the Committee) for the purposes of monitoring and ensuring compliance of the orders of the Hon’ble Supreme Court in the matter Writ Petitions (Civil) No. 202/1995 and 171/1996, covering the subject matters of Environment and Forest & Wildlife, and related issues arising out of the said orders and to suggest measures and recommendations generally to the State as well as Central Government, for the more effective implementation of the Act and other orders of the Court. 2. Accordingly, following are hereby appointed to this committee with immediate effect for a period of three years or till they attain the age of Sixty -Six years or till any other order of the Central Government, whichever is earlier: 1) Sri Sid dhant Das, Chairman 2) Sri Chandra Prakash Goyal, Member 3) Sri Sunil Limaye, Member 4) Dr J.R. Bhatt, Member 5) Ms Banumathi G, Assisstant Inspector General of Forests, Minsitry of Environment, Forest & Climate Change - Member Secretary 3. The members of the Committee are appointed in their personal capacity and the Committee shall function under the administrative control of the Central Government in the Ministry of Environment, Forest & Climate Change with its headquarters at Delhi . 4. The salaries and allowances pa yable to, and the other terms and conditions of service of, the Chairperson and Members, will be prescribed separately, provided that neither the salary nor perks and the other allowances nor the other terms and conditions of service of the Chairperson or a Member shall be varied to his disadvantage after his appointment. 5. The Ministry of Environment, Forest & Climate Change shall provide suitable and adequate office accommodation for the Committee and requisite manpower, budgetary support and infrastruc ture to discharge the functions and powers delegated to the Committee. 6. The expenditure incurred on the working of the Committee including salary or remuneration to the members and supporting staff, will be met by Ministry of Environment, Forest & Clim ate Change. 7.
